Glendale Ave. Glendale, AZ MEMBERS PRESENT: Mayor Elaine Scruggs, Chair Larry Clark, Citizen Board Member Lt. John Wolfe, Police Board Member Brandon Keefer, Police Board Member STAFF PRESENT: Alma Carmicle, Human Resources Director and Board Secretary Nick DiPiazza, Chief Deputy City Attorney La Trisse Kuzinski, Human Resources Support Staff MEMBERS ABSENT: City Manager Ed Beasley, Board Member OTHER ATTENDEES: Grant Eaton, Glendale Police Officer Jill Tinney John"Jack"Rose Open Meeting Law Refresher Chief Deputy City Attorney Nick DiPiazza reviewed provisions of the Open Meeting Law pertinent to the Local Police Board. Call to Order Mayor Elaine Scruggs, Chair, called to order the Local Police Board meeting at 9:36 a.m. Review and Approval of the February 24,2010 Local Police Board Meeting Minutes Alma Carmicle, Board Secretary, provided a copy of a revised draft of the proposed minutes of the February 24, 2010 Local Police Board meeting. The initial draft copies of the minutes were collected. Larry Clark moved to accept the revised Minutes as presented. Lt. John Wolfe seconded the motion. The Board voted and passed the motion unanimously. Review and Approval of Application for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.")—Lawrence S. Shine The Local Police Board reviewed Lawrence S. Shipe's D.R.O.P. enrollment application. Lawrence S. Shipe, Police Officer, has 26.004 years of credited service. He has elected to participate in the D.R.O.P. for a period of sixty (60)months beginning on April 9, 2010. On and after this date, employee and employer contributions will cease to be made to the Public Safety Personnel Retirement System ("PSPRS"). He must terminate employment with the City of Glendale Police Department on or before April 30, 2015. He has been a member of the Glendale Police Department since March 7, 1986. Page 1 of 3 Local Police Board Meeting Minutes 4/28/10 Lt. John Wolfe moved to approve the D.R.O.P. enrollment application submitted by Lawrence S. Shipe, Police Officer. Brandon Keefer seconded the motion. The motion passed unanimously. Review and Approval of Application for Retirement from Deferred Retirement Option Plan ("D.R.O.P.") David A. Donald The Local Police Board reviewed David A. Donald's D.R.O.P. retirement application. David A. Donald, Police Sergeant, has 25 years of credited service. He had elected to participate in the D.R.O.P. for a period of sixty (60) months beginning on July 26, 2005. On or after this date, employee and employer contributions ceased to be made into the Public Safety Personnel Retirement System ("PSPRS"). He must terminate employment with the City of Glendale Police Department on or before June 30, 2010. David A. Donald has been a member of the PSPRS since December 24, 1979. Lt. John Wolfe moved to approve the D.R.O.P. retirement application submitted by David A. Donald, Police Sergeant. Larry Clark seconded the motion. The Board voted and passed the motion unanimously. Commencement of Executive Session The Board recessed the Open Session and convened in Executive Session to review the continuation of Ordinary Disability Benefits without an offset for Jennifer J. Bibeau. Consider and Vote on the Continuation of Ordinary Disability Benefits—Jennifer J. Bibeau The Board recessed Executive Session and reconvened in Open Session. Lt. John Wolfe moved to approve the continued entitlement of Ordinary Disability Retirement Benefits for Jennifer J. Bibeau without an offset. Larry Clark seconded the motion. The motion was voted upon and passed unanimously. Request to Address Board Regarding Survivor Benefits—Jill D. Tinney Jill D. Tinney, surviving spouse of Larry Allyn Spaulding, retired Police Officer, addressed the Board regarding survivor benefits. Mrs. (Tinney) Spaulding was accompanied by John "Jack" Rose, a friend. After addressing the Board, Mrs. Spaulding was advised that the Board Agenda provided only for her to address the Board regarding survivor benefits. Mrs. Spaulding was then advised by the Board that a formal application could be submitted to the Board and would be put on the next agenda as an action item for the Board to consider and vote upon. Mrs. Spaulding asked if she could submit additional paperwork and was advised that she may include any additional pertinent information along with the required application. Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System ("PSPRS")—Grant Eaton Ms. Carmicle presented the application from Grant Eaton, a Police Officer with the City of Glendale, who has applied for Accidental Disability Retirement through the Public Safety Personnel Retirement System ("PSPRS") on October 12, 2009. He has been a member of the PSPRS since July 1, 1996. Ms. Carmicle advised the Board that "Accidental Disability" means a physical or mental condition which the Local Board finds totally and permanently prevents an employee from performing a reasonable range of duties within the employee's job classification and was incurred in the performance of the employee's duty (A.R.S. Section 38-842.1) Page 2 of 3 Local Police Board Meeting Minutes 4/28/10 Officer Eaton requested to address the Board prior to the Board's meeting in Executive Session to review and discuss his application. Commencement of Executive Session The Board recessed the Open Session and reconvened in Executive Session to review the Application for Accidental Disability Retirement from the PSPRS for Officer Grant Eaton. Consider and Vote on the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System—Grant Eaton The Board adjourned Executive Session and reconvened in Open Session. Officer Eaton was then invited back into the meeting. The Board advised Officer Eaton that they still have questions for the treating physician in his case and that they will await the physician's responses before bringing it back to the Board for a vote. Lt. John Wolfe made a motion to table the Application for Accidental Disability for Officer Grant Eaton until the specific information pursuant to the Board's inquiries can be obtained from the physician. Brandon Keefer seconded the motion. The motion was voted upon and passed unanimously. New Business There was no new business.
