GLEN HARBOR BLVD - SUITE 201 GLENDALE,ARIZONA 85307 AIRPORT CONFERENCE ROOM FEBRUARY 12,2014 6:00 P.M. I. CALL TO ORDER The meeting was called to order at 6:03 p.m. by Chair Ten-ill with the following Commissioners present: Walt Chaney, Victoria Rogen, Scott Hadley, Quentin Tolby, and Joe Mascaro. Also present were Walter Fix, Airport Administrator; James Gruber, Assistant City Attorney; Basil Allen, Glendale Airport Tower; Tito Suazo, Aerosim Aviation; Bob Stratton and Justin Durham II. APPROVAL OF MINUTES OF THE PREVIOUS MEETING Commissioner Chaney motioned to approve the January 8, 2014 meeting minutes with the following changes: • Page 2, section V, item 1: Change the word "CNS" to "C&S". Commissioner Mascaro made the second. The motion carried 6—0. III. REQUEST FOR CONTINUANCE OR WITHDRAWAL OF ITEMS. None. IV. AIRPORT BUSINESS 1. New Commissioner& Loyalty Oath Commissioner Hadley gave a brief background of himself and signed the Loyalty Oath. 2. Open Meeting Law Presentation Mr. Gruber briefed the Commission on the Open Meeting Law (OML) policy. Mr. Gruber stated that the OML is defined by Arizona State Statute. Mr. Gruber provided a presentation, which included the following information: • What Does It Say? o "All meetings of any public body shall be public meetings and all persons so desiring shall be permitted to attend and listen to the deliberations and proceedings. All legal action of public bodies shall occur during a public meeting." A.R.S. 38-431.01(A) • Meeting o "Meeting" means the gathering, in person or through technological devices, of a quorum of the members of the public body at which they discuss, propose or take legal action...including deliberations..." A.R.S. 38-431(4) 1 o So, the definition of"meeting" includes: • In person gatherings • Telephonic gatherings • Email/Social media gatherings • Beware the "forward" button — If a Commissioner forwards an email to another Commissioner, and that Commissioner forwards the email to another Commissioner and so on, which could eventually establish a quorum and Open Meeting Law will have then been violated. • Relaying messages through third parties — Staff cannot be used to relay messages to avoid Open Meeting Law. o Quorum: Majority of members • Public Body o Applicable to any"public body". o Public Body — Includes any political subdivision and special or advisory committees appointed by the public body, such as this Commission. o Does not include judicial proceedings, legislative conferences or caucuses. • Deliberations o OML applies not only to decisions made by public bodies,but also to the discussions. • Legal Action o "Legal action" is a collective decision or commitment pursuant to the body's scope of duties. • Role of Staff o Staff's role is to help you as Commissioners • Provide facts,background,history • In one-on-one meetings and in workshops • Develop the agenda o Staff cannot be used to circumvent the OML • Agenda o Requires at least 24 hours notice with an agenda. o Can only discuss and take action on agenda items. o Items not on agenda—members of the public may make statements to the Commission, but no discussion may take place. The best practice is to put the item on a future agenda for discussion. • Agenda&Miscellaneous o Summaries — If a "summary" is listed on the agenda, a summary of current events can be reported but not discussed. o Records—Meetings must be recorded or notes taken. Legal action taken and a recording or minutes posted on City website within ten days of approval. o Members of public can record a meeting. • Violations o Legal actions taken are void if meeting not noticed or posted with an agenda. o Attorney General investigates complaints of violations of OML. o Any person affected by a violation may bring a lawsuit for enforcement. o $500 penalty for each violation. o Officials can lose jobs. • Public Record Law o A.R.S. 39-121-161 o Public records are open to public inspection. 