The meeting was called to order by Mayor Elaine M. Scruggs, with Vice Mayor Thomas R. Eggleston and the following Councilmembers present: Joyce V. Clark, Steven E. Frate, David M. Goulet, H. Philip Lieberman, and Manuel D. Martinez. Also present were Ed Beasley, City Manager; Pam Kavanaugh, Assistant City Manager; Craig Tindall, City Attorney; and Pamela Hanna, City Clerk. The Mayor welcomed Boy Scout Pack Number 221, Thunderbird District. COMPLIANCE WITH ARTICLE VII, SECTION 6(c) OF THE GLENDALE CHARTER A statement was filed by the City Clerk that the four resolutions and one ordinance to be considered at the meeting were available for public examination and the title posted at City Hall more than 72 hours in advance of the meeting. APPROVAL OF THE MINUTES OF THE SEPTEMBER 26, 2006 CITY COUNCIL MEETING It was moved by Goulet, and seconded by Frate, to dispense with the reading of the minutes of the September 26, 2006 regular City Council meeting, as each member of the Council had been provided copies in advance, and approve them as written. The motion carried unanimously. BOARDS AND COMMISSIONS This is a request for City Council to approve the recommended appointments to the following boards and commissions that have a vacancy or expired term and for the Mayor to administer the oath of office to those appointees in attendance. It was moved by Martinez, and seconded by Frate, to appoint Larry Warren Clark, Sr. to the Public Safety Personnel Retirement System/Fire Board and the Public Safety Personnel Retirement System/Police Board, for a term commencing on October 10, 2006 and terminating on July 1, 2010. The motion carried unanimously. Mr. Larry Clark was called forward and was administered the oath of office. He thanked Mayor Scruggs and the Council. He stated that he was proud to be a member of the advisory board. PROCLAMATIONS AND AWARDS PROCLAMATION OF APPRECIATION TO SINE HARDWARE This is a request for City Council to recognize Sine Hardware on the occasion of its 95th anniversary. Sine Hardware will hold a three-day celebration on October 13, 14, and 15, 2006 to celebrate its 95 years in the community. Amanda Carlson, General Manager of Sine Hardware, and daughter-in-law of Bob and Tracy Sine, will accept the proclamation. Sine Hardware, which was originally named Glendale Motor and Supply Company, was first opened in 1911 by two brothers, Tuck and Van Sine. In the early 1900s the original store space became limited, so soon another building was constructed next to the store to assist in the sale of large farm equipment. Sine Hardware continues to be a successful family-owned and operated business. The recommendation was to proclaim appreciation for Sine Hardware and its commitment to Glendale and the community. Ms. Amanda Carlson, was called forward and spoke on behalf of the Sine family. Also called forward were Mr. Bob Sine and Ms. Tracy Sine. 2 Ms. Amanda Carlson thanked Mayor Scruggs and Council on behalf of the Sine family and store employees for honoring them with this proclamation. She stated that throughout the years they have seen many changes. Sine Hardware has changed and adapted with the city's growth to continually meet the needs of the customers. She noted that what has not change was their devotion to their customers. SALVATION ARMY HARVEST FESTIVAL This is a request for City Council to proclaim October 21 , 2006 a day to honor the Salvation Army's mission of strengthening our community's commitment of making a difference by helping others. The community is invited to show their support by attending the Harvest Festival on Saturday, October 21 , 2006 at the Glendale Corps, 6010 West Northern Avenue from 11:00 a.m. to 3:00 p.m. Major Ron Bawden of the Salvation Army's Glendale Corps was ordained as a minister and commissioned as a Salvation Army Officer with the rank of Lieutenant in 1965. William and Catherine Booth founded the Salvation Army in 1878. Their mission was to help feed the homeless and assist in rehabilitation services in London's East End. The Salvation Army has continued with their mission for over 100 years, and has expanded their outreach to more than 100 countries. They have continued their goal of social service backed by their strong religious principals. The recommendation was to present the proclamation to the Salvation Army's Glendale Corps in honor of their committed service to the community and their Harvest Festival celebration. Major Ron Bawden accepted the proclamation on behalf of the Salvation Army Glendale Corps. He thanked Mayor Scruggs for this honor. He stated that he and his wife chose the City of Glendale as their appointment. He said he has been in the Valley for five years and it's been an enjoyable stay. He said they plan to retire in the Valley because of its small, hometown feel. He stated he appreciates the opportunity to serve the community. DOMESTIC VIOLENCE AWARENESS MONTH PROCLAMATION This is a request for City Council to proclaim October as Domestic Violence Awareness Month. Educating citizens is an important component in working towards the goal of ending family violence. Domestic Violence Awareness Month provides a special opportunity to recognize and thank the people and agencies that support victims of family violence. Warren Nothmagle, the husband of Sue Lindley, and Debbie DeWitt and Ginger Cox from the American Legion Auxiliary will be present to accept the proclamation from the Mayor. 