OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA,
HELD TUESDAY, SEPTEMBER 25, 2007, AT 7:00 P.M.
The meeting was called to order by Mayor Elaine M. Scruggs, with Vice Mayor
Manuel D. Martinez, and the following Councilmembers present: Joyce V. Clark, David
M. Goulet, Yvonne J. Knaack, and H. Philip Lieberman.
Councilmember Steven E. Frate was absent.
Also present were Ed Beasley, City Manager; Pam Kavanaugh, Assistant City
Manager; Craig Tindall, City Attorney; and Pamela Hanna, City Clerk.
COMPLIANCE WITH ARTICLE VII, SECTION 6(c) OF THE GLENDALE CHARTER
A statement was filed by the City Clerk that the ten resolutions and seven
ordinances to be considered at the meeting were available for public examination and
the title posted at City Hall more than 72 hours in advance of the meeting.
APPROVAL OF THE MINUTES OF THE AUGUST 14, 2007 CITY COUNCIL MEETING
It was moved by Goulet, and seconded by Clark, to dispense with the
reading of the minutes of the August 14, 2007 regular City Council meeting, as
each member of the Council had been provided copies in advance, and approve
them as written. The motion carried unanimously.

The recommendation was to make appointments to the Boards and
Commissions and administer the Oaths of Office.
It was moved by Martinez, and seconded by Goulet, to appoint Kathleen
Roe, Darrell Criswell and M.B. Finnerty to the Arts Commission; William Kelly and
Pierce McLean to the Aviation Advisory Commission; Saif Al-Alawi to the Citizens
Bicycle Advisory Committee; Susan Jernigan and Madeline Page to the
Community Development Advisory Committee; Jeff Hyvarinen and Thomas
Castaldo to the Housing Advisory Commission; and Arthur Alcanatara to the
Planning Commission, for the terms listed above. The motion carried
unanimously.
Mayor Scruggs called those appointees present forward to receive the oath of
office. The oath of office was administered to Darrell Criswell, M.B. Finnerty, Kathleen
Roe, William Kelly, Susan Jernigan, Madeline Page, Jeff Hyvarinen, Thomas Castaldo,
and Arthur Alcantara.
PROCLAMATIONS AND AWARDS
DOMESTIC VIOLENCE AWARENESS MONTH PROCLAMATION
This is a request for the City Council to proclaim October as Domestic Violence
Awareness Month. Educating citizens is an important component in working towards
the goal of ending family violence. The proclamation will educate Glendale residents
about the serious issues involving family violence and the city resources available to
help with the education, prevention, and intervention of domestic violence.

Accepting the proclamation will be Greg Miller, supervisor of Maricopa Adult
Probation Department Domestic Violence; Glynn Thomas, Adult Probation Officer; and
Barbara Goree, Adult Surveillance Officer.
The National Coalition Against Domestic Violence created Domestic Violence
Awareness Day in October 1981. Their purpose was to bring advocates together who
are working to end domestic violence against women and children. Since then the
month of October has been used to highlight domestic violence issues and encourage
victims of family violence to seek out their local resources.
The Glendale Police Department collaborates with other agencies and partners
within the community to reduce incidents of domestic violence. Maricopa County Adult
Probation is one of the major agencies who have collaborated on the Domestic
Violence Task Force by participating in warrant sweeps focused on domestic violence
incidents and offenders. The Probation Officers are a valuable resource to victim
advocates regarding probation violations and offender accountability.
Domestic Violence Awareness Month provides a special opportunity to recognize
and thank the people and agencies that support victims of family violence.
The recommendation was to present the proclamation in recognition of October
as Domestic Violence Awareness Month to Greg Miller, Glynn Thomas and Barbara
Goree.
Mayor Scruggs proclaimed the month of October as Domestic Violence
Awareness Month and presented the proclamation to Greg Miller, Supervisor of
Maricopa Adult Probation Department, Domestic Violence; Glynn Thomas, Adult
Probation Officer; and Barbara Goree, Adult Surveillance Officer.
Mr. Greg Miller thanked the Mayor and City Council for the proclamation. He
stated that he was very grateful to the city courts, prosecutor's office and the city Police
Department in battling domestic violence and offering hope to victims within the City of
Glendale.
NATIONAL FIRE PREVENTION MONTH
This is a request for the City Council to proclaim the month of October as
National Fire Prevention Month. The Glendale Fire Department will celebrate Fire
Prevention Month by hosting the 25th Annual Fire Prevention Day and Parade on
October 6, 2007.
Glendale citizens are being asked to participate in fire prevention activities at
home, work and school. Dennis and Hannah Davis, longtime Glendale Fire volunteers,
will be present to accept the proclamation from Mayor Scruggs.

The purpose of this nationally observed month is to remind citizens of the
importance of fire prevention at home, work, and school. This year's theme is "Practice
Your Escape Plan". Activities for Glendale's Fire Prevention Month begin with the city's
Fire Prevention Day Parade on Saturday, October 6, 2007. The parade begins at 52nd
and Glendale Avenues and proceeds west to 5e Avenue and ends at Murphy Park.
The recommendation was to proclaim October as National Fire Prevention
Month.
Mayor Scruggs proclaimed October as National Fire Prevention Month and
presented the proclamation to Dennis and Hannah Davis, longtime Glendale Fire
volunteers.
Mr. Dennis Davis thanked the Mayor and City Council on behalf of the Fire
Department. He noted that there was probably nothing beyond preventing fires that
saved lives as much as having an escape route.
CONSENT AGENDA
Mr. Beasley requested that Agenda Item No. 11 be pulled administratively.
He noted that this item would be coming forward at a future Council meeting for
consideration.
Mr. Ed Beasley, City Manager, read agenda item numbers 1 through 10 and 12
through 15 and Ms. Pamela Hanna, City Clerk, read consent agenda resolution item
numbers 16 through 22 by number and title.
1. SPECIAL EVENT LIQUOR LICENSE FOR ST. LOUIS THE KING CHURCH
This is a request for the City Council to approve a special event liquor license for
St. Louis the King Church located at 4331 West Maryland Avenue. The fundraising
event will be held on Friday, October 5, 2007 from 5:00 p.m. to 11:00 p.m., Saturday,
October 6, 2007 from 11:00 a.m. to 11:00 p.m., and Sunday, October 7, 2007 from
11:00 a.m. to 11:00 p.m. The special event liquor license was submitted by Marc
Gerard Riccitelli.
If this license is approved, the total days expended by this applicant will be three
of the allowed 10 days this year. Under the provisions of Arizona Revised Statutes
Sec. 4-203.02, the Arizona Department of Liquor Licenses and Control may issue a
special event liquor license only if the City Council recommends approval of such
license.

