The meeting was called to order by Mayor Elaine M. Scruggs, with Vice Mayor Manuel D. Martinez, and the following Councilmembers present: Joyce V. Clark, Steven E. Frate, David M. Goulet, Yvonne J. Knaack, and H. Philip Lieberman. Also present were Ed Beasley, City Manager; Pam Kavanaugh, Assistant City Manager; Craig Tindall, City Attorney; and Pamela Hanna, City Clerk. Mayor Scruggs welcomed Cub Scout Pack #267 — Den 4 from Glendale/Peoria. The four boys are working on their Citizen Activity Badge. Wesley Christmas, Joshua Brown, Derrick Blowers and Alex Teusink were accompanied by their parents Melissa Christmas, Joe Brown, Annie and Brian Blowers and Don Feltner. COMPLIANCE WITH ARTICLE VII, SECTION 6(c) OF THE GLENDALE CHARTER A statement was filed by the City Clerk that the two resolutions and three ordinances to be considered at the meeting were available for public examination and the title posted at City Hall more than 72 hours in advance of the meeting. APPROVAL OF THE MINUTES OF THE DECEMBER 11, 2007 CITY COUNCIL MEETING It was moved by Goulet, and seconded by Frate, to dispense with the reading of the minutes of the December 11, 2007 regular City Council meeting, as each member of the Council had been provided copies in advance, and approve them as written. The motion carried unanimously. CONSENT AGENDA Mr. Ed Beasley, City Manager, read agenda item numbers 1 through 7 and Ms. Pamela Hanna, City Clerk, read consent agenda resolution item numbers 8 and 9 by number and title. 1. SPECIAL EVENT LIQUOR LICENSE FOR ST. HELEN CATHOLIC CHURCH — FEBRUARY 2, 2008 This is a request for the City Council to approve a special event liquor license for St. Helen Catholic Church, located at 5510 West Cholla Street. The event will be held on Saturday, February 2, 2008 from 6:00 p.m. to 10:00 p.m. and will be held in the church's Social Hall. This event will be a charity fundraiser, with proceeds going to St. Helen Catholic Church renovation activities. Adequate parking for attendees will be 1 available on the church campus. The special event liquor license was submitted by Bernadette A. Friedl. If this license is approved, the total days expended by this applicant will be one of the allowed 10 days per year. Under the provisions of Arizona Revised Statutes Sec. 4-203.02, the Arizona Department of Liquor Licenses and Control may issue a special event liquor license only if the Council recommends approval of such license. No previous action has occurred. The City of Glendale Planning, Fire and Police Departments have reviewed the application and determined that it meets all technical requirements. Therefore, it is staffs recommendation to forward the application to the Arizona Department of Liquor Licenses and Control with a recommendation of approval. 2. LIQUOR LICENSE NO. 3-1162 CHEVRON, SPEEDSMART This is a request for the City Council to approve a new non-transferable Series 10 (Liquor Store — Beer and Wine) license, for Chevron, Speedsmart, located at 5103 West Peoria Avenue. The Arizona State application (number 10075516) was submitted by Hassan Mohamad Zeitoun. The 60-day deadline for processing this application was December 23, 2007. A request for extension was submitted to the Department of Liquor License. The location of the establishment is 5103 West Peoria Avenue and is within the Barrel District, zoned C-2 (general commercial). This establishment is over 300 feet from any school or church. This is a new license application for a non-transferable Series 10 (Liquor Store — Beer and Wine) by Hassan Mohamad Zeitoun. The population density is 6,200 people per square mile. The approval of this license will increase the total number of liquor licenses in this area by one. The number of liquor licenses within a one-mile radius is 33 as listed below: Series Type Quantity 6 Bar —All Liquor 10 7 Bar — Beer & Wine 1 9 Liquor Store — All Liquor 6 10 Liquor Store — Beer & Wine 6 12 Restaurant—All Liquor 10 Total 33 No protests were received during the 20-day posting period. The City of Glendale Planning and Police Departments, as well as the Maricopa County Health Department, have reviewed the application and determined that it meets all technical requirements. Therefore, it is staffs recommendation to forward this 2 application to the Arizona Department of Liquor Licenses and Control with a recommendation of approval. 