GLENDALE CITY COUNCIL MEETING
Council Chambers
5850 West Glendale Avenue
September 10, 2013
7:00 p.m.
The meeting was called to order by Mayor Jerry P. Weiers. Vice Mayor Yvonne J. Knaack and
the following Councilmembers were present: Norma S. Alvarez, Samuel U. Chavira, Ian Hugh,
Manuel D. Martinez and Gary D. Sherwood.
Also present were Brenda Fischer, City Manager; Julie Frisoni, Interim Assistant City Manager;
Michael Bailey, City Attorney; and Pamela Hanna, City Clerk.
Mayor Weiers called for the Pledge of Allegiance and a moment of silence was observed.
CITIZEN COMMENTS
Micaela Dailey, a Yucca District resident, said there is flood irrigation where she lives at 83rd
Avenue and Bethany Home Road. She said the residents are responsible for a ditch that runs
parallel to the canal in that area. They got a notice from SRP saying the ditch needed to be
cleaned out. Her father and some friends were attacked by bees and wasps while cleaning out
the ditch. After calling SRP about the bees, she was informed it was her problem. She is also a
crisis response volunteer for the Glendale Fire and asked some of the firefighters and some
police officers what to do about the bee problem. She finally contacted her Councilmember's
office and was given the name of Mark Fortkamp, who helped her resolve the problem. She
wanted to let the Councilmembers know what an amazing experience it was dealing with Mark
about this health and safety issue. She said SRP was also involved in resolving the problem.
SRP identified the area in the canal that is their responsibility and they will remove the trees.
The beehives, some of which were Africanized bees, were removed. City employee Anthony
Garcia, Bulk Trash Supervisor, also came out and met with the residents and told her to call the
city the next time this area needed to be cleaned and they would help get the area cleaned up.
She said it was a perfect example of putting the community first and wanted to thank everyone.
Councilmember Chavira thanked Ms. Dalley for sharing her experience and thanked our
incredible city staff.

Approval of the minutes of the August, 13,2013 City Council Meeting
It was moved by Vice Mayor Knaack, and seconded by Councilmember Sherwood, to dispense
with the reading of the minutes of the August 13, 2013 Regular City Council meeting, as each
member of the Council had been provided copies in advance, and approve them as written. The
motion carried unanimously.

It was moved by Councilmember Martinez, and seconded by Councilmember Chavira,

PROCLAMATIONS AND AWARDS
NATIONAL PREPAREDNESS MONTH PROCLAMATION

ACCEPTED BY: Rebecca Ontiveros and John Torres,Volunteers with Citizen Corps
This is a request for City Council to proclaim September 2013 as National Preparedness
Month to encourage preparedness for disasters or emergencies in homes, businesses and
the community. National Preparedness Month is sponsored by the Federal Emergency
Management Agency's (FEMA) Ready Campaign in partnership with Citizen Corps and the

Advertising Council. Rebecca Ontiveros and John Torres, who work with.Citizen Corps and
are Glendale residents,will be present to accept the proclamation.
Rebecca Ontiveros spoke and accepted the award on behalf of the Ocotillo District,
Councilmember Alvarez and the city at large. She said the city needed a plan of action to
keep the city and its citizens safe.
John Torres offered a prayer to commemorate acceptance of this proclamation
John Flores was present to accept the proclamation.
CONSENT AGENDA
Ms. Brenda Fischer, City Manager, read agenda item numbers 1 through 3.
1. SPECIAL EVENT LIQUOR LICENSE, DEEP WITHIN REHAB CENTER, INC.
PRESENTED BY:Susan Matousek, Revenue Administrator
This is a request for City Council to approve a special event liquor license for the Deep
Within Rehab Center, Inc. The event will be held at Westgate Waterdance Plaza located at
6770 North Sunrise Boulevard on September 15, October 6, 17, and 27, November 10 and
24, and December 8 and 29, 2013. The purpose of this special event liquor license is for
fundraising at the Arizona Cardinals Football games tailgate parties.
Staff is requesting Council to forward this application to the Arizona Department of Liquor
Licenses and Control with a recommendation of approval.
2. LIQUOR LICENSE NO. 5-10975, OREGANO'S PIZZA BISTRO
PRESENTED BY:Susan Matousek, Revenue Administrator
This is a request for City Council to approve a new, non-transferable series 12 (Restaurant)
license for Oregano's Pizza Bistro located at 6738 West Bell Road. The Arizona Department
of Liquor Licenses and Control application (No. 12079586) was submitted by Mark Steven
Russell.
Staff is requesting Council to forward this application to the Arizona Department of Liquor
Licenses and Control with a recommendation of approval.
3. EXPENDITURE AUTHORIZATION FOR MARICOPA COUNTY DETENTION SERVICES
PRESENTED BY:Debora Black, Police Chief
This is a request for City Council to approve expenditure authorization by the City Manager
to Maricopa County for detention services in an amount not to exceed $2,035,418.