The City of Glendale Planning, Fire and Police Departments have reviewed the
application, determined that it meets all technical requirements, and have approved the

license. Therefore, it is staff's recommendation to forward the application to the
Arizona Department of Liquor Licenses and Control with a recommendation of
approval.
2. LIQUOR LICENSE NO. 3-1135 KABUKI JAPANESE RESTAURANT
This is a request for the City Council to approve a new non-transferable Series
12 (Restaurant — All Liquor) license for Kabuki Japanese Restaurant, located at 6770
North Hockey Way #G211. The Arizona State application (number 12077203) was
submitted by Kevin Arnold Kramber.
The 60-day deadline for processing this application is August 17, 2007. A
request for extension was submitted to the Department of Liquor Licenses. The
location of the establishment is 6770 North Hockey Way #G211 and is within the Yucca
District, zoned PAD (planned area development). This is a new application submitted
by Kevin Arnold Kramber. The population density is 1,831 people per square mile. The
approval of this license will increase the total number of liquor licenses in this area by

The 60-day deadline for processing this application is August 15, 2007. A
request for extension was submitted to the Department of Liquor Licenses. The
location of the establishment will be 5944 West Bethany Home Road and is within the

Ocotillo District, zoned C-2 (general commercial). This establishment is over 300 feet
from any school or church. Cypress Lounge operated at this location from June of
2003 until April of 2005 under Mike Gillette. Cypress Lounge has operated at this
location from April of 2005 until March of 2007 under Joseph White. Cypress Lounge
operated at this location from March of 2007 to present under Jesus Cardenas

location of the establishment is 5880 West Camelback Road and is within the Cactus
District, zoned C-2 (general commercial). This establishment is over 300 feet from any
school or church. This is a new license application by Kim Kenneth Kwiatkowski. The
Circle K Stores Inc. submitted a letter stating that if this non-transferable Series 10
(Liquor Store- Beer and Wine) is approved, the current Circle K across the street in
Phoenix would surrender back its license to the Arizona Department of Liquor. The

(number 06070296) was submitted by Lynette Robin Braun.

was submitted by Michael Scott Taylor.
The 60-day deadline for processing this application is September 18, 2007. A
request for extension was submitted to the Department of Liquor License. The location
of the establishment is 6751 North White Out Way, Suite E109 and is within the Yucca
District, zoned PAD (planned area development). This is a new application at a newly
constructed site, submitted by Michael Scott Taylor. The population density is 4,429

11. AWARD OF BID 07-36: STREET SWEEPER BROOMS
This is a request for the City Council to approve the award of contract to West
Coast Equipment, Inc. to provide ongoing replacement of brooms for street sweepers.
This street sweeper broom replacement contract will assist the city to maintain a
clean, healthy and safe environment for citizens.
Three bids were received to supply the Field Operations Department with street
sweeper brooms. The Streets Division of the Field Operations Department currently
has nine street sweepers. The front and rear brooms need to be replaced periodically.
The lowest responsive bid was submitted by West Coast Equipment, Inc. The contract
shall begin upon approval by the City Council and continue for one year. The bid
specifications contain an option clause that will permit the city, at the discretion of the
City Manager, to extend this contract for four additional years in one-year increments.
Well maintained, clean and safe roads are critical for our residents. Regular
streets sweeping throughout the city reduces airborne particulate matter and debris that
may accumulate on streets.
Funding is available in the Field Operations Department Streets Division
operating budget.

The recommendation was to award a contract to provide ongoing replacement of
brooms for street sweepers to West Coast Equipment, Inc. in the amount of
$54,171.30.
12. AWARD OF PROPOSAL 07-53: COMMERCIAL REFUSE CONTAINERS

This is a request for the City Council to award the agreement for the purchase of
commercial refuse containers to Wastequip-Arizona in an amount not to exceed
$100,000.
This frontload and roll-off container contract will assist the city to maintain high-
quality service for citizens.
Frontload and roll-off containers are used to provide commercial sanitation
services to businesses and apartments throughout the city. The city has seen
significant growth in both multifamily dwellings, as well as businesses requesting city
sanitation services. The purchase will include approximately 10 roll-off containers and
up to 100 front load containers of various sizes.
Two proposals were received to supply commercial refuse containers on an "as
needed" basis. An evaluation committee consisting of staff from the sanitation
department reviewed the offers received. Evaluation factors included: compliance with
specifications, cost, warranty information, and references. The proposal submitted from
Wastequip-Arizona was scored highest by the committee. Upon award by the City
Council, the agreement will continue for two years. The proposal contains an option
clause permitting the city, at the discretion of the City Manager, to extend this
agreement for four additional years in one-year increments.
Effective solid waste management services are critical to community health and
safety. The city's ability to provide refuse containers is critical to the provision of refuse
collection services.
Funding is available in the Field Operations Department's Fiscal Year 2007-08