3. CONSTRUCTION MANAGER AT RISK CONTRACT FOR CHOLLA TELEMETRY PROJECT, PHASE Ill This is a request for the City Council to approve a Construction Manager at Risk contract with Hunter Contracting Company to provide construction services for the Cholla Telemetry Phase III project with a stated Guaranteed Maximum Price of $1,200,000. One of Council's strategic goals is high-quality service for citizens. The Cholla Telemetry Phase III project ensures reliable remote monitoring of all the treatment plants' water and wastewater control systems by replacing the current telephone telemetry with microwave radio telemetry. Burgess & Niple, Inc., Consulting Engineers, prepared the Utilities Department's Radio Telemetry Master Plan that outlined three phases of necessary improvements. Phase I, completed in the summer of 2000, developed the Radio Telemetry Master Plan and completed the installation of critical equipment at 19 sites, primarily wells and water distribution critical equipment sites. In the summer of 2003, Phase II completed the installation of critical equipment at 17 sites, primarily wastewater lift stations and effluent distribution outlets. CH2M Hill was selected to perform the design and construction administration services for Phase III, which includes adding microwave radio communication equipment to the Arrowhead Ranch Water Reclamation Facility, Cholla Water Treatment Plant, Pyramid Peak Water Treatment Plant and West Area Water Reclamation Facility and to the Emergency Operations Center. A Request for Qualifications (RFQ) was issued by the city to solicit proposals for Construction Manager at Risk construction services. One proposal was received from Hunter Contracting Company. They were selected to perform the construction services based on their responsive proposal, having met all the qualifications outlined in the RFQ. On May 22, 2007, the Council approved a professional services agreement with CH2M Hill to perform design and construction administration services for the Phase III components of the radio telemetry system. On June 25, 2002, the Council approved the transfer of funds and awarded the construction contract to Alliance Control & Service Specialists, for the construction of Phase II of the radio telemetry system to monitor and control various water and wastewater facilities located throughout the city. 3 On June 12, 2001, the Council approved the professional services agreement with Burns and McDonnell for the design and construction administration services for Phase I of the radio telemetry system. The addition of the microwave radio system will ensure reliable remote monitoring of all the treatment plants by constructing a new city-owned high-speed data telemetry system that will have an automatically switched backup system maintained by the phone company. Funds are available in the Fiscal Year 2007-08 Cholla Telemetry Account No. 2400-61005-550800 Capital Improvement Program (CIP) for part of the required work. However, a transfer of funds in the amount of $648,710 from the Oasis Water Campus CIP Account No. 2400-61003-550200 into the Cholla Telemetry Account No. 2400- 61005-550800 is requested to complete the construction costs. Grants Capital Expense One-Time Cost Budgeted Unbudgeted Total X X $1,200,000 Account Name, Fund, Account and Line Item Number: FY 2007-08: Cholla Telemetry, Account No. 2400-61005-550800 The recommendation was to authorize the City Manager to enter into a Construction Manager at Risk contract with Hunter Contracting Company with a Guaranteed Maximum Price of $1,200,000 to provide construction services for the Cholla Telemetry Phase III project and approve the transfer of funds. 4. AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT FOR 43RD AVENUE INTERSECTIONS This is a request for the City Council to approve an amendment of the professional services agreement (PSA) with RBF Consulting at a total cost of $98,000 for construction administration services for intersection improvements on 43rd Avenue between Bethany Home Road and Peoria Avenue. This project meets the Council goal for providing high-quality services for the citizens by improving the transportation options within the city. Improvements include new traffic signals, raised medians, improved access control, turn lanes, and bus bays. In November of 2001, Glendale voters approved funding for the Glendale Onboard Program (GO) for a variety of transportation projects to enhance the quality of life throughout the City of Glendale. In 2003, RBF was selected to design and provide construction administration services to complete intersection improvements along 43rd Avenue. 4 This amendment is necessary for the consultant to fully complete construction administration and construction close-out services. Additional costs have occurred because of numerous changes to the project over the past several years, including redesign of traffic signal plans, medians, a screenwall, and driveway access; additional coordination meetings with Salt River Project and the City of Phoenix; and a substantial amount of additional detail on traffic signal plans, median re-design and site access alternatives. On April 10, 2007, the Council approved an amendment to the PSA with RBF Consulting in the amount of $135,000. On March 17, 2004, the Council approved an amendment to the PSA with RBF Consulting in the amount of$34,500. On October 28, 2003, the Council awarded a PSA with RBF Consulting in the amount of $383,560 for the design of five intersections and bridge safety improvements. 