It was moved by Vice Mayor Knaack and seconded by Councilmember Martinez, to
approve the recommended actions on Consent Agenda Item Nos. 1 through 3, and to
forward Special Liquor License for Deep Within Rehab Center, Inc. and Liquor
License Application No. 5-10975 for Oregano's Pizza Bistro to the State of Arizona
Department of Liquor Licenses and Control, with the recommendation for approval.

4. ADDENDUM TO INTERGOVERNMENTAL AGREEMENT WITH ARIZONA DEPARTMENT
OF TRANSPORTATION FOR DATABASE ACCESS

Division (MVD), for database access. The Addendum will extend the Human Resources &
Risk Management Department's access to the MVD database.

This is a request for Council to waive reading beyond the title and adopt a resolution
authorizing the City Manager to accept the 2013 Edward Byrne Memorial Justice Assistance
Grant award in the approximate amount of$86,334. If approved, the grant funding will be

used toward a portion of the cost of replacing the current Computer Aided Dispatch (CAD)
and Records Management System (RMS) with a more advanced system.

11. AMENDMENTS TO CITY COUNCIL GUIDELINES

10. AMENDMENT TO CITY COUNCIL MEETING RULES AND PROCEDURES
PRESENTED BY: Kristen Krey, Council Services Administrator
RESOLUTION: 4721
This is a request for City Council to waive reading beyond the title and adopt a resolution
authorizing an amendment to the City Council Meeting Rules and Procedures.
Ms.Krey gave a history of reviewing the draft guidelines for including a prayer or
invocation to be placed on the voting meeting agenda.
Councilmember Martinez asked what the response was from citizens regarding this issue.
Ms. Krey said there were 25 written comments on this matter. She said 22 of those
comments did not support prayer,but did encourage council to continue with the moment
of silence. Three of the comments were supportive of this item.
Mr. Stobberingh,a Yucca resident, said with all the other issues facing the city,the council
does not need to change council procedures to include prayer. He said implementing the
prayer raises more questions and problems. He spoke about some problems that might
come up by allowing prayer at the council meetings,which included how the speakers are
chosen, and by whom,who will be allowed to speak and what happens if a speaker does not
adhere to the guidelines. He asked if there will be any check on the speaker's credentials
and if lay people will be allowed to offer a prayer. He asked if the entire process would be
transparent. He asked if there would be repercussions if a speaker did not adhere to the
suggested guidelines. He also said there were so many factors to consider that could cause
controversy. The city has successfully conducted their business for so many years without
a prayer, he did not feel it was necessary to start offering a prayer at the beginning of the
meeting now. He said the pledge of allegiance and moment of silence is adequate to show
their respect. He asked the council to vote against this proposed change. He felt the council
meetings should remain as secular as possible and this was the least controversial and
biased way to run the meetings. He said the city should not make these changes as they
could cost the city money down the road with respect to legal challenges.
Vice Mayor Knaack said because of the prayer,she cannot support this item. She felt this is
a personal agenda item and not one that the majority of citizens support. Council has
received many emails from religious organizations that oppose the inclusion of prayer at
the meetings. She said her own survey and a survey in the Glendale Star had similar
results, as the moment of silence being the majority opinion. The twenty point guideline
for the prayer makes a simple and meaningful thing complicated and bureaucratic. She
said she cannot support this.
Councilmember Martinez supported Vice Mayor Knaack's comments. He said he supported
keeping the moment of silence so everyone could pray or reflect as they wished, and going
to a prayer could cause some problems. He said public feedback received opposed the

