The City of Glendale Special Bond Election is scheduled for May 15, 2007. Exhibit A, Resolution No. 4013, New Series calls for a Special Bond Elections to submit to the qualified electors five ballot questions on authorizing the issuance and sale of bonds of the city to provide funds in specified amounts for enumerated public purpose. Exhibit B Resolution 4025, New Series, sets forth the location of polls places and lists voter information. Both resolutions are in English and Spanish. These resolutions are i published in both languages for two consecutive weeks in the local newspaper, the Glendale Star. Pre-Clearance 2006 Primary and General Elections On September 12, 2006 and November 7, 2006, the City of Glendale conducted Primary and General Elections. A copy of U.S. Justice Department letter of July 18, 2006 stating no objection to the elections included as Exhibit C. The City of Glendale contracted with Maricopa County for election services such as space on their ballot, tabulation and polling places. Polling Places The May 15, 2007 Special Bond Election will have thirty polling places, with five in each of six districts. This is an increase of six polling places, one per district, from the last Special Election conducted on May 17, 2005. In the 2006 Primary and General, the City of Glendale candidates and propositions were on the Maricopa County. Maricopa County provided and precleared the polling places. The list of May 15, 2007 Special Bond Election polling places is included in Exhibit B, Resolution No. 4025, New Series; Exhibit D is the list of May 17, 2005 Special Election polling places. The City Clerk's Department has provided Maricopa County with a list of polling places. Our Service Agreement with Maricopa County requires them to inspect, provide equipment, election officials, and manage the polling places. Exhibit E is a copy of the City of Glendale Menu of Services agreement with Maricopa County. The City's Commission on Persons with Disabilities and the Hispanics for Better Education Committee will review the polling places The Chairperson for the Glendale Commission on Disabilities is Ms. Rickie Ray, (623) 915-2045 and the contact person for Hispanics for Better Education Committee is Mr. John Flores, (623) 937-0402. Voter Information The Arizona State Statues require Voter Information Pamphlets be mailed to every household with a registered voter. However, the City of Glendale will print and mail Voter's Informational Pamphlets to every registered voter in the city for the May 15, 2007 Special Election. Arizona voters passed a Proposition 200 approximately two years ago, which has been approved by the Justice Department, requiring voter identification at the polls. The mailing of the information pamphlet to every registered voter is not required but will provide the voter with an official election document, acceptable as I identification at the polling place. This is a one-time additional expense to provide an easier transition for voters to meet the identification requirements. Annexations The U.S. Department of Justice, Civil Rights Division letters of no objection to the city's most recent annexations nos. 160 and 163 as well as the City's submittal letter to the Justice Department are Exhibit F. and Exhibit G is a Maricopa County map of City of Glendale's city districts and county precincts. That a Special Bond Election (the "Election") is hereby ordered and called to be held on May 15, 2007 to submit to the qualified electors of the City the question as shown i on the official form of ballot attached as Exhibit "A" hereto and incorporated herein by this reference. The City Clerk is directed to place the questions on the ballot of the Election on May 15, 2007. SECTION 2. The City Clerk is hereby authorized to enter into a Service Memo Agreement with the Maricopa County Elections Department (the "County") to hold such election and to pay the standard and customary election charges announced by the County. SECTION 3. The Clerk of the City shall cause to be prepared and delivered to the election boards to be by them furnished to the qualified electors offering to vote at the election ballots presenting questions in the form hereto attached as Exhibit "A". The County shall also provide ballots to early and disabled voters. HX 327733809v4 1/8/2007 SECTION 4. Notice of the calling of the Election is ordered to be given by (i) mailing or distributing an informational pamphlet (the "Informational Pamphlet") and sample ballot to the residence of each registered voter within the City not less than thirty-five days prior to the date of the election, (ii) publishing a copy of the Call of Special Bond Election set forth in Exhibit B in the Glendale Star, a newspaper published and of general circulation in the City, for two weeks not less than 90 days prior to the date of the Election and (iii) publishing a copy of a notice of Special Bond Election in the Glendale Star for two weeks not less than 20 days prior to the date of Election. The City Clerk is hereby instructed to prepare and distribute the Informational Pamphlet, which shall include the items required by Arizona Revised Statutes §35-454(A)(1). The City Clerk is further instructed to transmit a copy of the Informational Pamphlet to the Department of Revenue pursuant to Arizona Revised Statutes §35-454(A)(2). SECTION 5. That the polling places and the time the polls shall be opened and closed shall be from 6:00 a.m. to 7:00 p.m. SECTION 6. The Election shall be conducted and the poll lists kept, and the votes cast thereat shall be counted and tabulated and the returns thereof shall be made in the manner provided by law and only persons shall vote at the Election who are qualified electors of the City. SECTION 7. In order to comply with the Voting Rights Act of 1965, as amended, the following proceedings pertaining to this Election will be translated into Spanish and distributed as required, to wit: the Notice of Special Bond Election, the Ballot, all early voting material and all instructions at the polls, and such other materials as the City Clerk shall deem necessary. SECTION 8. The returns of the Election shall be made to the Council within twelve days of the election and the Council will meet within twenty days after the election, to canvass the returns of the Election, all as provided by law. The Council will be governed by the vote of the majority on the questions submitted. SECTION 9. Pursuant to Arizona Revised Statutes §35-454(F), the City Clerk shall, on behalf of the Mayor and Council of the City, file and record in the office of the Maricopa County Recorder a certificate disclosing the purposes of the Election, the total number of votes for and against each bond proposition and whether or not the indebtedness in each ballot proposition is ordered. SECTION 10. That the allocations between the six percent (6%) and twenty percent (20%) debt limitations as a percentage of the value of taxable property within the City under Article 9, Section 8 of the Arizona Constitution of the bonds authorized in the respective propositions shall be determined at the time of issuance of such bonds. 