43rd Avenue is a major arterial street on the border of Glendale and the City of Phoenix. The improvements will include construction of medians to provide access control, as well as bus bays and turn lanes to improve capacity at the major intersections. On February 15, 2007, a public meeting was held for review of the design of improvements for intersections along 43`d and 5151Avenues. In November of 2001, Glendale voters approved funding for the GO projects, which included the intersections designed by RBF Consulting. PROFESSIONAL SERVICES AGREEMENT - ARCHITECTURAL SERVICES FOR THE WEST BRANCH LIBRARY This is a request for City Council approval of a professional services agreement with DWL Architects & Planners for the design of a new library to be located within the Western Regional Park site at 83rd Avenue and Bethany Home Road. 5 The new library will address the goal of a city with high-quality services for citizens, as well as one community with strong neighborhoods. The West Branch Library was specifically identified as a capital project in the Fiscal Year1998-2007 ten-year capital plan. In that ten-year capital plan, the facility was scheduled for design in Fiscal Year 2001-02, with construction planned for the last five years, Fiscal Years 2003-2007. A few years later, as a part of the master plan for a new regional park at 83rd Avenue and Bethany Home Road, a new branch library was identified as an important element of the overall site plan. The park site comprises approximately 88 acres located on the northeast corner of 83rd Avenue and Bethany Home Road. As part of the park's master plan, a new one-story library structure, approximately 33,500 square feet in size, was planned for seven acres within the park. It will be compatible with the existing Gateway Public Safety building, as well as other park amenities. The professional services agreement with DWL Architects includes design and construction administration services for the construction of the West Branch Library. In June of 2007, a Request for Proposals (RFP) was advertised and sent to architectural firms to obtain the professional architectural services to perform this work. Three firms were invited to present to the selection committee, consisting of staff from Planning, Parks and Recreation, Engineering, Library and an executive from a licensed contracting company (D. L. Withers). Based on the committee's scores, DWL Architects was selected as the best qualified firm to provide the required services. The West Branch Library was specifically identified for the first time in the Capital Improvement Program (CIP) as part of the Fiscal Years 1998-2007 ten-year CIP. This project will directly benefit the citizens of Glendale, especially those in the western area of the city who currently must drive several miles to utilize the Velma Teague Branch. This library will provide services and programs to children, teens, adults and seniors that are not currently accessible for many residents. It will serve a population of approximately 50,000 in the western area of Glendale, and it is anticipated that more than 1,000 people per day will utilize the services of this branch. The West Branch Library will offer more than 870 programs annually. The neighborhood has been involved in the project since the spring of 2001, when three neighborhood meetings concerning the West Area Regional Facility Master Plan were held. Citizens' feedback from the meetings indicated that 60 percent of the attendees felt that the library was a vital part of the plan, thus making it the number one amenity mentioned for inclusion on the site. Area residents have been kept updated about the park and its pending amenities via neighborhood and City Council meetings over the years. There will be more opportunities for citizen participation during the initial design phase. 6 It is estimated that O&M expenses of $700,000 will begin in April of 2010, approximately three months prior to the opening of the library. The full fiscal year impact of approximately $2.5 million is expected to occur in Fiscal Year 2010-11. Funds for architectural services are budgeted in the Fiscal Year 2007-08 Capital Improvement Budget, and will be paid using Development Impact Fee funding designated for libraries. CONSENT RESOLUTIONS 8. INTERGOVERNMENTAL AGREEMENT FORMING THE FIRE SERVICES RESOURCE CONSORTIUM This is a request for the City Council to authorize the City Manager to approve an intergovernmental agreement with Valley fire agencies to establish the Fire Service Resource Consortium to provide special event staffing assistance. The participating jurisdictions are the cities of Apache Junction, Avondale, Chandler, El Mirage, Goodyear, Mesa, Peoria, Phoenix, Scottsdale, Surprise, Tempe and Tolleson, the towns of Buckeye and Gilbert, and the fire districts of Daisy Mountain, Sun City, Sun City West and Sun Lakes. The intergovernmental agreement addresses the Council's goal of one community focused on public safety for citizens and visitors. 