prayer as well. He quoted from a newspaper article and said, "Prayer should be found in
the churches and home of those who wish to do so,not in secular settings such as
government meetings,"and also mentioned in the article was the separation of church and
state. Councilmember Martinez quoted another newspaper article that said, "It's a bad
idea. Let's get real. These Christians are trying to hijack our secular government. No
matter the claims that other faiths will be represented,we all know it will be all about Jesus
ninety percent of the time. It is divisive and accomplishes nothing more than making
Christians feel superior to everyone else." Two more quotes from a letter to the Mayor and
council from the Freedom from Religion Foundation. The first is, "Government prayer is
unnecessary,inappropriate and divisive calling upon Councilmembers and citizens to pray
would be coercive, embarrassing and beyond the scope of secular government.
Councilmembers are free to pray privately or to worship on their own time in their own
way. They do not need to worship on taxpayer's time and the government should not lend
its power and prestige to religion amounting to a governmental endorsement that excludes
the non-religious and people for whom religion is a personal,private matter." The second
quote from that letter is, "Prayer at government meetings continues to be litigated, divisive
and problematic for local governments across the nation precisely because of this legal
uncertainty and instability. The best course is to not have prayers if you wish to pray prior
to the meeting, do so on your own time in your own way. Do not make it part of the secular
business of your local government. Councilmember Martinez also quoted Father Jim
Turner, Pastor of St.Thomas Moore Church, from an e-mail sent to Mayor and Council,
"Dear Mayor Weiers and Councilmembers, I am aware of an ongoing discussion regarding
the appropriateness of opening city council meetings with public prayer and I thought I
would offer my thoughts on the subject. While I naturally encourage my parishioners and
others to pray frequently, I would be very hesitant to support such a move on the part of
the council. My understanding of the proposal before the council is that volunteer
members of the local clergy and other religious leaders would offer a generic prayer to an
unnamed deity at the start of council sessions. I must wonder what the point of such a
prayer would be. As a Catholic Christian, I offer prayers to the Father through Jesus Christ
as most other Christians do. Jews, Muslims, Hindus, Native Americans, Buddhists and
others obviously have their own way of invoking the deity. To suggest that I, as a Catholic
priest, and others, adjust our prayers as to make them non-offensive to members of other
religious traditions is inappropriate and even offensive, and this does not even address the
large number of nonbelievers who are members of the Glendale community and for whom
any public prayer would be offensive." Councilmember Martinez quoted a sentence from
another paragraph, "I generally find when people try to mix religion and politics,especially
in the civil arena,there is some agenda at work." He stated he hesitated to support prayer
at City Council meetings and his preference is for a moment of silence.
Mayor Weiers said he disagreed with several of the comments made. He said the city is
extremely diverse. He spoke about the freedom of speech and the freedom of religion. He
said the city needs help and he didn't see anything wrong with asking for help from a
higher power. He said they will allow any religion. He said he never saw any controversy
with this issue in the legislature.

Councilmember Martinez quoted Paul Giblin of the Arizona Republic in an August 20th
article, "Weiers,a former state representative,told his colleagues that prayers have been
offered before sessions in the state legislature for more than a century without causing an
issue, but a secular invocation caused a stir three months ago. Representative Juan Mendez
of Tempe,who is Atheist, used his turn to offer the invocation on May 21St to ask
lawmakers to celebrate their'shared humanness'. Continuing with the quote,
Councilmember Martinez said, "This is a room in which there are many challenging
debates, many moments of tension of ideological division, of frustration, he said at the time,
but this is also a room where my secular humanness tradition stresses,by the very fact of
being human,we have much more in common than we have differences." Paul Giblin
continued quoting, "The following day, Representative Steve Smith,a representative of
Maricopa who is Christian, asked lawmakers to join him in a second daily prayer in
repentance for Mendez's secular invocation. The debate surfaces fairly regularly. In 2011,
Litchfield Park Councilmember Pete Mahoney started walking out during prayers after the
council replaced its moments of silence with invocations that Mahoney felt were Christian
oriented. No disrespect was intended at the time, he said, I'm a Christian. I'm a true
believer in separation of church and state, Mahoney said. That same year,the Chandler
Unified School District went the opposite direction. It switched from public prayers to
moments of reflection after officials at the Arizona School Board Conference suggested that
boards avoid prayers to prevent lawsuits.
Mayor Weiers said he stood by his comments that during his term in the legislature, he
never saw any issues.
Councilmember Alvarez said she is voting for the prayer. She reminded everyone that the
dollar bill states "In God We Trust."
Councilmember Chavira said St.Thomas Moore was referred to as a man for all seasons,
and he is the patron saint of politicians and politics.

