Glendale Ave. Glendale,AZ MEMBERS PRESENT: Larry Clark, Citizen Board Member and Acting Chair Capt. Mark Manor, Fire Board Member Capt. Joe Hester, Fire Board Member STAFF PRESENT: Jim Brown, Asst. Human Resources Director and Acting Board Secretary Nick DiPiazza, Chief Deputy City Attorney Patty Frey, Deputy Fire Chief Marcia Zientek, Human Resources Support Staff MEMBERS ABSENT: Mayor Elaine Scruggs, Chair City Manager Ed Beasley, Board Member Call to Order Larry Clark, Acting Chair, called to order the Local Fire Board meeting at 9:00 a.m. Administration of Loyalty Oath Larry Clark, Acting Chair, administered the Loyalty Oath to newly elected Board member Joe Hester. Review and Approval of the May 25,2011 Local Fire Board Meeting Minutes The minutes of the May 25, 2011 Local Fire Board meeting were reviewed. Capt. Mark Manor moved to accept the minutes as presented. Larry Clark seconded the motion. The Board voted and passed the motion unanimously. Review and Approval of Application for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.")—Richard Ellis Franklin The Local Fire Board reviewed Richard Ellis Franklin's D.R.O.P. application. Richard Ellis Franklin, Fire Captain, has 25.326 years of credited service. He has elected to participate in the Deferred Retirement Option Plan ("D.R.O.P.") for a period of sixty (60) months effective June 1, 2011. On and after this date, the employee and employer contributions would cease to be made to the Public Safety Personnel Retirement System ("PSPRS"). He must terminate employment with the City of Glendale Fire Department on or before June 1, 2016. Richard Ellis Franklin has been a member of PSPRS since February 3, 1986. Larry Clark seconded the motion. The Board voted and passed the motion unanimously. Review and Approval of Application for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.")—John A. Walter II The Local Fire Board reviewed John A. Walter II's D.R.O.P. application. John A. Walter, Fire Captain, has 26.058 years of credited service. He has elected to participate in the Deferred Retirement Option Plan ("D.R.O.P.") for a period of sixty (60) months effective June 30, 2011. On and after this date, the employee and employer contributions would cease to be made to the Public Safety Personnel Retirement System ("PSPRS"). He must terminate employment with the City of Glendale Fire Department on or before June 30, 2016. John A. Walter II has been a member of PSPRS since June 10, 1985. Mark Manor motioned to approve the D.R.O.P. enrollment application submitted by John A. Walter II, Fire Captain. Larry Clark seconded the motion. The Board voted and passed the motion unanimously. Commencement of Executive Session Larry Clark recessed the Open Session and convened into Executive Session to review and discuss the medical evaluations of two (2)new Fire personnel. The Board adjourned Executive Session and reconvened into Open Session to vote on the admission of two (2) new Fire personnel into the Public Safety Personnel Retirement System ("PSPRS") with any pre-existing conditions noted on the medical evaluations. Review and Approve Fire Medical Evaluations for Pre-existing Conditions Capt. Mark Manor made a motion to accept the applications of the following Fire personnel into the PSPRS with any pre-existing conditions noted on the physicals: Eric Fields Joshua Hughes Larry Clark seconded the motion. The Board voted and passed the motion unanimously. New Business The Board received a copy of the April/May 2011 PSPRS Local Board Newsletter which noted that Senate Bills 1317 and 1609 had been signed into law by the 50th Legislature—First Regular Session. The general effective date for the legislation will be July 20, 2011. Capt Mark Manor addressed the subject of the timing of members' retirement dates and the dates that the PSPRS Local Board meets in order to approve the retirement applications. Capt. Manor asked if the Board dates could be adjusted to accommodate those members retiring so that their retirement checks were not delayed. Nick DiPiazza, Chief Deputy City Attorney, noted that the Board has no control over when members' decide to submit their papers to retire, and that there is always the possibility that someone may go a little longer before they collect their first retirement check due to the timing of their retirement date and the date the Board meets to approve it. Mr. DiPiazza also noted that, irrespective of when the Board meets, the effective date is still the effective date, and the employee will not lose any benefits. Capt. Manor noted that it Page 2 of 3 PSPRS Local Fire Board Meeting Minutes 6/22/2011 will be a matter of educating the members of the fact that they must submit their paperwork in a timely manner in order to receive their first check when it was anticipated. There was no other business. Adjournment Larry Clark, Acting Chair, asked for a motion to adjourn the meeting. Capt. Mark Manor made a motion to adjourn the meeting. Larry Clark seconded the motion.