10 The continued growth of the West Valley and the increase of Valley-wide events have created significant staffing challenges for public safety agencies. This partnership will provide assistance to an agency hosting an event to request staffing should their own resources not be sufficient to meet all the fire fighting, fire prevention, EMS and special operations services. The participating agencies agree to provide personnel and resources on an as-available, as-needed, basis. Through this agreement, the hosting agency will reimburse the providing agency for any personnel or equipment provided. The partnership with the various fire agencies will ensure that public safety staff is available for protection of the community. The Fire Resource Consortium is similar to the West Valley Coalition established by the Glendale Police Department. The coalition consists of law enforcement agencies from throughout the valley. Through this consortium, the Glendale Fire Department and participating agencies will be working together to ensure that citizens and visitors experience a safe environment while attending special events. The hosting agency will reimburse the providing agency for any personnel or equipment. However, neither agency will incur any additional costs. The recommendation was to waive reading beyond the title and adopt a resolution authorizing the City Manager to enter into the intergovernmental agreement with Valley fire agencies to establish the Fire Service Resource Consortium to provide for special event staffing assistance. Resolution No. 4122 New Series was read by number and title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF AN INTERGOVERNMENTAL AGREEMENT FORMING THE FIRE SERVICE RESOURCE CONSORTIUM FOR FIRE SERVICE RESOURCES TO SUPPORT SPECIAL EVENTS WITH THE FOLLOWING JURISDICTIONS: CITIES OF APACHE JUNCTION, AVONDALE, CHANDLER, EL MIRAGE, GOODYEAR, MESA, PEORIA, PHOENIX, SCOTTSDALE, SURPRISE, TEMPE AND TOLLESON, THE TOWNS OF BUCKEYE AND GILBERT, AND THE FIRE DISTRICTS OF DAISY MOUNTAIN, SUN CITY, SUN CITY WEST AND SUN LAKES. 9. LETTER OF AGREEMENT WITH THE NAVAJO COUNTY COMMUNITY COLLEGE DISTRICT This is a request for the City Council to adopt a resolution entering into a letter of agreement with the Navajo County Community College District (Northland Pioneer College) to conduct educational programs to train qualified individuals for certification as Emergency Medical Technicians. The trainees will provide free additional manpower on Glendale Fire Department apparatus while completing their training. 11 The approval of the training agreement with Northland Pioneer College will ensure that Council's goal of one community focused on public safety for citizens and visitors is accomplished. The Glendale Fire Department has historically assisted various community colleges within Maricopa County to train qualified individuals to become certified Emergency Medical Technicians. This request will allow qualified individuals to receive valuable field experience in a progressive medical training atmosphere. The trainees will provide free additional manpower on Glendale Fire Department apparatus while completing their training. Additionally, this will assist Rural Communities in training qualified emergency medical technicians for emergency response in their communities. All expenses, including liability insurance coverage, will be provided by Northland Pioneer College. The recommendation was to waive reading beyond the title and adopt the resolution authorizing the City Manager to enter into a letter of agreement with the Navajo County Community College District (Northland Pioneer College) to conduct educational programs to train qualified individuals for certification as emergency medical technicians. Resolution No. 4123 New Series was read by number and title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A LETTER OF AGREEMENT WITH THE NAVAJO COUNTY COMMUNITY COLLEGE DISTRICT aka NORTHLAND PIONEER COLLEGE TO CONDUCT EDUCATIONAL PROGRAMS TO TRAIN QUALIFIED INDIVIDUALS FOR CERTIFICATION AS EMERGENCY MEDICAL TECHNICIANS. Mr. Leonard Clark, a Barrel resident, stated his support for item number one for Saint Helens Church. He said that the Church was great for the community and should be supported. He added that he was also in full agreement with consent resolutions eight and nine. He commends the City of Glendale for all they do for the community. It was moved by Frate, and seconded by Knaack, to approve the recommended actions on Consent Agenda Item Nos. 1 through 9, including the approval and adoption of Resolution No. 4122 New Series and Resolution No. 4123 New Series, and to forward Special Event Liquor License Application for St. Helen Catholic Church for a charity fundraiser to be held at 5510 West Cholla Street on February 2, 2008 and Liquor License Application No. 3-1162 for Chevron, Speedsmart to the State of Arizona Department of Liquor Licenses and Control, with the recommendation for approval. The motion carried unanimously. 