GLENDALE LOCAL POLICE BOARD

Call to Order
Larry Clark, Acting Chair, called to order the Local Police Board meeting at 9:00 a.m.
Review and Approval of the September 1,2010 Local Police Board Meeting Minutes
The minutes of the September 1, 2010 Local Police Board meeting were reviewed. Det. Brandon Keefer
moved to accept the minutes as presented. Lt. John Wolfe seconded the motion. The Board voted and passed
the motion unanimously.
Review Reemployment and Prior Agreement Determination of Retired Police Officer Robert Schoech in
Accordance with A.R.S. 438-849.D
Robert Schoech is a retired Police Officer from the City of Glendale. He retired from the City on June 20,
2009, and was subsequently rehired by the City as a Security Officer in the Utilities Department on November
15, 2010. PSPRS has established guidelines that the Local Board must follow regarding return to work
provisions including the determination of a pre-existing agreement to rehire the member and if the member is
considered to be rehired in the 'same position'. Nick DiPiazza noted that the Board was provided documents
in their board books confirming the employee's date of retirement from PSPRS, the date of the posting of the
Security Officer position, a Police Officer's job description and a Security Officer's job description, and
affidavits signed and notarized stating that there was no pre-existing agreement to rehire the employee. The
Local Board must make a determination and vote on the following issues:
1. Did Mr. Robert Schoech become reemployed with the City of Glendale before sixty (60) consecutive
days after his date of retirement with PSPRS? (7/1/2009)
Lt. John Wolfe moved that Mr. Robert Schoech did not become reemployed with the City of Glendale
before sixty (60) consecutive days after his date of retirement with PSPRS. Det. Brandon Keefer
seconded the motion. The motion passed unanimously.

2. Was there a pre-existing agreement to rehire Mr. Robert Schoech?
Lt. John Wolfe moved that there was not a pre-existing agreement to rehire Mr. Robert Schoech,
noting that there was no evidence of a pre-existing agreement, and that there was a significant amount
of time between the time he departed employment and the time of his rehire. Det. Brandon Keefer
seconded the motion. The motion passed unanimously.
3. Was Mr. Robert Schoech, who is currently a Security Officer, reemployed in the 'same position' from
which he retired from as a Police Officer?
Lt. John Wolfe moved that Mr. Robert Schoech was not reemployed in the same position. Lt. Wolfe
pointed out that there are significant differences in the two positions; a Police Officer has the
responsibility to enforce the laws of the state of Arizona while a Security Officer is not armed, does
not have powers of arrest, and that there are many other differences from that of a Police Officer. Det.
Brandon Keefer seconded the motion. The motion passed unanimously.
Distribution of the Open Meeting Law Booklet
The Board members received the revised Open Meeting Law Booklet which is in keeping with A.R.S. §38-
431.01 (G). This booklet replaces any previous Open Meeting Law materials. The revision date was July
2010 and the booklet was reviewed by the Glendale City Attorney's office in September 2010. Nick
DiPiazza, Chief Deputy City Attorney, advised the board that if any member had any questions now or at a
later date regarding the Open Meeting Law, they should bring them to his attention. There were no questions
at that time.
New Business
There was no new business.
Adjournment
Larry Clark asked for a motion to adjourn the meeting. Lt. John Wolfe made a motion to adjourn the meeting.
Det. Brandon Keefer seconded the motion. The Local Police Board meeting adjourned at 9:07 a.m.