The recommendation was to award the agreement for the purchase of commercial

13. PROFESSIONAL SERVICES AGREEMENT: ARROWHEAD RANCH WATER
RECLAMATION FACILITY
This is a request for the City Council to approve the professional services
agreement with Lockwood, Andrews and Newnam, Inc. to provide design and
construction administration services for the Arrowhead Ranch Water Reclamation

Facility recharge well design and installation project. The addition of four recharge
wells is necessary to achieve 100% effluent recharge capacity and to more effectively
operate the system, including the ability to take the effluent line out of service for
repairs.
This project is consistent with the Council goal of providing high-quality service
for Glendale residents by increasing the recharge capacity of the Arrowhead Ranch
Water Reclamation Facility (ARWRF).
Reuse and recharge of reclaimed water supplies is a major emphasis of the City
of Glendale's water resources and infrastructure master plans. These plans assume
that a significant quantity of reclaimed water supplies will be utilized either directly to
meet irrigation demands or indirectly through recharge, storage and recovery. The city's
reclaimed water facilities include reclaimed water lines and pump stations to convey
water supplies from the ARWRF to meet irrigation demands and to future recharge
wells used for recharge and storage of supplies in excess of direct irrigation demands.
This multi-phase project comprises design and construction of four recharge wells and
associated facilities. Currently ARWRF has eight recharge wells and is permitted up to
an additional eight recharge wells.
On October 24, 2000, the Council approved Amendment No. 3 to the
professional services agreement with Wilson & Company in an amount not to exceed
$767,367 for the construction engineering services and startup operation of the effluent
recharge and recovery facilities being installed at two sites in North Glendale.
On July 11, 2000, the Council awarded the construction contract to Zim
Industries, Inc. in the amount of $321,159.38 for the installation of a new water
recharge test well and pipe work at the ARWRF.
On July 11, 2000, the Council approved Amendment No. 2 to the professional
services agreement with the firm of Wilson & Company in the amount of $106,929 for
the engineering services needed to design and prepare contract documents for effluent
recharge and recovery facilities on the site of the ARWRF.
The benefit to the community is providing a safe high-quality effluent for
recharge facilities and irrigation. Also, the increased recharge capacity will allow more
flexibility at the treatment plant.
Funding is available in the Fiscal Year 2007-08 Capital Improvement Plan
budget.

This is a request for the City Council to approve two contracts related to the
Zone 4 Groundwater Treatment Plant (Z4GWTP) and one contract relating to the
updating of the Water Master Plan. The first contract is a professional services
agreement with CH2M HILL, Inc. to conduct a study and prepare a preliminary design
for Phase I of the Z4GWTP and its related wells and water pipelines. In the future, this
professional services agreement will be amended to include Phase II, the final design
services and the construction administration services. The second contract is a
professional services agreement for Construction Manager at Risk (CMAR) with Sundt
Construction, Inc. for preconstruction services of Phase I of the Z4GWTP and related
facilities. The third contract is a professional services agreement with Black & Veatch
Corporation to update the Water Master Plan to include the projected water demands
and facilities needs especially as it relates to the water demands in the rapidly growing
western area of the city.
This project is consistent with the Council goal of providing high quality service
for Glendale residents. The Zone 4 Groundwater Treatment Plant will provide
additional water capacity to the overall water supply infrastructure to meet the growing
demands.
The Zone 4 Groundwater Treatment Plant was originally recommended in the
2003 Water Master Plan for the city and was included in the 10-year Capital
Improvement Projects (CIP) budget. The plant will increase the city's water delivery
capacity by an additional 10 million gallons per day. The ground water treatment plant
will treat water from a few city wells to meet regulatory standards and reduce the nitrate
levels through an ion-exchange process.
The selection of the design consultant, CH2M HILL, Inc., and the construction
company, Sundt Corporation, Inc., was based on the standard procurement process
through proposal reviews and interviews. Five firms submitted proposals and three
firms were short listed for interview in both instances. An interview panel selected
CH2M HILL, Inc. as the most qualified to provide the design and a separate panel
selected Sundt Corporation, Inc. as the most qualified to perform the CMAR
preconstruction services.

Through a qualifications-based selection process, Black & Veatch Corporation
was selected to complete the 2003 Water Master Plan. Due to their intimate knowledge
of the city's water system and the short time frame needed to keep new growth-related
projects on schedule, Black & Veatch have been selected to prepare the updated
Water Master Plan which includes updating the projected water demand and facility
needs to meet the rapid growth in the west area of the city.
These projects will boost the overall water supply capacity of the city. This will
ensure that the city will continue to consistently meet the growing water demand and
provide high quality water to protect public health.
Funding for this project is available in the Fiscal Year 2007-08 Capital
Improvement Plan budget. The contract awards will be in the following amounts: CH2M
HILL, Inc. for Study and Preliminary Design: $ 2,298,120; Sundt Construction, Inc. for

DEPARTMENT
This is a request for the City Council to adopt a resolution entering into a
cooperative fire rate agreement with the Arizona State Land Department to provide fire
protection to state forests and wildlands.
This request supports the Council's strategic goal of one community focused on
public safety for citizens and visitors by providing fire protection to state forests and
wildlands.
The State Land Department has developed a comprehensive forest and wildland
fire Incident Management System. Fire departments that are called to assist with

wildland and forest fires are those who have cooperative agreements with the State
Land Department. By entering into this agreement, the Glendale Fire Department will
be able to provide emergency fire suppression assistance if needed during large scale
events on state lands. Costs incurred by the department while assisting in these events
are reimbursable through the state's disaster cost recovery process. Costs incurred for
use of our equipment will be reimbursed at the rates set by the State. The labor costs
and costs to backfill position for our salaries will be reimbursed by the State at our
rates.
On November 12, 2002, the Council authorized the cooperative mutual aid
agreement with the Arizona State Land Department to provide fire protection to state
forests and wildlands.
By entering into this agreement, the Glendale Fire Department will be able to
provide emergency fire suppression assistance, if needed, during large scale events on
state lands. In return, the city will have access to state-owned fire equipment, if
needed, during periods of extreme brush fire danger in large parks and open areas.