CITIZEN COMMENTS.
It was moved by Councilmember Hugh and seconded by Councilmember Alvarez, to
approve the recommended actions on Consent Agenda Item No. 10, including the
approval and adoption of Resolution No. 4721 New Series. The motion carried with
the following Councilmembers voting "aye": Alvarez, Chavira, Hugh and Weiers.
Members voting"nay": Knaack, Martinez and Sherwood.
PUBLIC HEARING-LAND DEVELOPMENT ACTIONS
12. ANNEXATION APPLICATION AN-190: 11748 WEST GLENDALE AVENUE (PUBLIC
HEARING REQUIRED)

This is a request for City Council to conduct a public hearing on the blank annexation
petition for Annexation Area No. 190 (AN-190) as required by state statutes. The
annexation is approximately five acres in size, and is located north of the northwest corner
of the 117th Avenue Alignment and Glendale Avenue. No other action of Council is required
at this meeting.
Mr. Froke provided explanation of photos for context of the property being discussed. He
said the purpose was to conduct a public hearing through state statutes for annexation
procedures. He said no action was needed by the council except for opening the public
hearing. He said the next steps were technical issues and they would come back with an
ordinance.
Mayor Weiers opened the public hearing on Agenda Item No. 12. As there were no
comments,Mayor Weiers closed the public hearing.
BIDS AND CONTRACTS
13. AWARD OF PROPOSAL 13-01 TO PHILIPS HEALTHCARE FOR DEFIBRILLATOR
SERVICE
PRESENTED BY: Mark Burdick, Fire Chief
This is a request for City Council to award proposal 13-01 and authorize the City Manager
to enter into a five-year agreement with Philips Healthcare for defibrillator service. If
approved, this agreement will ensure defibrillators used by the Glendale Fire Department
are up-to-date on software, ongoing maintenance, and semi-annual manufacturer
performance inspections.
Chief Burdick said these defibrillators are essential pieces of emergency equipment and the
services provided by Philips Healthcare are critical.

14. PROFESSIONAL SERVICES AGREEMENT WITH Y. S. MANTRI &ASSOCIATES, LLC FOR
TRAFFIC CONTROL IMPROVEMENTS

Staff is requesting City Council authorize the City Manager to enter into a professional
services agreement with Y. S. Mantri & Associates, LLC, in an amount not to exceed

$156,161, for design and construction administration services for traffic control
improvements at five locations in the Ocotillo District.
Ms. Colbath said Y.S. Mantri is on the Engineering Department's on-call list and they will
prepare plans and specifications that will be used to issue a bid for five projects and will
also provide construction administration for those projects. The improvements include a
new traffic signal at 59th Avenue and Hayward, a HAWK on Bethany Home Road between
60th and 61st Avenues, relocation of the traffic signal cabinet at 59th Avenue and Myrtle and
installation of new conduit and conductors at 58th Avenue and Glendale and 57th Avenue
and Glendale. Funding for these projects is available in the Transportation traffic signal
budget.
It was moved by Vice Mayor Knaack, and seconded by Councilmember Chavira, to
approve the Professional Services Agreement with Y.S. Mantri & Associates, LLC for

15. PROFESSIONAL SERVICES AGREEMENT WITH ARRINGTON WATKINS ARCHITECTS,
LLC FOR DESIGN AND CONSTRUCTION ADMINISTRATION SERVICES FOR THE
GLENDALE MUNICIPAL LANDFILL

Staff is requesting City Council authorize the City Manager to enter into a professional
services agreement with Arrington Watkins Architects, LLC in an amount not to exceed
$325,438 for design and construction administration services for the Glendale Municipal
Landfill (Landfill) Scale-House Relocation Project.
Mr. Kent said the landfill will undergo renovation over the next several years, and
Arrington Watkins Architects will assist in the design and construction administration.

Mr. Froke provided some history on this property. He said the property has been
purchased by D.R. Horton homes and they would like to change the configuration of phase
2 of the development, which would increase the lot size in that phase. Mr. Froke provided
photographs to assist in explaining the procedure.

updating the city's signature authority for banking transactions and appointing Brenda S.

periodically due to changes in the organization. The appointment of a City Treasurer is
authorized by the Glendale City Charter.
Councilmember Alvarez asked if there was a salary increase for this appointment. Ms.
MacLeod said there was no salary increase.

This is a request for the City Council to waive reading beyond the title and adopt a
resolution authorizing the City Manager to execute a license agreement between the City of
Glendale and NewPath Networks, LLC (NewPath) for the installation of a Distributed
Antenna System (DAS).
Mr. Rodzenko said this is for a new facility on a city streetlight located at the southwest
corner of Cabela Drive and Zanjero Boulevard. He said these are small antennas which are
attached to city streetlight poles, and the fees are consistent with fees charged by other
cities in the valley.

It was moved by Vice Mayor Knaack, and seconded by Councilmember Sherwood, to hold a
City Council Workshop at 1:30 p.m. in the Council Chambers on Tuesday, September, 17,
2013, to be followed by an Executive Session pursuant to A.R.S. 38-431.03. The motion

Mayor Weiers spoke about an event called Stand Up For Veterans to be held on September
