Glendale Ave. Glendale, AZ MEMBERS PRESENT: Mayor Elaine Scruggs, Chair Larry Clark, Citizen Board Member Lt. John Wolfe,Police Board Member Det. Brandon Keefer, Police Board Member STAFF PRESENT: Alma Carmicle, Human Resources Director and Board Secretary Jim Brown, Assistant Human Resources Director Nick DiPiazza, Chief Deputy City Attorney La Trisse Kuzinski, Human Resources Support Staff Marcia Zientek, Human Resources Support Staff MEMBERS ABSENT: City Manager Ed Beasley, Board Member Call to Order Mayor Elaine Scruggs, Chair, called to order the Local Police Board meeting at 9:08 a.m. Review and Approval of the July 28,2010 Local Police Board Meeting Minutes The minutes of the July 28, 2010 Local Police Board meeting were reviewed. Lt. John Wolfe moved to accept the minutes as presented. Larry Clark seconded the motion. The Board voted and passed the motion unanimously. COMMENCEMENT OF EXECUTIVE SESSION Mayor Scruggs recessed the Open Session and convened in Executive Session to review and discuss an Application for Accidental Disability Retirement. RECONVENED IN OPEN SESSION The Board adjourned Executive Session and reconvened in Open Session. Consider and Vote on the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System ("PSPRS")—Grant Eaton Grant Eaton, a Police Officer with the City of Glendale, applied for Accidental Disability Retirement through the Public Safety Personnel Retirement System ("PSPRS") on October 12, 2009. He has been a member of the PSPRS since July 1, 1996. He is still currently employed with the City of Glendale. Page 1 of 2 Local Police Board Meeting Minutes 9/1/10 "Accidental Disability" means a physical or mental condition which the Local Board finds totally and permanently prevents an employee from performing a reasonable range of duties within the employee's job classification and was incurred in the performance of the employee's duty. (A.R.S. Section 38-842.1) In order to approve the Application for Accidental Disability Retirement, the Local Board must make a determination on three (3) issues in accordance with the statutes A.R.S. 38-842 and A.R.S. 38-844. Jim Brown, Assistant Human Resources Director, read the three (3) issues on which the Board must make their determination: 1. Does the claimant have a physical or mental condition which totally and permanently prevents him from performing a reasonable range of duties within his job classification as a Police Officer? Det. Brandon Keefer moved that the claimant had a physical or mental condition which totally and permanently prevents him from performing a reasonable range of duties within his job classification of Police Officer. Lt. John Wolfe seconded the motion. The motion passed unanimously. 2. Does the claimant's disability result from a physical or mental condition or injury that existed or occurred prior to the claimant's date of membership in the PSPRS? (July 1, 1996) Det. Brandon Keefer moved that the claimant's disability did not result from a physical or mental condition or injury that existed or occurred prior to the claimant's date of membership in the PSPRS which was July 1, 1996. Lt. John Wolfe seconded the motion. The motion passed unanimously. 3. Was the disabling condition or injury incurred in the performance of the claimant's duty as a Police Officer? Det. Brandon Keefer moved that the disabling condition or injury was incurred in the performance of the claimant's duty as a Police Officer. Lt. John Wolfe seconded the motion. The motion passed unanimously. Since all of the conditions for Accidental Disability Retirement were satisfied, the Board approved the application submitted by Grant Eaton.