3 The National Coalition Against Domestic Violence created Domestic Violence Awareness Day in October 1981. Their purpose was to bring advocates together who are working to end domestic violence against women and children. Since then, the month of October has been used to highlight domestic violence issues and encourage victims of family violence to seek out their local resources. There is a high correlation between domestic violence and child abuse and neglect. Studies have shown that child abuse occurs in up to 70% of families that have a history of domestic violence. The Glendale Police Department collaborates with other agencies and partners in the community to reduce domestic violence. In order to be proactive and prevent crimes against children, the Glendale Police Department is expanding the services offered at the West Valley Advocacy Center to include the radKIDS (Resisting Aggression Defensively) Personal Empowerment Safety Education Program. The educational program enhances the ability of children to utilize knowledge and skills to protect themselves from violence and harm. This program would not be offered if it were not for the funding opportunities provided by our local organizations. Funds were donated to the West Valley Advocacy Center in memory of Sue Lindley, who was the forensic interviewer at the West Valley Advocacy Center. Ms. Lindley devoted her energy and skills to abused children. This donation paid for the training of two certified instructors. The American Legion Auxiliary also generously donated funds for instructional materials and equipment used for self- defense training The proclamation will educate Glendale residents about the serious issues involving family violence and the city resources available to help with the education, prevention, and intervention of domestic violence. The primary benefit to our community is that we have another resource, through the radKIDS program, to help keep our children safe from violence and harm. The recommendation was to present the proclamation in recognition of October as Domestic Violence Awareness Month to Warren Nothmagle, the husband of Sue Lindley, and Debbie DeWitt and Ginger Cox from the American Legion Auxiliary. Ms. Lori Smith, Victim Assistance Caseworker, shared her pride and gratefulness in accepting this honor. She thanked Mayor Scruggs and Council for the proclamation. CONSENT AGENDA Mr. Ed Beasley, City Manager, read Agenda Item Numbers 1 through 5 and Ms. Pamela Hanna, City Clerk, read consent agenda resolutions numbers 6 through 8 by number and title. 4 1. LIQUOR LICENSE NO. 3-1078 7-ELEVEN #16623E This is a request for City Council to approve a new Series 10 (Liquor Store — Beer and Wine) license for 7-Eleven #16623E, located at 5925 West Olive Avenue. The Arizona State application (number 10075274) was submitted by Surinder Kaur Sahnan. The 60-day deadline for processing this application is October 14, 2006. The location of the establishment is 5925 West Olive Avenue and is within the Barrel District, zoned C-3 (heavy commercial). This establishment is over 300 feet from any school or church. This business operated as a 7-Eleven from May 2000 to present, and held a Series 10 license throughout the duration. This is an ownership change from 7- Eleven, Inc. to Surinder Kaur Sahnan, an independent franchisee. This is a new license application by Surinder Kaur Sahnan, operating with an interim permit. The population density is 7,415 people per square mile. The approval of this license will not increase the total number of liquor licenses in this area. LIQUOR LICENSE NO. 3-1079 HOUSE OF SPIRITS This is a request for City Council to approve a person-to-person transfer of this Series 9 (Liquor Store — All Liquor) license for House of Spirits, located at 4306 West Northern Avenue. The Arizona State application (number 09070323) was submitted by Mansar Mansar. 