This is a request for the City Council to approve an Intergovernmental
Agreement (IGA) with the United States Department of Justice, Drug Enforcement
Administration (DEA) for the assignment of a Glendale detective to the Phoenix DEA
Task Force for a two-year period. Participation in the Task Force helps the Police
Department fight the importation, sale and use of dangerous drugs and narcotics.
This request supports the Council's strategic goal, one community focused on
public safety for citizens and visitors.
Glendale's participation in the task force dates back more than two decades.
Federal task force agents and detectives partner with Glendale narcotics detectives in
large-scale drug suppression operations in Glendale throughout the year. Up to ten
agents and detectives, and a supervisor may augment the city's own Special

Investigations Unit in operations aimed at interdicting the supply of drugs and the
transfer of large sums of money that accompany the illicit drug trade. The Drug
Enforcement Administration pays the detective's overtime incurred, up to $15,854.25
annually, as the result of task force activities.
Participation in the Task Force enables the Police Department to mount periodic
large-scale operations to suppress drug importation and sales, and greatly enhances
information sharing. It promotes close cooperation between the DEA and the
Department. Up to 10 DEA agents often augment our own Special Investigations Unit
in operations aimed at interdicting the supply of drugs and the transfer of large sums of
money that accompany the illicit drug trade. Removing these traffickers and the effects
of their operations from our neighborhoods is an ongoing priority for law enforcement.

This is a request for the City Council to authorize the City Manager to approve
the intergovernmental agreement (IGA) with the city of Tempe. The IGA allows Tempe
to join the West Valley Coalition, which assists the Glendale Police Department with
public safety services and security for events at the University of Phoenix Stadium
(Stadium).
Entering into this IGA creates a positive partnership with other law enforcement
agencies and provides cooperation for services needed at Stadium events. It
addresses the Council goal of one community focused on public safety for citizens and
visitors by ensuring a high level of public safety coverage at large events in the
Stadium.
At the April 10, 2007 meeting, the Council authorized the City Manager to
approve IGAs with both the cities of Chandler and Scottsdale to join the West Valley
Coalition.
At the June 13, 2006 meeting, the Council authorized the City Manager to
approve IGAs with several West Valley agencies to join the West Valley Coalition. The

participating law enforcement agencies are the police departments from the cities of:
Avondale, Buckeye, El Mirage, Goodyear, Peoria, Phoenix, Surprise, Tolleson,
Wickenburg, and Youngtown; as well as the Maricopa County Sheriff's Office; and the
Arizona Department of Public Safety.
Through these partnerships, the Glendale Police Department and all participating
law enforcement agencies will be working together to ensure that residents and visitors
to Glendale experience a safe environment while attending sports and entertainment
events.

Agreement (IGA) with the Arizona Department of Public Safety for the assignment of a
Glendale detective to the Arizona Auto Theft Task Force. Participation in the Arizona
Auto Theft Task Force helps the Glendale Police Department fight auto theft.
This request supports the Council's strategic goal, one community focused on
public safety for citizens and visitors.
The Arizona Auto Theft Task Force is headed by the Arizona Department of
Public Safety. Glendale's participation dates back approximately eight years. Task
Force detectives partner with Glendale detectives in large scale auto theft suppression
operations in Glendale several times a year. Up to ten detectives and a supervisor
augment Glendale's Auto Theft Squad on these occasions. The Glendale detective
assigned to the Task Force also maintains close liaison with the Arizona Auto Theft
Authority, which dispenses numerous grants to fund equipment, such as the
department's first license plate reader, and training.
On February 24, 2004, the Council adopted a resolution authorizing the city
manager to enter into an IGA with Arizona Department of Public Safety with annual
renewals.

In 1998, the initial IGA was approved with annual renewals.
Participation in the Arizona Auto Theft Task Force enables the Police
Department to mount periodic large scale operations to suppress auto theft within
existing resources, and enhances opportunities for information sharing and alternative
funding. The agreement provides the department with access to additional resources
to combat auto theft. The Arizona Department of Public Safety supplies and maintains
the assigned detective's vehicle, and pays 75 percent of the detective's base salary and
overtime incurred as the result of Task Force activities.

OF TRANSPORTATION FOR BICYCLE FACILITY IMPROVEMENTS ON 63RD
AVENUE
This is a request for the City Council to enter into two Intergovernmental
Agreements (IGAs) with the Arizona Department of Transportation (ADOT) for the
improvements of bicycle routes on 63`d Avenue. These will include the construction of
an on-street bike route on 63`d to 61st Avenues, from Olive to Grand Avenues, and for
the construction of a multi-use overpass at the Loop 101 and the 63`d Avenue
alignment.
By making bicycling and walking more convenient and safe, the overall quality of
life will be enhanced for Glendale residents. Improving and providing transportation
options within the city will assist in providing high-quality services to citizens.
A planned element of the Glendale Bicycle System is 63`d Avenue extending
from Thunderbird Park in the north to the Grand Canal Liner Park in the south. The
proposed projects will close two gaps in this 13-mile corridor.
Part of the plan for Glendale's Bicycle system is the construction of a multi-use
overpass at the Loop 101 and the 63rd Avenue alignment. This multi-use facility passes
over Loop 101 and under the frontage roads on each side, serving as a safe and
convenient route for pedestrians and bicyclists.

