GRANT OF EASEMENT
(Glen Harbor Commerce Park,Glendale,Arizona)
For Ten Dollars ($10.00) and other valuable consideration, Bron-AZ Business Properties,
LLC, an Arizona limited liability company ("Grantor"), hereby grants to the City of Glendale, an
Arizona municipal corporation (the "City"), an easement to install, repair, operate, maintain and
remove water pipelines and appurtenances (collectively, the "Facilities") upon, over and under the
surface of the following described property(the"Easement Area"):
See Attached Description,"Exhibit A"
Together with the right of ingress and egress to,from,across and along the Easement Area;the right
to use lands adjacent to the Easement Area during temporary periods of construction; the right to
operate, repair, replace, maintain, and remove the Facilities and appurtenances from the Easement
Area;the right to add to or alter the Facilities at any reasonable time;and the right to trim or remove
any trees or shrubs that in the judgment of the City may interfere with the construction,operation or
maintenance of the Facilities.
The City rights hereunder are non-exclusive and Grantor shall have the right to landscape
and otherwise use and enjoy the Easement Area, provided that such use by Grantor does not
interfere with the rights granted to the City hereunder.
By accepting this Grant of Easement the City agrees to: exercise reasonable care to avoid
any damage to Grantor's property; to restore disturbed or damaged area as close to original
condition as is reasonably possible at the sole cost and expense of the City if excavation is
necessary; and to indemnify and hold Grantor, it successors and assigns harmless from and against
any damage to person or property incurred as a direct and proximate result of the exercise of rights
under this Grant of Easement by the City,its contractors,agents or employees.
This Grant of Easement shall continue in full force and effect until such time as the
Facilities are permanently removed or no longer used for water purposes. Upon termination of the
necessity of the use of the Easement Area the City shall prepare and record appropriate
documentation abandoning the use..