2 a discussion to others. Mr. Gruber replied in the positive. at the meeting. Mr. Fix stated that he revised the agenda format several years ago to include what is occurring at the Airport in a broad sense. Commissioner Tolby stated that last month, Mr. Gruber asked that a discussion cease because it was off the agenda topic. Commissioner Chaney interjected that that discussion involved fuel prices. Commissioner Chaney felt that it was a good discussion. Mr. Gruber agreed but added that he suggested that the topic be put on a future agenda so that members of the public could have a chance to attend the meeting and comment on the subject. Commissioner Mascaro expressed concern about the necessity of having a lawyer present at the Commission meetings for potential discussions. Commissioner Tolby wondered about the presence of a City attorney at the monthly meetings of approximately twenty City Commissions in regards to the tight City budget. Commissioner Tolby did not remember City attorneys attending Commission meetings in the past. Mr. Gruber stated that it was not his intent to speak at all of the Commission meetings. Chair Terrill stated that Mr. Gruber will be utilized as a resource at the Commission meetings. Mr. Gruber explained that there was a question with the OML and City Council and therefore, Council is stressing that the Attorney General's Office spread the word regarding the OML. Chair Terrill thanked Mr. Gruber for his presentation. 3. Retreat—Activity Ideas Chair Terrill stated that the Commission has historically held an annual retreat in place of the May meeting on the second Saturday in May. Chair Terrill stated that last year, the retreat was held at the Airport with a breakfast at the Airport restaurant prior to the meeting. Chair Ten-ill facilitated a discussion on ideas for the annual retreat. Commissioner Tolby commented that last year's retreat did not have much substance. Commissioner Tolby stated that at the retreat, he would like to discuss the main issue of the Airport "dying" and what can be done to stop it. Commissioner Rogen suggested that the FBO give a presentation to the Commission regarding interactions with the pilots and the public and how business is going. Commissioner Rogen stated that pilots come to Airports for certain treatment, gas prices and amenities. Commissioner Rogen stated that before the Commissioners can help give life to the Airport, the Commissioners must know the players who really have control in promoting the Airport. Commissioner Mascaro stated that fuel price issues are the same all over. Commissioner Mascaro wondered about plans for the Super Bowl. Commissioner Chaney suggested a meeting with the pilots and other interested parties whereby they could voice their concerns and suggestions to the Commission. Commissioner Chaney stated that it would be beneficial to spend time to hear the opinions of the public in regards to the Airport. Commissioner Chaney noted that the Commission's stated role is to advise the City Council on the maintenance and operation of the Glendale Municipal Airport and its role in statewide air transportation. Commissioner Chaney stated that the Commission cannot give proper advice until the Commission finds out what the public and users of the Airport like and dislike about the Airport. 4 Chair Terrill agreed and added that he would work with Mr. Fix and Mr. Gruber as to setting up the session. Commissioner Tolby would like to have someone from the federal government come to the retreat to explain if other Airports are experiencing the same type of scrutiny. Mr. Fix stated that a representative from the FAA was at the Airport before, but not at a Commission meeting. Commissioner Tolby stressed that the federal representative should be at a meeting. Mr. Fix commented that Mr. Tony Garcia of the FAA out of the LA District Office was invited to a Commission meeting but was not able to attend. Commissioner Rogen stated that a presentation should be given to the Commission by the City depaitnent responsible for the Commission. Commissioner Rogen added that the City department or Council may already have plans for the Airport that have not been announced. Commissioner Hadley agreed with the suggestion of a public input session but agreed that it would be more beneficial to have a representative from the Public Works department make a presentation to the Commission in April, prior to the retreat. Commissioner Hadley stated that this would give the Commissioners knowledge from the City prior to the public input meeting. Commissioner Hadley noted that the Commission would be better able to advise City Council with the information from Public Works coupled with the public comments. Commissioner Tolby commented that he would like to see the owners of the Valley Aviation Services hangars at the Airport give a presentation on their future plans and how the Airport can help