The Loop 101 multi-use overpass will eliminate a critical gap in Glendale's
bicycle system. Currently, cyclists must cross the Loop 101 in north Glendale on busy
arterial streets, with motorized traffic entering and exiting the freeway, a situation that is
inconvenient and often unsafe. The overpass at 63rd Avenue will allow pedestrians and
cyclists to safely reach destinations on both sides of the freeway.
Another gap in the 63rd Avenue bicycle corridor is between Olive and Grand
Avenues. This project will: (1) construct bicycle lanes from Alice Avenue to Frier Drive,
(2) provide a bicycle connection to the Bike Park (Safety City Park) and Lions Park
along 63rd Avenue, and (3) mark bike lanes along Frier Drive from 63rd and 61st
Avenues and along 61st Avenue from Frier Drive to Grand Avenue.
From 2005 to 2007 the city of Glendale applied and successfully received
Congestion Mitigation and Air Quality (CMAQ) funding for these projects. The City of
Glendale agreed to provide matching funds for the federal grants.
On November 8, 2005, the Council approved a professional services agreement
with Parsons Transportation Group for engineering design of a bicycle/pedestrian
bridge at 63rd Avenue and Loop 101 and bicycle route improvements along 63rd Avenue
from Grand to Olive Avenues.
On April 12, 2005, the Council awarded a contract to Nickle Contracting, LLC, for
the construction of the 63rd and Northern avenues Community Park, which includes the
portion of 63rd Avenue bicycle improvements between Frier Drive and Northern Avenue.
On November 25, 2003, the Council approved the design concept for the
bicycle/pedestrian bridge over Loop 101 on the 63rd Avenue alignment.
Providing transportation alternatives to Glendale residents is part of the overall
Transportation Master Plan. The citizens of Glendale actively use bike routes and
paths around the city. Improving these sections of the city's bike path system will
provide for safer and more convenient bicycling.
In January of 2007, a mail distribution of information and photos of the proposed
bridge were sent to 1,500 residents and the Council.
In November of 2006 alternative bridge designs were presented to the Arts
Commission. Four concepts were presented, and based on appearance and cost the
cable-stayed design was preferred.
On November 1, 2006, a public meeting was held at the Foothills Public Library
for public review of the multi-use overpass bridge. Approximately 38 residents attended
this meeting and there were eleven comments submitted in support of the proposed
project and one comment submitted opposing the project.

On October 25, 2006, a public meeting was held at City Hall for public review of
the bicycle route improvements along 631 Avenue. Approximately 15 residents
attended this meeting to express their opinions on the proposed project; however, there
were no written comments submitted regarding this project.
On October 5, 2006, the Citizens Transportation Oversight Commission reviewed
design alternatives and overall supported the cable-stayed bridge design.
At the September 4, 2003 CTOC meeting, approximately 15 representatives
from the Glendale Bicycle Advisory Committee and two regional bicycle clubs
expressed their support for the bridge project. On July 9, 2003, Transportation staff
met with approximately 15 residents of the Enclave neighborhood located near the
bicycle/pedestrian bridge project site to discuss design options for the proposed bridge.
Comments by the residents have been taken into consideration in the design of this
project. On February 27, 2003, a public meeting was held at the Foothills Public Library
for the public to review proposed design options for the proposed bicycle/pedestrian
bridge. Approximately 25 Glendale residents attended and provided responses to
survey questions regarding the proposed project.
The 2001 voter-approved Glendale Onboard Transportation Program included
the proposed bicycle and pedestrian improvements along 63rd Avenue. Staff and
representatives from the City of Glendale have participated in annual Glendale
Onboard Open Houses where the 63rd Avenue bike route improvements were
presented for review. Members of the Arts Commission, the Citizens Bicycle Advisory
Committee and the Citizen Transportation Oversight Commission have reviewed the
design of the bridge. Members of the Parks and Recreation Department, the Citizens
Bicycle Advisory Committee and the Citizen Transportation Oversight Commission have
reviewed the design of the improvements along 63rd Avenue.
The cost for construction for the multi-use overpass is $6,234,375. ADOT will
manage construction of the project and the city will receive Federal Congestion
Mitigation and Air Quality (CMAQ) funds of $1,900,000 in Fiscal Year 2006-07 and
$1,657,383 in Fiscal Year 2007-08. The city's required contribution of $2,676,992 is
available in the Fiscal Year 2007-08 Transportation Capital Improvement Plan.

This is a request for the City Council to authorize the City Manager to enter into
an Intergovernmental Agreement (IGA) with the City of Phoenix (Contract Change
Order No. 9) for the continued operation of fixed route bus services in the City of
Glendale.
One of the Council's goals is to provide high-quality services for citizens.
Improving and providing transportation options within the city will assist in achieving this
goal.
For over 25 years fixed route bus service has been provided in Glendale through
an agreement with the City of Phoenix. The agreement will provide continuation of

current levels of fixed route bus service to the citizens of Glendale. Bus service is
provided with funds from the GO Glendale Transportation Plan.
This is an annual IGA approved by the Council to provide fixed route services in
Glendale. This agreement was last approved by the Council on August 29, 2006.
This contract provides citizens of Glendale with all or part of the bus service on
Bethany Home Road, Northern Avenue, Olive Avenue, Peoria Avenue, Thunderbird
Road, Bell Road, Union Hills Drive, 51st, 59th and 67th Avenues. Fixed route service
was provided to more than two million riders in Glendale last year.

21. INTERGOVERNMENTAL AGREEMENT WITH REGIONAL PUBLIC
TRANSPORTATION AUTHORITY FOR TRANSIT SERVICES
This is a request for the City Council to authorize the City Manager to enter into
an Intergovernmental Agreement (IGA) with the Regional Public Transportation
Authority (RPTA) for the continued provision of transit services in the City of Glendale.
Glendale provides ADA service within % of a mile of fixed route service as required by
the ADA legislation. This agreement provides partial reimbursement of ADA costs with
funds provided through Prop. 400.
Improving and providing transportation options within the city will assist the
Council in achieving the goal to provide high-quality services for citizens.

