This refers to the conduct by the county of city elections, including the use of county
polling places, and the procedures for conducting the September 12, 2006, special referendum
election for the City of Glendale in Maricopa County, Arizona, submitted to the Attorney
General pursuant to Section 5 of the Voting Rights Act, 42 U.S.C. 1973c. We received your
submission on May 23, 3006.
The Attorney General does not interpose any objection to the specified changes. However,
we note that Section 5 expressly provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the changes. Procedures for the
Administration of Section 5 of the Voting Rights Act (28 C.F.R. 51.41).

The City of Glendale's previous submittal noted that Maricopa County would be
preclearing all polling place in the city for the September 12, 2006 Primary Election and
the November 7, 2006 General Election. The City of Glendale has contracted with
Maricopa County to provide polling places and will be on Maricopa County election
ballot. We are sending a copy of the Resolution 3979 adopted by the Glendale City
Council, which contains the polling places for these elections for your information.

A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE,
MARICOPA COUNTY, ARIZONA, PROVIDING NOTICE OF
ELECTION PURSUANT TO A.R.S. §16-228 BY SETTING THE
DA IE OF THE PRIMARY ELECTION, ESTABLISHING THE

CONTRACTING FOR ELECTION OFFICIALS AND FIXING THEIR

WHEREAS, it is provided by law for the holding of a Primary Election;
WHEREAS, the Council has by this resolution called a Primary Election to be held on Tuesday,
September 12, 2006; and
WHEREAS, a Notice of Election is required to be adopted and published in accordance with
A.R.S. §16-228.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
GLENDALE as follows:
SECTION 1. DESIGNATION OF ELECTION DAY.
That the City of Glendale Primary Election be held on Tuesday, September 12, 2006 for the
purpose of (1) nominating candidates for the office of Council Member for the districts of Barrel,
Cholla and Ocotillo. Any candidate receiving a majority of the votes cast at the Primary Election will
be declared elected without running at the General Municipal Election; and (2) for the purpose of
considering proposals designated as Proposition 402 (providing for an increase in the salary for the
Mayor) and Proposition 403 (providing for an increase in the salary for council members).

In the event of unforeseen circumstances in which a polling place cannot be utilized, the City
Clerk is authorized to acquire a replacement and notify all interested parties.
SECTION 3. PRIMARY ELECTION DAY POLLING PLACE HOURS.
The polls shall be open from 6:00 a.m. to 7:00 p.m.
SECTION 4. ELECTION OFFICIALS AND THEIR COMPENSATION.
The City Clerk is hereby authorized to contract, for each Primary Election polling place, one
inspector, two judges, two to five clerks and four trouble-shooters; and an adequate number of early
ballot processing inspectors and early ballot processing clerks at the compensation rates set by
Maricopa County Elections Department.
SECTION 5. PUBLISHING.
That this resolution shall be published two (2) times in a newspaper of general circulation in
Glendale not less than one week apart during the six (6) calendar weeks preceding twenty (20) days
before the primary election.

City of Glendale, Arizona—2006 Primary and General Elections
Dear Sir or Madam:
This letter, including Exhibits A through I, constitutes Glendale's submission for
DOJ review under Section 5 of the Voting Rights Act. The City of Glendale Primary
Election is scheduled for September 12, 2006 and the General Election is scheduled for
November 7, 2006. At the city's Special Election on May 17, 2005, a charter amendment
was passed by the voters to change the City of Glendale's election cycle to the fall,
beginning with the 2006 elections. This change enables the city to place its candidates
and ballot questions on the Maricopa County Primary and General Election ballot. A
copy of Resolution 3853, New Series, the Canvass of Vote for May 17, 2005 Election is
included as Exhibit A. All future City of Glendale Primary and General Elections will
be conducted in the fall election cycle and appear on the Maricopa County ballot. The
last spring City of Glendale Primary and General Municipal Elections were conducted
on March 9, 2004 and May 18, 2004.
Primary Election
The City of Glendale will have three Council positions in the Cholla, Barrel, and
Ocotillo Districts, as well as one proposition on the Maricopa County Primary Election
ballot. A copy of Resolution No. 3948, New Series placing the proposition on the ballot

and Resolution No. 3946, New Series calling the 2006 City of Glendale Primary and
General Elections are included as Exhibits B and C.
The City of Glendale and Maricopa County have entered into an election services
contract for both the September 12, 2006 Primary and November 7, 2006 General
Elections. Maricopa County will pre-clear the polling places with the Justice
Department as a part of their submittal. Maricopa County will also recruit and train
election officials, process early ballots, and conduct ballot tabulation, etc. The City of
Glendale's Services Contract with Maricopa County is included as Exhibit D.
The Glendale City Clerk's Office will offer the same program for voter
information and early voter request mailings. The early ballot request card has been
modified to allow the voter to seal the card for security. As a part of this plan, we will
be informing voters about the voter identification requirements of State Proposition 200.
A copy of the voter information plan is included as Exhibit E.
General Election
At the Maricopa County General Election, the City of Glendale may have a run-
off for elected positions not filled at the Primary Election. No city ballot questions are
currently proposed.
Pre-Clearance 2005 Special Election
On May 17. 2005, the City of Glendale conducted a Special Election with two
franchise agreements and a charter amendment on the ballot. A copy of the U.S. Justice
Department, Civil Rights Division letter of no objection is included as Exhibit F.
Polling Places
Maricopa County will pre-clear all of the polling places for the City of Glendale
2006 Primary and General Elections. The City of Glendale 2004 Primary and General
Elections as well as the 2005 Special Election, had 24 polling places. State law allows
municipalities to have one polling place for several precincts. The number of registered
voters per polling place must be relatively the same at each polling place. By State law,
Maricopa County must attempt to provide a polling place in every precinct. Therefore,
the number of polling places in the City of Glendale will be increased to approximately
75. The City of Glendale and Maricopa County elections utilize many of the same
polling places. A list of the City of Glendale polling places for the 2004 and 2005