12 ORDINANCES 10. SALT RIVER PROJECT EASEMENTS Mr. Larry J. Broyles, P.E., City Engineer, presented this item. This is a request for the City Council to adopt an ordinance granting the following easements in favor of Salt River Project (SRP): (1) an underground power distribution easement on the east side of 71st Avenue, south of Frier Drive; (2) an electrical transmission line easement on 99th Avenue at Camelback Road; and, (3) a temporary irrigation easement along Camelback Road, west of 107th Avenue. The city is constructing a new park facility on the southeast corner of 71St Avenue and Frier Drive, and requested electrical service from SRP. SRP agreed to accommodate this request and is requesting a power distribution easement from the city for the installation and protection of its facilities. In conjunction with a development on the northeast corner of 99th Avenue and Camelback Road, SRP was required to relocate its electrical transmission lines and apparatus. SRP agreed to accommodate this request and is requesting an electric transmission line easement from the city for the protection of its facilities in the new location. In conjunction with the development of the Spring Training Facility at the northwest corner of Camelback Road and 107th Avenue, SRP needs to temporarily relocate an irrigation ditch. SRP has agreed to the temporary relocation if the city grants a temporary irrigation easement for its location. This is a request for the City Council to adopt an ordinance granting a utility easement for natural gas distribution in favor of Southwest Gas Corporation (SWG) at the Glendale Regional Public Safety Training Center, located at 11550 West Glendale Avenue. The city is constructing tactical and situational training features at the Glendale Regional Public Safety Training Center and has requested natural gas service from SWG. SWG has agreed to accommodate this request, and has requested a utility easement from the city to run its gas distribution line across city property for the installation and protection of its facilities. The recommendation was to waive reading beyond the title and adopt an ordinance authorizing the City Manager to execute a utility easement for natural gas distribution in favor of Southwest Gas Corporation at the Glendale Regional Public Safety Training Center. EL PASO NATURAL GAS EASEMENT Mr. Larry J. Broyles, P.E., City Engineer, presented this item. This is a request for the City Council to adopt an ordinance granting a natural gas line easement in favor of El Paso Natural Gas (EPNG) on the north side of Glendale Avenue, just west of Glen Harbor Boulevard. As a result of projected development and population growth in the West Valley, Southwest Gas requested an increase in the delivery of natural gas from its distributor EPNG. EPNG agreed to accommodate this request and is requesting an easement from the city for its natural gas line and expanded facility in the new location. REQUEST FOR FUTURE WORKSHOP AND EXECUTIVE SESSION It was moved by Martinez, and seconded by Frate, to hold a City Council Workshop at 1:30 p.m. in Room B-3 of the City Council Chambers on Tuesday, January 15, 2008, to be followed by an Executive Session pursuant to A.R.S. 38- 431.03. The motion carried unanimously. CITIZEN COMMENTS Mr. Leonard Clark, a Barrel resident, commented on what a great place the City of Glendale was to reside. He thanked the Councilmembers for all they do to make this city such a great place to live. He also thanked them for their leadership with the up and coming Super Bowl. COUNCIL COMMENTS AND SUGGESTIONS Councilmember Clark commented on the new opening of a great restaurant at Westgate. She invited everyone to come and sample the fine food and decor. She also thanked the Council for approving the design of the West Branch Library. Councilmember Lieberman reminded everyone to attend Glendale Glitter and Glow on January 19, 2008. He also wished everyone a great, healthy, prosperous New Year. Councilmember Martinez thanked and congratulated staff on the great work done on the Fiesta Bowl, especially the public safety staff. He added he was confident that the Super Bowl would run smoothly as well. 15 Councilmember Frate also thanked all the departments involved with the Fiesta Bowl. He also thanked the Scouts here tonight for their attendance. He invited everyone to Arrowhead Town Center at 9:00am where they will be breaking ground for a new store. He reminded everyone to watch children around water. Councilmember Knaack wished everyone a safe and healthy New Year. Mayor Scruggs thanked the Cub Scouts for being here tonight. She also thanked the four members of the Mayor Youth Advisory Commission in attendance. She thanked all the city employees, business owners and citizens of Glendale as well.