This agreement provides funding through the RPTA for both fixed route and
Americans with Disabilities Act (ADA) transit services. Approval of this IGA will provide
for the continuation of bus service provided by the RPTA in Glendale for Fiscal Year
2007-08 at an estimated cost to the RPTA of $3,256,635. The agreement also
provides for reimbursement of ADA paratransit costs up to $550,088 for Fiscal Year
2007-08.
This is an annual agreement to provide bus service in addition to the service
provided by the GO Glendale Transportation Plan. This agreement was last approved
by Council on August 29, 2006.
This contract provides citizens of Glendale with all or part of the bus service on
Glendale, Peoria, Grand, 59th, and 67th Avenues and four express routes. New fixed
route service improvements for Fiscal Year 2007-08 include super-grid service on
Glendale Avenue and two new express routes. Fixed route service was provided to
more than two million riders in Glendale last year.
The costs of providing transit services are included in the Transportation
Department's operating budget for the Dial-A-Ride division. This agreement with RPTA
provides for reimbursement of ADA paratransit expenses up to $550,088 for Fiscal
Year 2007-08. Funds will be deposited into account 1660-16530-419250, Regional
Public Transit Authority revenue.

PUBLIC HEARING—LAND DEVELOPMENT ACTIONS
22. GENERAL PLAN AMENDMENT GPA07-05 AND REZONING APPLICATION
ZON07-09: 4455 WEST PALMAIRE AVENUE
Mr. Jim May, AICP, Deputy Director for Current Planning, presented this item.
This is a request by Glendale Condominiums North LLC to amend the General
Plan from General Commercial (GC) to High Density Residential (HDR), 12-20 Dwelling
Units per acre, and amend the General Plan from High Density Residential (HDR), 12-
20 Dwelling Units per acre, to General Commercial (GC). Rezone from General
Commercial (C-2) to Multiple Residence (R-4), and Rezone from Multiple Residence (R-
4) to General Commercial (C-2). This will be for the future development of a
condominium project and improvements to an existing Burger King and Taco Bell to the
south of this property. The project is located on Palmaire Avenue, just east of 45th
Avenue.
The General Plan Amendments and rezoning applications will provide land use
designations and zoning districts that will be consistent with the property lines of the
future condominium community and the two existing restaurants to the south. The
requests implement the City Center Master Plan.
The property was annexed on March 28, 1959 and subsequently zoned Multiple
Residence (R-3). The eastern most .8 acres was rezoned to Commercial District
Planned Unit Development (C-2 P.U.D.) in 1977. The remaining acreage was rezoned
to C-2 in 1991. This parcel of property was then rezoned from C-2 to R-4 in 2000.
The Planning Commission recommended approval of GPA07-05/ZON07-09 at
its public hearing on August 2, 2007.
The General Plan amendments and rezonings will be consistent with the City
Center Master Plan (CCMP).
Notification letters were sent to 101 adjacent property owners within 500 feet of
the site and to other interested parties. There were two responses from the property
owners in support of the General Plan amendments and the rezonings.

24 REZONING APPLICATION ZON07-01: CATLIN COURT EAST-5555 WEST
ORANGEWOOD AVENUE
Mr. Jon Froke, AICP, Planning Director, presented this item.
This is a request for the City Council to approve the Planning Commission
initiated request to rezone the Catlin Court East neighborhood from Mixed Residence
(R-2) to Single Residence (R1-6). This neighborhood is located at the southwest corner
of 55th and Orangewood avenues.

The rezoning request is consistent with the General Plan, will implement the City
Center Master Plan, and implement the City Council goal of One Community with a
Vibrant City Center.
The neighborhood is bounded by Orangewood Avenue on the north, 55th Avenue
on the east, Myrtle Avenue on the south, and 57th Avenue on the west. The requested
rezoning would include the 149 lots currently zoned R-2.
The requested rezoning would reduce the intensity of use for the neighborhood
should redevelopment occur in the future and would provide a zoning district that is
similar in character to the existing neighborhood and surrounding residential
neighborhoods. The City Center Master Plan identifies this area as a Neighborhood
Improvement Area, which is intended to encourage residential housing of a single-
family character. The requested rezoning would also bring the property into
conformance with the General Plan designation of Medium Density Residential (3.5 -5
dwelling units per acre).
The Planning Commission recommended approval of the rezoning request at
their meeting of May 3, 2007.
The neighborhood is largely developed with single-family homes, and a rezoning
would preserve the single-family character of the neighborhood by prohibiting new two-
family or multi-family residences in the rezoned area. The rezoning will permit
modifications and additions to existing residences, and the construction of new
residences with side yard setbacks of 10 feet and 5 feet rather than the 15-foot side
yards required in the R-2 zoning district. With the reduced required side yard setbacks,
staff anticipates that the number of variance requests filed for reductions in side yard
setbacks in this neighborhood should decrease.
Given the neighborhood's initial development for single-family homes and its
location adjacent to a neighborhood school and churches, eliminating the R-2 zoning at
this location will eliminate the potential for redevelopment of this neighborhood property
with incompatible medium high-density residential uses.
Letters were sent out to all property owners within the proposed rezoning area on
March 7, 2006, inviting them to the neighborhood meeting. Staff held a neighborhood
meeting on Wednesday, March 29, 2006. Staff also sent out notification letters on
January 30, 2007 and attended a neighborhood block party on Saturday, April 21, 2007
to provide information and receive comments. Staff received one letter of opposition
from a property owner, and his property has been excluded from this rezoning request.
A public notice for tonight's hearing was published in The Glendale Star on August 30,
2007. The property was posted on September 4, 2007, and post card notices were
mailed to approximately 299 adjacent property owners and interested parties on
September 7, 2007.

title, and approve the ordinance for rezoning application ZON07-01.
Councilmember Goulet asked if a person wanted to build a dual condominium,
would they be able to sell them to separate individuals. Mr. Froke stated that it would
probably depend on the lot size. He said that it would depend on the dimensions of the
lots and how much room there was for setbacks.
Councilmember Clark inquired as to why the Planning Commission had only
designated one block for rezoning and not the other block as shown on the map. Mr.
Froke stated that the area in question was primarily a multi-family area with apartments
and duplexes, however would be evaluated at a later time. Councilmember Clark
commented that what she understood was that the western block was easier to process
and the 2nd block was more time consuming however would be evaluated in the future.
Mr. Froke stated that she was correct.
Mayor Scruggs opened the public hearing on Agenda Item No. 24. As there
were no comments, Mayor Scruggs closed the public hearing.