them. Commissioner Tolby stated that if those hangars were filled, it would be good for the Airport. Chair Terrill will work with Mr. Fix and Mr. Gruber regarding all of the suggestions for the retreat. Commissioner Mascaro stated that it would be good to have a presentation on where the Airport is in comparison to others. Mr. Fix replied that he can give a presentation on the general state of aviation and how the Airport compares locally, statewide and nationally. V. SUMMARY OF CURRENT EVENTS Mr. Fix reported on current airport activities: 1. Construction Projects/Grants: o Council approved the contract for C&S Engineering for the apron design and rehabilitation. Design work should be ready by the end of June. o In regards to the Conair property, the FAA is still working on the Environmental Assessment FONSI. Mr. Fix sent an email today to the FAA ADO regarding this issue. Currently, the FAA issue is with staffing. o Mr. Fix will close out the blast fence and blast pad grants. 2. Budget/Expenses/Revenue: The City is currently undergoing intense talks regarding the next fiscal year budget. More information will be provided as it is known. 3. Economic Development/Airport Business Plan: The plan was distributed last month and comments and suggestions are welcome as the plan is dynamic. 4. Land Use Planning/Airspace: o On Tuesday, February 18'' at 1:30 p.m. at Council Workshop on Camelback Ranch Land Use Planning will be held. o Mr. Fix attended an FAA workshop. The Airport's Runway 19 Departure Procedure has been pushed out to September 2014. 5 5. FAA Grant Assurance Compliance: Mr. Fix attended the Southwest American Association of Airport Executive Conference on January 25th. The event is attended by airport personnel and legal counsel. The topic of the day was Part 16 Complaints and Compliance and it was very informative. 6. Super Bowl XLIX Planning: Last week, Mr. Fix received a call from the FAA ATC administrative staff. The FAA is contacting all Airports to request the names of all businesses, flight schools, tenants and others. The FAA wants to disseminate information regarding the Super Bowl to all impacted parties. Chair Terrill inquired if airplanes would be parked at the Airport during the Super Bowl. Mr. Fix estimated 100 jets to be at the Airport. Chair Terrill inquired about a TFR for the Super Bowl. Mr. Allen stated that aircraft can fly in to the Airport up to one hour before the game begins. 7. City of Glendale Organizational Changes: Last month, Mr. Fix handed out a new organizational chart. Mr. Fix stated that there have been more changes and the Transportation Division will be under Public Works beginning July 1, 2014, and Mr. Jamsheed Mehta has taken a new job as the Deputy Town Manager of Maricopa. Mr. Mehta's last day with the City of Glendale is March 12th. 8. Air Traffic Operations/Based Aircraft (Quarterly): Mr. Fix reported that there are currently 285 quarterly based aircraft with an average of 283 over the past several years. Mr. Allen reported that operations for January 2014 are just slightly below January 2013. Mr. Allen was hopeful that operations would increase due to the good weather, possible pilots relocating from the Goodyear Airport and possibly a little more TransPac business. Mr. Allen announced that the Luke Air Force Base Air Show is still scheduled for March 12th through the 17th, with public days of March 15th and March 16th Commissioner Rogen asked for an update on the court cases for the hangar inspections. Mr. Fix stated that the court date is now February 25th VI. CALL TO THE PUBLIC No comments were made. VII. NEW BUSINESS REQUESTS (Future Agenda Items) The following items were proposed: • A report on the state of general aviation including local, regional and national statistics and trends • City of Glendale direction regarding the airport • Ideas for airport revitalization • An update on the airport restaurant VIII. NEXT MEETING TIME The next meeting will be held at 6:00 p.m. on the second floor Conference Room of the Airport terminal building on Wednesday, March 12, 2014. IX. COMMISSION COMMENTS AND SUGGESTIONS Commissioner Chaney stated that the Airport Tower is a tremendous asset that can really sell the Airport. Commissioner Chaney commented that is very refreshing to come to the Airport and do a pattern and not shoot a five mile final. Commissioner Chaney added that the Tower staff is very professional. 6
