3.LEGAL MATTERS
A.The City Council will meet with the City Attorney for legal advice, discussion and consultation
regarding the city’s position in pending or contemplated litigation, including settlement
discussions conducted in order to avoid or resolve litigation. (A.R.S. § 38-431.03(A)(3)(4))
B.Council will meet to discuss and consider records exempt by law from public inspection and
are specifically required to be maintained as confidential by state or federal law. (A.R.S. §

A.Discussion/consultation with the City Attorney and City Manager to receive an update, to
consider its position, and to provide instruction/direction to the City Attorney and City Manager
regarding Glendale's position in connection with a contract relating to property in the area of
Beardsley and Loop 101. (A.R.S. §§ 38-431.03 (A)(3)(4)(7)).
B.Discussion/consultation with the City Attorney and City Manager to receive an update, to
consider its position, and to provide instruction/direction to the City Attorney and City Manager
regarding Glendale's position in connection with a contract relating to property in the area of
58th Avenue and Glenn Drive. (A.R.S. §§ 38-431.03 (A)(3)(4)(7)).

ADJOURNMENT
Upon a public majority vote of a quorum of the City Council, the Council may hold an executive session, which will not
be open to the public, regarding any item listed on the agenda but only for the following purposes:
(i) discussion or consideration of personnel matters (A.R.S. § 38-431.03(A)(1));
(ii) discussion or consideration of records exempt by law from public inspection (A.R.S. § 38-431.03(A)(2));
(iii) discussion or consultation for legal advice with the city’s attorneys (A.R.S. § 38-431.03(A)(3));
(iv) discussion or consultation with the city’s attorneys regarding the city’s position regarding contracts that are
the subject of negotiations, in pending or contemplated litigation, or in settlement discussions conducted in order
to avoid or resolve litigation (A.R.S. § 38-431.03(A)(4));
(v) discussion or consultation with designated representatives of the city in order to consider its position and
instruct its representatives regarding negotiations with employee organizations (A.R.S. § 38-431.03(A)(5)); or
(vi) discussing or consulting with designated representatives of the city in order to consider its position and
instruct its representatives regarding negotiations for the purchase, sale or lease of real property (A.R.S. §
38-431.03(A)(7)).
Confidentiality
Arizona statute precludes any person receiving executive session information from disclosing that
information except as allowed by law. A.R.S. § 38-431.03(F). Each violation of this statute is subject
to a civil penalty not to exceed $500, plus court costs and attorneys’ fees. This penalty is
assessed against the person who violates this statute or who knowingly aids, agrees to aid or
attempts to aid another person in violating this article. The city is precluded from expending any
public monies to employ or retain legal counsel to provide legal services or representation to the
public body or any of its officers in any legal action commenced for violation of the statute unless
the City Council takes a legal action at a properly noticed open meeting to approve of such
expenditure prior to incurring any such obligation or indebtedness. A.R.S. § 38-431.07(A)(B).

NOTIFICATION REQUIREMENTS

Purpose and Recommended Action
At the December 6, 2016 Council Workshop, Councilmember Malnar identified a Council Item of Special
Interest requesting for staff to prepare an overview on how Planning and Zoning Notification
Requirements are administered on various projects.
Background
The Planning Division is responsible for administering the Citizen Participation (CP) process for all land
use applications that require a public hearing. The CP process consists of a number of components as
follows:
Interested Parties List
The city-wide interested parties’ lists, along with the interested parties list for each of the six City Council
districts, are managed by the Planning Division. These lists contain the names and addresses of
individuals and organizations who wish to receive notification of public hearings for land use
applications. The lists are updated as people either want to be added or removed from the lists.
Postcard Mailing
If someone is on one of the interested parties list, they would receive a green postcard from the Planning
Division for all public hearings of the following decision making bodies:
City Council (CC)
Planning Commission (PC).
Board of Adjustment (BOA).
The postcards provide information including the application number, a brief description of the land use
proposal, a vicinity map and staff contact should someone wish to contact the Project Manager for the
application. The applicants name and contact information is also provided.
Area of Notification
Notification outlined in the Zoning Ordinance requires that property owners located within 300 feet of the
site be provided a notice of the public hearing. As a practice, in an effort to encourage greater citizen
participation and transparency, the notice area was administratively increased to 500 feet for projects
presented before City Council and Planning Commission. Area of notification for cases heard before the
Board of Adjustment is only for those properties which may be directly impacted.
Notice of Public Hearing
At least 15 days prior to a public hearing, a Notice of Public Hearing (NOPH) is published in The