5 The 60-day deadline for processing this application is October 20, 2006. The location of the establishment will be 4306 West Northern Avenue and is within the Cactus District, zoned C-2 (general commercial). This establishment is over 300 feet from any school or church. The House of Spirits has operated at this location from March 1996 to present, and held a Series 9 license throughout the duration. The population density is 7,320 people per square mile. The approval of this license will not increase the total number of liquor licenses in this area. A microbrewery is a small brewery, generally producing fewer than 10,000 barrels of beer and ale a year and frequently selling its products on the premises. The Arizona State application (number 12076806) was submitted by Randy D. Nations. The 60-day deadline for processing this application is October 27, 2006. The location of the establishment will be 6915 North 95th Avenue and is within the Yucca District, zoned PAD (planned area development). This is a new application and a new location within Westgate City Center. There has never been a liquor license at this location. The population density is less than 1,370 people per square mile. The approval of this license will increase the total number of liquor licenses in this area by one. AWARD OF BID 06-51, NEIGHBORHOOD TRAFFIC MITIGATION DEVICES This is a request for City Council to approve the bid award to Swaine Asphalt Corporation to construct speed humps, speed cushions, and infill modified speed humps for the city's mitigation program in an amount not to exceed $70,185. This construction of neighborhood mitigation devices impacts the quality of life for Glendale residents by enhancing traffic safety to the traveling public. An invitation for bid (IFB) to construct neighborhood mitigation devices was advertised in August of 2006. Swaine Asphalt Corporation, while the only bidder, submitted a responsive bid that staff determined was acceptable. It is estimated that 1,000 linear feet, or approximately 28 speed humps, will be constructed this year. It is also estimated that 400 linear feet, or approximately 10 speed cushions, will be constructed this fiscal year as a part of a pilot test program. The terms of the contract will be for one year, with four one-year renewal options. The asphalt speed hump construction program is typically implemented twice a year. Some speed humps identified and not installed in the previous year's program will be completed in the fall of 2006. Additionally, staff has completed the neighborhood input and petition process to move forward with installation at newly identified locations. Furthermore, there are several pending neighborhood requests that will be added to the fall or spring construction program pending successful completion of the petition process. A pilot study to evaluate the effectiveness of speed cushions will also be implemented in coordination with the Fire Department for application on streets designated as primary response routes. In June of 2002, Council approved an amendment to IFB 02-01 with Swaine Asphalt Corporation to construct an additional 1,500 linear feet of speed humps. Speed humps are proven to be effective at reducing travel speeds. The quality of life improves for residents when excessive vehicular speeds on neighborhood roadways are reduced. The speed cushion pilot test program is aimed at testing new physical devices designed to reduce speeds on primary response routes with minimal effect on emergency response vehicles. Public input is the main component of the neighborhood mitigation program. Prior to constructing speed humps/cushions in a neighborhood, an informational public meeting is arranged by the city. Additionally, substantial support is required from the neighborhood, which is demonstrated through the implementation of a petition process. 8 The total cost for constructing and striping 1,000 linear feet of speed humps, 400 linear feet of speed cushions, and infilling three modified speed humps is $70,185. CONSENT RESOLUTIONS 6. REQUEST FOR INTERGOVERNMENTAL AGREEMENT WITH MARICOPA COUNTY FOR COURT SECURITY SERVICES This is a request for City Council to approve an intergovernmental agreement with Maricopa County Superior Court to provide security officers for City Court. Maricopa County Superior Court offers affordable, well-trained security staff to several limited jurisdiction courts. Maricopa County's security officers receive court specific security training, giving them the ability to initiate inter-agency alerts in emergency situations and make appropriate decisions in the best interest of the court and its customers. Glendale City Court has been utilizing Maricopa County's security services since 2002. These services are essential to the safety and security of city personnel and the public. Unless otherwise established by either party, this agreement shall remain in effect until June 30, 2007. Thereafter, the parties may renew this agreement for up to four additional one-year terms. The funds are provided in Court Security Professional Contractual. These funds are generated from the collection of Court Improvement Fees. Resolution No. 3990 New Series was read by number and title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF AN INTERGOVERNMENTAL AGREEMENT WITH THE MARICOPA COUNTY SUPERIOR COURT FOR SECURITY SERVICES AT THE GLENDALE CITY COURT. 