SPECIAL WARRANTY DEED
For the consideration of Ten Dollars ($10.00) and other valuable consideration,
TARGET CORPORATION, a Minnesota corporation, formerly known as Dayton-
Hudson Corporation, ("Grantor") does hereby convey to the CITY OF GLENDALE, an
Arizona Municipal Corporation, ("Grantee"), the following real property situated in
Maricopa County, Arizona, together with all rights and privileges appurtenant thereto:
SEE EXHIBIT "A" AND EXHIBIT "B" ATTACHED HERETO.
The conveyance herein is made as a dedication for public right of way for roadway
purposes and all the uses contemplated in public street dedication.
The conveyance made hereunder is made subject to real estate taxes and installments of
special assessments, a lien not yet due and payable; all matters of record; all matters that
would be disclosed by an accurate survey of the Property; and any matter caused or
suffered by Grantee; the Grantor hereby binds itself and its successors to warrant and
defend the title against all those claiming by or through Grantor and none other, subject
to the matters above set forth.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS
SPECIAL WARRANTY DEED OR IN ANY EXHIBIT ATTACHED HERETO, IT IS
UNDERSTOOD AND AGREED THAT THE PROPERTY IS BEING CONVEYED
HEREUNDER IN AN"AS IS, WHERE IS, AND WITH ALL FAULTS" CONDITION
AND, EXCEPT ONLY FOR THE SPECIAL WARRANTY OF TITLE EXPRESSLY
SET FORTH ABOVE, NO WARRANTY OR REPRESENTATION IS BEING MADE
BY GRANTOR REGARDING THE PROPERTY, INCLUDING BUT NOT LIMITED
TO: THE CONDITION OF THE SURFACE OR SUBSURFACE OF THE PROPERTY;
ZONING OR OTHER GOVERNMENTAL CONDITIONS OR RESTRICTIONS
APPLICABLE TO THE PROPERTY; UTILITY AVAILABILITY OR CAPACITIES;
COMPLIANCE WITH ENVIRONMENTAL LAWS OR ANY OTHER EXISTING
LAWS OR GOVERNMENTAL REGULATIONS; THE CONDITION OF ANY
BUILDINGS OR IMPROVEMENTS INCLUDED WITHIN THE DEFINITION OF
THE PROPERTY; MERCHANTABILITY OR FITNESS OF THE PROPERTY OR
ANY PART THEREOF FOR A PARTICULAR PURPOSE; OR ANY OTHER ASPECT
OF THE PROPERTY WHICH MAY MATERIALLY AFFECT THE VALUE OR THE
USE THEREOF.