PUBLIC HEARING — LAND DEVELOPMENT ACTIONS
25. DESIGN REVIEW APPLICATION DR07-34: DICK'S SPORTING GOODS-7700
WEST BELL ROAD
Ms. Tabitha Perry, Senior Planner, presented this item.
This is a request by Maxwell Johanson Maher Architects for the City Council to
approve the Design Review application for Dick's Sporting Goods located at 7700 West
Bell Road. The site is located on the north side of the Arrowhead Towne Center
between the AMC Theater and Macy's Department Store.
Council approval of this design review application is required as a stipulation of
the Planned Area Development (PAD) zoning on this property.

The proposed anchor store is consistent with the General Plan objective of
promoting economic development in the City of Glendale. The development
incorporates sound growth management techniques by utilizing the surrounding
infrastructure.
The applicant intends to construct a Dick's Sporting Goods store. The store will
total approximately 77,000 square feet on two floors and will have pedestrian access
from outside and inside the mall. There is sufficient parking provided on the mall
property, and all other development standards have been met.
The project will complete the development of the Arrowhead Towne Center and
provides shopping options that are compatible with the surrounding area.
The applicant sent notification letters to interested parties in the Hidden Manor
Estates and Secluded Estates II which are located within the Arrowhead Towne Center
area. The applicant received one response via email expressing concern regarding the
proposed building blending in with the existing mall. Staff received one response in
support of the proposed development.
A letter of approval from Westcor, the mall owner, supporting the proposed
elevations was submitted on June 14, 2007.
The recommendation was to approve Design Review application DR07-34,
subject to the stipulations as recommended by the Planning Department.
Councilmember Lieberman commented that they had waited 15 years for the
completion of Arrowhead Mall Shopping Center and this last space was now being
developed.

26. CANVASS OF VOTES FOR SEPTEMBER 11 , 2007 SPECIAL ELECTION

This is a request for the City Council to adopt a resolution accepting the canvass
of votes for the September 11, 2007 Special Election.
Glendale voters decided on whether or not to increase the City of Glendale
privilege (sales) tax rate by four tenths of one-percent (.4%), except for the privilege
(sales) tax rate on food for home consumption, and dedicating the increased revenue
therefrom to enhance public safety funding.

Councilmember Lieberman stated that he was disappointed in the low turnout for
the election. He encouraged everyone to get informed and vote.
Mayor Scruggs commented that the low turnout could have possibly been
because the election fell in the fall of an odd numbered year. She noted that it had
been the only election taking place at the time and not in conjunction with national
state, or county elections.
ORDINANCES
27. RIGHT-OF-WAY ABANDONMENT: EAST SIDE OF 99TH AVENUE, NORTH OF
CAMELBACK ROAD, GLENDALE CORPORATE CENTER
Mr. Larry J. Broyles, P.E., City Engineer, presented this item.
This is a request for the City Council to adopt an ordinance abandoning a portion of
the east side of 99th Avenue, north of Camelback Road, reserving to the city a 20-foot
wide exclusive utility easement over the western part of the right-of-way being
abandoned.
On February 27, 2007, the Council approved entering into a Development
Agreement with Opus West Corporation for its 22-acre corporate office campus
development at the northeast corner of 99th Avenue and Camelback Road. One of the
terms of that agreement was abandonment by the city of 40 feet of 99th Avenue right-of-
way.
In anticipation of the Loop 101 freeway, Maricopa County Department of
Transportation acquired a 125-foot-wide right-of-way for the east side of 99th Avenue.
The Loop 101 freeway was eventually constructed approximately 950 feet east of 99th
Avenue. The City of Glendale annexed the area in May of 2003, including 99th Avenue.

The city has determined that such a wide right-of-way is not necessary for the area, and
believes a right-of-way width for the east side of 99th Avenue of 85 feet is adequate.
The right-of-way to be abandoned measures approximately 40 feet by 1,258 feet, and
contains slightly more than one acre.
There have been no objections to this abandonment from outside utility companies,
or from other city departments, as long as the city retains an exclusive utility easement
over the west 20-feet of the abandoned parcel.
The recommendation was to waive reading beyond the title and adopt an
ordinance abandoning a portion of the east side of 99t Avenue, north of Camelback
Road, reserving to the city a 20-foot wide exclusive utility easement over the western
part of the right-of-way being abandoned.

28. ANNEXATION AREA NO. 164: OASIS WATER CAMPUS- 7070 WEST
NORTHERN AVENUE

This is a request for the City Council to adopt an annexation ordinance for
Annexation Area No. 164, which consists of approximately 3.5 acres and is located
along the 71st Avenue alignment north of Northern Avenue. The proposed annexation
includes property owned by the City of Glendale and Rovey Investments.
Glendale 2025, the city's General Plan, includes specific goals addressing the
need for growth management; the Land Use Element, Goal 2 — "Promote sound growth

management methods" and the Growth Areas Element, Goal 3 — "Manage growth to
achieve reasonable, responsible urban development". Annexation is a tool that can be
used by the city to direct and manage growth.
The property is now used as a pad of the city of Glendale Oasis Water Campus
currently under construction, including the driveway access from Northern Avenue and
construction staging yard. The annexation will ensure that the entire Oasis Water
Campus, including all perimeter improvements are developed within the city.
Appropriate signatures have been gathered in support of annexation. To provide
comparable zoning with the existing county zoning, the initial Glendale zoning for the
property will be Agricultural (A-1).
On June 26, 2007, the Council conducted a public hearing on the blank
annexation petition for Annexation Area No. 164 as required by state statute.
The annexation of this site would require that any future development of this
location meet the Glendale General Plan requirements, as well as all other
development standards for the city. The proposed Oasis Water Campus will provide
additional treatment capacity to meet the city's growing potable water demands.