elections are included as Exhibit G. A current map with the City of Glendale Districts
and Maricopa County Precincts is included as Exhibit H.
The City Clerk's Department will request a review of the 2006 Primary and
General polling places by the Glendale Commission on Persons with Disabilities
("GCPD") and Hispanics for Better Education ("HBE"), a local Hispanic organization.

contact person for HBE is John Flores at (623) 937-0402.
Annexations
Annexations 155, 156, and 158 have received the U.S. Department of Justice, Civil
Rights Division letter of no objection. These annexations occurred after the last City of
Glendale
Special Election held on May 17, 2005. These letters and the City's submittal letters are
included as Exhibit H.

A RESOLUTION OF THE COUNCIL OF THE CITY
OF GLENDALE, MARICOPA COUNTY, ARIZONA,
DECLARING AND ADOPTING THE RESULTS OF
THE SPECIAL ELECTION HELD ON MAY 17, 2005;
AND ORDERING THAT A CERTIFIED COPY OF
THIS RESOLUTION BE RECORDED.
WHEREAS, the City Council of the City of Glendale, Maricopa County,
Arizona, by Resolution No. 3841, New Series, adopted on the 12th day of April,
2005, caused a notice to be submitted to the qualified electors of the City of
Glendale (the "City") of a Special Election called and held in and for the City on
the 17th day of May, 2005 for the consideration of three proposals designated as
Proposition 101, Proposition 102 and Proposition 103; and
WHEREAS, the City Council caused notice of the Special Election to be
provided by the City Clerk by publishing notice thereof in the Glendale Star
newspaper, which is published in and has general circulation within the City. The
notice as published, specified the polling places where the election was to be
held; plus, the candidates and propositions to be voted upon. A copy of the
notice, with the affidavit of publication attached thereto, is on file and a part of the
official records of the City of Glendale; and
WHEREAS, the election returns have been presented to and have been
canvassed by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF GLENDALE as follows:
SECTION 1. The total number of ballots cast at the Special Election, as
shown by the cumulative report of polling places, with the addition of provisional
ballots and early ballots processed, was 6,635.
SECTION 2. The total number of early ballots cast at the Special Election
was 5,025. Of these, 0 early ballots were found to be invalid.
SECTION 3. The total number of provisional ballots received was 48. Of
these, 13 provisional ballots were found to be invalid.
SECTION 4. That the votes cast for Propositions 101, 102, and 103 were

SECTION 5. It is hereby found, determined, and declared of record, that

PRIMARY El.FCTION.
WHEREAS, Art. II, Sec. 8, Charter of the City of Glendale provides for appointment of a
Salary Review Commission, to study the salaries of the Mayor and Council members and to
make recommendations to the City Council; and
WHEREAS, the Charter further provides that the Council may accept, reject or modify
the salary recommendations of the Salary Review Commission and submit any proposed increase
in Council salaries to the voters for approval; and
WHEREAS, the annual salaries of the Mayor and Council members were last reviewed in
1996, which resulted in a recommendation for an increase; and
WHEREAS, the Council appointed a Council Salary Review Commission,which has met
several times and compiled a report containing job evaluation information and salary comparison
data; and
WHEREAS, the Council Salary Review Commission had unanimously voted to make a
recommendation that the Council place a question on the ballot proposing an increase in the
annual salary of Mayor to$65,000;
WHEREAS, the Council Salary Review Commission had unanimously voted to make a
recommendation that the Council place a question on the ballot proposing an increase in the
annual salary for Council members to$45,000;
WHEREAS, the Council modified the salary recommendations of the Council Salary
Review Commission at its Workshop session on February 21, 2006 to an annual salary of the
Mayor of$48,000; and
WHEREAS, the Council modified the salary recommendations of the Council Salary
Review Commission at its Workshop session on February 21, 2006 to an annual salary of
Council members of$34,000.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF .TIS CITY OF
GLENDALE as follows:
SECTION 1. That pursuant to Art. II, Sec. 8, Charter of the City of Glendale, the Council
hereby modifies the recommendations of the Council Salary Review Commission and
recommends that the annual salary of the Mayor be increased to$48,000.
SECTION 2. That pursuant to Art. II, Sec. 8, Charter of the City of Glendale, the Council
hereby modifies the recommendations of the Council Salary Review Commission and
recommends that the annual salary of each Council member be increased to$34,000.
SECTION 3. That the following proposed Glendale City Code amendments relating to
the salary of the Mayor and Council is hereby referred to the qualified electors of the City of
Glendale for their approval or rejection at the next general election:

ie Maricopa County Elections Department (MCED) conducts all elections on the Eagle Optech Vote
Scanning System. The statutory required amount of ballots must be designed ordered and printed
through MCED. 102% ballots shall be printed (of which 55% shall be for early voting.)
TRANSLATION
'y Spanish Translation of ballot text shall be provided by MCED; the translation is bonded, certified,
and has been approved by the U.S. Department of Justice. In order to maintain the integrity of the
translation, no changes shall be allowed to translation provided by MCED. The Jurisdiction is
responsible to insure the MCED Spanish Translation also appears in the Information Report, Publicity
Pamphlet and Sample Ballot.
Jurisdiction will provide their own Spanish translation of ballot text, and will assurhe all
responsibilities regarding the translations accuracy.
NATIVE AMERICAN TRANSLATION PROVIDED BY MCED: All electidn related materials must be

100 DAYS PRIOR TO THE ELECTION the Jurisdiction shall notify MCED of any corrections* to the
BALLOT. Sign-off will indicate that text of the issue(s) is final and approved for translation to Spanish.
UPON COMPLETION OF THE ACTUAL BALLOT MCED shall provide the Jurisdiction with a COSMETIC
BALLOT PROOF that provides the Jurisdiction with an actual version of their ballot as it will appear to
the voters. This COSMETIC BALLOT PROOF shall require sign-off to authorize the production of the
actual ballot. Any corrections* made at this point can incur additional charges as outlined below.

GOALS
• Generate awareness of City of Glendale's 2006 Primary/General Election to
residents through a multi-faceted communications and public information
campaign.
• Provide accurate election information to residents and media representatives in a
timely manner.
• Educate residents about Proposition 200 guidelines and requirements.

COMM[JNITY RELATIONS
The key objectives of the community relations initiatives are to: 1) make residents aware
of the upcoming fall election 2) register residents.to vote and/or fill out a mail-in ballot
request form.
Election Bookmarks or/and Pencils
A "2006 Primary and General" bookmark will be distributed to residents at all three
libraries during the first two weeks in August. Librarians will pass out the bookmarks to
patrons when they are checking out books and other material.
Registered Neighborhoods
Election information "E-mail Blasts" will be sent to Registered Neighborhood leaders
and other community stakeholders, including members of the Commission on
Neighborhoods, Community Volunteer groups, Community Mediation groups and
Glendale University graduates.
City Election Hotline
The hotline will provide residents with pre-recorded information on voter registration and
the City election. Residents calling the hotline during normal business hours will have the
option to speak with a City Clerk's Office representative, who will take mail-in ballot
requests over the phone and also be available to answer any questions.
City Meetings/Functions
City election information will be made available and/or distributed at various city
meetings and functions, such as neighborhood, district and Council meetings, Glendale
University classes, etc.
MEDIA
The objective of the media relations component of the plan is to inform and educate
residents on the upcoming election through free publicity and paid advertising in local
newspapers serving Glendale.

Several news releases will be written and distributed to media outlets throughout the
election communications and public information campaign.

The city's vast inventory of communications tools will all be utilized as part of this plan

Web Site
An update on the website to provide residents with infouuation on the election, as well as
key deadline dates for registering to vote, requesting an early ballot, etc. A special link to
Maricopa County's Web site will be created that will enable residents to request a voter
registration or mail-in ballot fouu.
• In addition to the Web site, an election logo will appear on the home pages of both the
City's external and internal Web sites to create even greater exposure for the upcoming
election. You can click on the logo to go to the webpage for elections.
Local Cable Programming
Election stories will be incorporated into current programming on Glendale 11 to inform
and educate residents about the City election. Timely information will appear regularly
on the channel's City Beat show. In addition, City Clerk Pam Hanna and attorney Jon
Caladini may be a scheduled guest on a Glendale Today show.
The City's "vote by mail" PSA that was produced last year will be updated and used for
the 2006 campaign.
Furthermore, Glendale 11 will provide live coverage of election results throughout the
evening by running a"text crawl" on the bottom of the TV screen during its regular
programming.

The Attorney General does not interpose any objection to the specified change. However,
we note that Section 5 expressly provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the change. Procedures for the

Attached is a recorded copy of Ordinance No. 2440 New Series; pertaining to the
annexation of approximately 159 acres of land located at the northwest corner of 115th
Avenue and Glendale Avenue.
There is no population in this annexation area.
This ordinance was adopted at a regular meeting of the Council of the City of Glendale,
held on May 24, 2005. It was originally recorded on June 8, 2005. It was noted that the
annexation map had been inadvertently omitted from the initial recordation; therefore,
the signed annexation map was recorded on July 15, 2005.
This is the first submittal of Annexation- No. 155 — Ordinance No. 2440 New Series to
the Justice Department.