Glendale Star. The NOPH includes similar information that is found on the postcards.
Property Posting
Cases that are heard by the City Council and Planning Commission are posted on the property by the
applicant with at least one 4’ x 8’ plywood posting sign. Cases that are heard by the Board of Adjustment
are posted on the property by Planning Division staff with at least one 18” x 24” card stock sign on
wooden stakes.
If Council wants to revise elements of how the public is provided notice of applications that require a
public hearing, the amendments can be processed through a future Zoning Text Amendment (ZTA).
Analysis
Glendale has had a Citizen Participation process outlined in the Zoning Ordinance since 1993.
Applications such as Design Review, also known as site plan approval, are an administrative function
and do not require a public hearing or neighborhood notification.
The ZTA process would offer additional citizen participation opportunities, where citizens can provide
input regarding this topic.
Conclusion
Staff is seeking guidance from Council on how to proceed with this topic. To provide some scale on how
many properties might receive a postcard in the mail, maps have been prepared that depict various
cases across the city with a comparison of both a 300 foot notification areas as well as a 500 foot
notification area.

Purpose and Recommended Action
This is a request for City Council to review the updated Heroes Park Library capital project and financing
plan and provide feedback on the identified funding for the project.
Background
The Heroes Park Library project has been discussed at numerous City Council, Library Advisory Board,
and Parks and Recreation Advisory Commission meetings. At the April 5, 2016 Council Workshop,
Council provided direction to begin design work on the Western Area Branch Library Capital
Improvement Project at Heroes Regional Park. Subsequently, on June 14, 2016, the City Council
adopted the Fiscal Year 2016-17, ten-year Capital Improvement Plan (CIP) which included funding for the
Western Area Branch Library from Development Impact Fees specifically collected for library projects.
At the December 20, 2016 Council Voting Meeting, Council approved a professional services agreement
with Dick and Fritsche Design Group, Inc. to provide design and architectural drawings for the potential
library project. Staff has had numerous discussions with the architect to design and properly equip the
facility.
Analysis
Based on staff discussions and consultation with Dick and Fritsche Design Group, Inc., the estimated
costs of the project have increased. The revised project estimate is based on the design of the library,
required infrastructure, and technology needs of the facility. However, based on a May 2, 2017 analysis
initiated and provided to Mayor and Council, additional Development Impact Fee funds were identified
which can be used to offset the additional project costs. Staff will present the revised estimates at this
Workshop meeting.
As the total project costs have increased, budget appropriation transfers may be necessary in the current
fiscal year to continue with the project or the additional project appropriations will be included in the
Fiscal Year 2018-19 budget discussions.
Staff is requesting Council direction on the updated financial plan for the facility which identifies
Development Impact Fees as the primary source of funding.
Previous Related Council Action

Community Benefit/Public Involvement
A western area library has been extensively discussed in public and at Library Advisory Board meetings,
including a detailed discussion at the August 8, 2015 Library Advisory Board meeting. At the September
9, 2015 Board meeting, the Board voted in favor of a modular building at the Heroes Regional Park,
which passed with a vote of 6 to 0. At the October 20, 2015 City Council workshop, staff presented the
library location options, and received direction to focus on the conceptual options at Heroes Regional
Park and the Media Center. Subsequent public meetings were conducted with the Library Advisory
Board on February 10, 2016 and March 9, 2016; the Parks and Recreation Advisory Commission on
March 14, 2016; and at a final joint meeting of both commissions on March 26, 2016. As a result, both
the Library Advisory Board and The Parks and Recreation Advisory Commission unanimously
recommended approval to the Heroes Regional Park option to Council for formal. At the April 5, 2016