This is a request for the City Council to adopt an ordinance granting an
underground power distribution easement in favor of Salt River Project (SRP) at the
city's Park and Ride Project on the northeast corner of 99th and Glendale Avenues.

The city has requested electrical service from SRP for the construction and
operation of the Park and Ride Project on the northeast corner of 99th and Glendale
Avenues. SRP agreed to accommodate this request, but requires an underground
power distribution easement from the city, across city-owned land, for the installation
and protection of its facilities.

This is a request for the City Council to adopt an ordinance to dedicate
approximately 1.6 acres of city-owned property as public right-of-way for the eastern
half of 99th Avenue, north of Glendale Avenue.
The city acquired this 22.2 acre parcel of land on the north side of Glendale
Avenue, between 99th Avenue and Loop 101 from Arizona Department of
Transportation (ADOT) on August 2, 2005 by a Special Warranty Deed. In this area,
99th Avenue varies between 55 feet wide on the southern portion and 33 feet wide on
the northern portion. Construction plans for the Loop 101/Glendale Park and Ride
require 99th Avenue to be 65 feet wide on the east side of 99th Avenue. Council action
is required to formally dedicate this portion of the 99th Avenue as public right-of-way.

Mr. Raymond H. Shuey, Chief Financial Officer/Finance Director, presented this
item.
This is a request for the City Council to adopt an ordinance amending the City
Code to implement the results of the September 11, 2007 Special Election.
Municipal elections promote increased citizen involvement in all aspects of
municipal government.
At the May 8, 2007 City Council Meeting, the Council adopted Resolution No.
4053 new Series. That action called for a Special Election for September 11, 2007. At
the April 10, 2007 City Council Workshop, the Council discussed various options for
funding Public Safety needs based on current assessments and studies. The Council
requested that the proposal to change the Public Safety tax rate be sent to City of
Glendale voters at a September 2007 Special Election. Staff filed appropriate
notification of the required Model City Tax Code changes with both the Deputy Director
of the League of Arizona Cities and Towns, and the Cities Program Liaison for the
Arizona Department of Revenue. They advised that no further action is required for the
provisions to take effect, and informed the Municipal Tax Code Commission of the
changes.
The recommendation was to waive reading beyond the title and adopt an
ordinance amending the City Code by increasing the privilege (sales) tax rate by four-
tenths of one percent (.4%), except for the rate on food for home consumption, and
dedicating the increased revenue to enhance public safety funding.
Ordinance No. 2589 New Series was read by number and title only, it being AN
ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA
COUNTY, ARIZONA, AMENDING CHAPTER 21.1 OF THE GLENDALE CITY CODE
BY INCREASING THE CITY OF GLENDALE PRIVILEGE (SALES) TAX RATE BY
FOUR-TENTHS OF ONE PERCENT (.4%), EXCEPT FOR THE PRIVILEGE (SALES)
TAX RATE ON FOOD FOR HOME CONSUMPTION, AND DEDICATING THE

INCREASED REVENUE THEREFROM TO ENHANCE PUBLIC SAFETY FUNDING;
AND SETTING FORTH AN EFFECTIVE DATE.
Councilmember Lieberman commented that this was a very controversial issue
and highlighted some items that were in the ordinance for citizen information.
It was moved by Lieberman, and seconded by Martinez, to approve
Ordinance No. 2589 New Series. Motion carried on a roll call vote, with the
following Councilmembers voting "aye": Clark, Goulet, Lieberman, Martinez,
Knaack, and Scruggs. Members voting "nay": none.
REQUEST FOR FUTURE WORKSHOP AND EXECUTIVE SESSION
It was moved by Martinez, and seconded by Clark, to hold the next
regularly scheduled City Council Workshop session at 2:30 p.m. in Room B-3 of
the City Council Chambers on Tuesday, October 2, 2007, to be followed by an
Executive Session pursuant to A.R.S. 38-431.03. The motion carried
unanimously.
MOTION TO EXCUSE COUNCILMEMBER FRATE
It was moved by Martinez, and seconded by Clark, to excuse
Councilmember Frate from tonight's Council meeting. The motion carried
unanimously.
COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Clark stated that she would be holding two fall district meetings on
October 1, 2007, at 6:30 p.m., at Desert Mirage Elementary School and October 29,
2007, at 6:30 p.m., at Bicentennial North Elementary School. She said that each
meeting was identical in format; therefore interested parties should try to attend one of
them.
Councilmember Goulet thanked the neighborhoods that continued to have their
neighborhood meeting despite the heat. He added that he looked forward to having
meetings during the cooler weather.
Councilmember Lieberman commented on his tour of the new Renaissance Hotel. He
stated that it would be hard to match the beauty, design and function of the hotel. He
added that he was immensely impressed.
Vice Mayor Martinez stated that he really did not have anything to add, however if
Councilmember Frate was in attendance he would remind everyone to watch children
around water even with the cooler temperatures.

Councilmember Knaack reminded everyone of her next district meeting being held
October 4, 200, at 6:30 p.m., at the Glendale Adult Center. She encouraged the Barrel
residents to attend.
Mayor Scruggs stated that she would be holding the next community conversation
meeting on October 1, 2007. She asked anyone interested to call her office to reserve
seating because space was limited.
