HomeMy WebLinkAboutMinutes - Minutes - Judicial Selection Advisory Board - Meeting Date: 8/27/2012 MINUTES OF THE CITY OF GLENDALE JUDICIAL SELECTION ADVISORY BOARD August 27, 2012—6:00 p.m. Glendale Municipal Office Complex, B-3 5850 West Glendale Avenue Glendale, AZ MEMBERS PRESENT: Jerry Berntsen, Chair Terrance Mead, Vice Chair Frederick Coury, Member Christina Rubalcava, Member Judge Ann Scott Timmer, Member Judge Randy Warner, Member Steven Keist, Member Judge Elizabeth Finn,Non-Voting Member STAFF PRESENT: Jim Brown, Acting Human Resources Director and Board Liaison Katie Douglas, Human Resources Generalist and Staff Representative Leona Vela, Human Resources Technician and Recording Secretary Cathy Clarich, City Court Administrator MEMBERS ABSENT: No Board members were absent. CALL TO ORDER Chair Jerry Berntsen called the meeting to order at 6:04 p.m. APPROVAL OF MINUTES FROM NOVEMBER 7, 2011 JSAB MEETING Judge Timmer moved to approve the minutes as presented and Judge Warner seconded the motion. It was voted unanimously to approve the Minutes as presented. OATH OF BOARD CHAIR JERRY BERNTSEN Board Member Jerry Berntsen, who was previously elected by the Board to serve a second one-year term as Chair,took his Oath at this time. BOARD ORGANIZATION Board Member Terrance Mead, who was previously elected by the Board to serve a second one- year term as Vice Chair, took his oath, which was administered by Chair Jerry Berntsen. BOARD ORGANIZATION Board Member Steven Keist, who was reappointed by the Maricopa Bar Association to serve a second three-year term as a JSAB member, took his Oath at the June 26, 2012 Glendale City Council Meeting. Mr. Keist's second term will expire April 23, 2015. BOARD ORGANIZATION Chair Jerry Berntsen referred to City of Glendale Organizational and Procedural Rules for JSAB which state: "No member may serve more than two terms as chair or two terms as Vice Chair, not including any term filled for the remainder of another member's unexpired term. Upon expiration of the Chair's term, whether a first or second term, the Vice Chair shall become the chair. If the Board selects the chair for a second term on the expiration of that Chair's first term, the Vice Chair shall remain in office for a second term." Accordingly, Vice Chair Terrance Mead shall become the Chair upon expiration of Jerry Berntsen's second term as Board Chair on November 29, 2012. BOARD ORGANIZATION Chair Jerry Berntsen invited Board Members to nominate candidates for the Vice Chair position which will be vacated by Terrance Mead on November 29, 2012. As there were no volunteers, Mr. Berntsen sought nominations from the Board. Judge Timmer moved to nominate Judge Randy Warner. Judge Warner asked if Judicial Officers have been Chair or Vice Chair in the past, stating he felt perhaps the Vice Chair position should be filled by one of the citizen members. Staff Representative Katie Douglas stated JSAB Organizational Rules did not dis-allow this. It was also determined that previously Judge Colleen McNally served as the Board's first Chair in 2002. Terrance Mead seconded the motion to nominate Judge Warner. There were no other nominations. Judge Warner accepted the nomination and the motion to elect Judge Warner as Vice Chair carried unanimously. Judge Warner's first term as Vice Chair will begin November 29, 2012. CALL FOR A VOTE TO ENTER EXECUTIVE SESSION Chair Jerry Berntsen requested a motion to enter executive session. Vice Chair Terrance Mead moved to enter executive session. Board Member Steven Keist seconded the motion and the motion carried unanimously. CALL FOR A VOTE TO RECONVENE INTO OPEN SESSION Vice Chair Terrance Mead moved to reconvene into Open Session and Judge Timmer seconded the motion. It was voted unanimously to reconvene into Open Session. REAPPOINTMENT INTERVIEW OF JOHN BURKHOLDER FOR CITY JUDGE Board Members interviewed John Burkholder for reappointment to City Judge. The interview was videotaped, a copy of which will be provided to the Mayor and City Council for their review, along with a copy of the interview questions asked of Judge Burkholder. PUBLIC COMMENT There were no comments from the public at this time. CALL FOR A VOTE TO ENTER INTO EXECUTIVE SESSION Vice Chair Terrance Mead moved to enter into Executive Session and Judge Timmer seconded the motion. It was voted unanimously to enter Executive Session. CALL FOR A VOTE TO RECONVENE INTO OPEN SESSION Judge Timmer moved to reconvene into Open Session and Judge Warner seconded the motion. It was voted unanimously to reconvene into Open Session. REAPPOINTMENT RECOMMENDATION OF JOHN BURKHOLDER TO CITY JUDGE Judge Timmer moved to recommend the reappointment of Judge John Burkholder to the Mayor and City Council. Board Member Christina Rubalcava seconded the motion. It was voted unanimously to recommend the reappointment of Judge John Burkholder to Mayor and Council. STAFF REPORT Staff Representative Katie Douglas informed the Board that the next meeting will focus on determining reappointment recommendations for Judge Finn and Judge Baxter, whose terms expire in March and April 2013 respectively. She also advised the Board that City Attorney Craig Tindall or a designee will attend the meeting to discuss the Open Meeting Law. BOARD COMMENTS Vice Chair Terrance Mead reminded those in attendance that today is Election Day and he encouraged them to vote. CALL FOR FUTURE MEETING: JANUARY 2013 Staff Representative Katie Douglas advised the Board that the next meeting will be scheduled in January 2013. ADJOURNMENT Vice Chair Terrance Mead moved to adjourn the meeting and Judge Timmer seconded the motion. It was voted unanimously to adjourn the meeting at 7:03 p.m. Submitted by: /Brown Board Liaison