2 PHX 327733809v4 1/8/2007 SECTION 11. By reason of the urgent need for the improvements to be made from the proceeds of the bonds herein sought to be authorized to improve the public services of the City and thereby protect the health and safety of the inhabitants of the City, the immediate operation of the provisions of this Resolution is necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, and this Resolution will be in full force and effect from and after the passage by this Council and it is hereby exempt from the referendum provisions of the Constitution and laws of the State of Arizona. GENERAL PROVISIONS The following provisions apply to all bonds to be voted on. Specific information for each issue is- set outfor each question. -In addition-to-each specificalLy_authorized-purpose,—bond proceeds may be used to pay all necessary legal, accounting, financial, architectural, engineering and other costs in connection with the purpose and to purchase bond insurance or other credit support for the bonds. Payment of Bonds: Each series of these bonds may be issued at the option of the Mayor and Council as general obligation bonds of the City and in which case the bonds shall be designated General Obligation Bonds. The issuance of these bonds will result in an annual levy of property taxes sufficient to pay the debt on the bonds. FOR THE BONDS ❑ AGAINST THE BONDS 0 A-2 PHX 327733809x4 1/8/2007 PROPOSITION NO. 2 ECONOMIC DEVELOPMENT AND NEW JOB CREATION PRINCIPAL AMOUNT: $51,588,000 Purposes: Promoting new private sector job creation through development and redevelopment within the City of Glendale, including land acquisition to be used for public/private partnerships, constructing infrastructure for future business parks, and acquiring land and interests therein as may be needed for such purposes. Payment of Bands: Each-series-of_these-bonds nay_be issued at-the-option of-the Mayor and - Council as general obligation bonds of the City and in which case the bonds shall be designated General Obligation Bonds. The issuance of these bonds will result in an annual levy of property taxes sufficient to pay the debt on the bonds. FOR THE BONDS 0 AGAINST THE BONDS 0 A-3 PI-IX 327733809v4 1/8/2007 PROPOSITION NO. 3 STREETS AND PARKING PRINCIPAL AMOUNT: $79,065,000 Purposes: Constructing, reconstructing, improving and maintaining major and local streets, highways and bridges and parking within the City, and further including but not limited to downtown and City-wide parking garages, street signage, lighting, street widening and landscaping, and acquiring land and interests therein as may be needed for such facilities and purposes. Payment of Bonds: Each series of these bonds may be issued at the option of the Mayor and Council, either as: (1) street and highway user revenue bonds payable solely from the revenues to be derived from taxes, fees, charges and other moneys collected by the State of Arizona and returned to the City for street and highway purposes pursuant to law which have not theretofore specifically been allocated and pledged for payment of other indebtedness of the City, so much of such revenues as are necessary to pay principal and interest of the bonds to be irrevocably ! appropriated for the purpose of paying such principal and interest; (2) tax secured revenue bonds payable from such street and highway user revenues and, if such revenues prove insufficient, from the levy of an ad valorem tax against the taxable property in the City, in which case the bonds may be designated Tax Secured Street and Highway Revenue Bonds; (3) general obligation bonds of the City, in which case the bonds shall be designated General Obligation Bonds. The issuance of these bonds will result in an annual levy of property taxes sufficient to pay the debt on the bonds, unless the governing body provides for payment from other sources. The City will prepare an information pamphlet that will be mailed to households of registered voters within the City. Any persons wishing to submit a PRO or CON statement regarding the questions to be presented (not to exceed 300 words) may do so by mail or hand delivery of the statement to the Office of the City Clerk, Glendale Municipal Building, 5850 West Glendale Avenue, Glendale, Arizona 85301. A printing fee of $150.00, payable to the Glendale City Clerk, is required to be submitted with each PRO or CON statement. Se le ordena a la Secretaria de la Ciudad que ponga la cuestion en la boleta de la Eleccion el 15 de mayo,2007. SECCION 2. Por medio de esta se le autoriza a la Secretaria de la Ciudad a concertar un Acuerdo de Memo de Servicio con el Departamento de Elecciones del Condado de Maricopa (el "Condado") para verificar dicha election y para pagar los cargos de elecciones normales y acostumbrados anunciados por el Condado. SECCION 5. Que los sitios de votacion y el horario en que las umas estaran abiertas y cerradas sera de las 6:00 a.m. a las 7:00 p.m. SECCION 6. La Eleccion sera verificada y se mantendran las listas de votacion, y los votos depositados en esa seran contados y tabulados y los retomos de esos seran hechos de la manera proporcionada por ley y votaran en la Eleccion solo las personas que son electores calificados de la Ciudad. SECCION 7. Para poder cumplir con el Acta de Derechos de Votacion de 1965, segun enmendado, los siguientes procedimientos pertenecientes a esta Eleccion seran traducidos al Espanol y distribuidos segun requerido, es decir: La Notificacion de la Eleccion de Bonos, la Boleta, todo el material de votacion por adelantado y todas las instrucciones en las urnas, y dichos otros materiales como la Secretaria de la Ciudad considere necesarios. SECCION 8. Los retomos El retomo de la Eleccion se le haran al Concilio dentro de doce dias de la eleccion y el Concilio se reunira dentro de veinte dias despues de la eleccion, para escrutinar los retomos de la Eleccion, todo segun provisto por ley.