7. INTERGOVERNMENTAL AGREEMENT WITH CITY OF PEORIA FOR DETENTION AND WEEKEND COURT SERVICES This is a request for City Council to renew an intergovernmental agreement (IGA) with the City of Peoria to provide detention and weekend court services for the Peoria Police Department. The Glendale Police Department has been providing detention and weekend court services to the Peoria Police Department since 1995. On average 40 Peoria inmates are processed each month and this does not overload or impact the capacity of the jail. In April of 2006, a review of services and costs was conducted which generated an increase in the per-day weekend court services costs. This cost increased from $50.30 to $55.22. The current $122.46 per inmate for detention services still adequately covers all detention related services. On August 22, 2006, the Peoria Council approved the renewal and authorized the Peoria City Manager to sign the IGA. Glendale has been providing these services to the City of Peoria since 1995. At the June 24, 2003 regular business meeting, the council renewed an IGA with the City of Peoria for detention and weekend court services, approving a rate increase at that time. The recommendation was to waive reading beyond the title and adopt a resolution authorizing the City Manager to enter into an intergovernmental agreement with the City of Peoria to provide detention and weekend court services to the Peoria Police Department. 10 Resolution No. 3991 New Series was read by number and title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF PEORIA TO PROVIDE DETENTION AND WEEKEND COURT SERVICES FOR THE CITY OF PEORIA POLICE DEPARTMENT. 8. INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF PHOENIX FOR FEDERAL TRANSIT ADMINISTRATION GRANT FUNDS This is a request for City Council to authorize the City Manager to enter into an intergovernmental agreement (IGA) with the City of Phoenix for acceptance of Federal Transportation Authority (FTA) funds for transit purposes. The IGA will allow Phoenix to reimburse Glendale for the federal portion of the Fiscal Year 2006-07 Dial-A-Ride maintenance expenses; reimbursement for the federal portion of the transit radio system; and construction funds for a park-and-ride lot. The purchases will be made under FTA Grant AZ-90-X074. One of the Council's goals is to provide high quality services for citizens. Improving and providing transportation options within the city will assist in achieving this goal. Phoenix has been designated as the regional recipient of FTA grants, and distributes the funds to cities in the metropolitan area. Past FTA grants have provided funds for transit improvements, including buses and shelters. This grant will provide citizens a convenient location to access Loop 101 to promote transit use and ridesharing, thereby helping to reduce traffic congestion. The grant provides 80% federal funds and requires 20% local matching funds. The federal funds will total $3,384,196 and the city's match will total $846,049 for a total of $4,230,245. The total amount to be allocated to the individual projects will be $3,524,045 for park-and-ride construction; $136,200 for transit vehicle maintenance expenses; and $570,000 for radio system cost reimbursement. The expenditures will be funded through FTA Grant AZ-90-X074. Resolution No. 3992 New Series was read by number and title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF AN INTERGOVERNMENTAL AGREEMENT (GRANT PASS-THROUGH AGREEMENT) WITH THE CITY OF PHOENIX FOR GRANT NO. AZ-90-X074 RELATING TO TRANSIT SERVICES. Mr. Leonard Clark, a Glendale resident, said he frequents the 7-11 store. He said the patrons and the people that work there are pleasant people. He has no problem with the Council's approval. He also stated that he is in totally agreement with the transportation being funded. He has recently had the opportunity to use the public transportation system and finds it more than adequate. He suggested more people should give it a try. He strongly supports both of these issues. It was moved by Eggleston, and seconded by Clark, to approve the recommended actions on Consent Agenda Item Nos. 1 through 8, including the approval and adoption of Resolution No. 3990 New Series, Resolution No. 3991 New Series, and Resolution No. 3992 New Series; and to forward Liquor License Application No. 3-1078 for 7-Eleven #16623E, Liquor License Application No. 3- 1079 for House of Spirits, Liquor License Application No. 3-1080 for Gordon Biersch Brewery Restaurant, and Liquor License Application No. 3-1081 for Gordon Biersch Brewery Restaurant to the State of Arizona Department of Liquor Licenses and Control, with the recommendation for approval. The motion carried unanimously. 12 PUBLIC HEARING — LAND DEVELOPMENT ACTIONS 9. GENERAL PLAN AMENDMENT GPA05-12 AND REZONING APPLICATION ZON05-22: PARADISE ENCLAVE - 6830 WEST PARADISE LANE Mr. Jon Froke, AICP, Planning Director, presented this item. This is a request by DeMore Development, LLC for approval of a General Plan Amendment to change the land use designation from MHDR (Medium-High Density Residential, 8-12 dwelling units per acre) to MDR (Medium Density Residential 3.5-5 du/ac) and to rezone from A-1 (Agricultural) to R1-4 PRD (Single-Residence, Planned Residential Development) for property located at 6830 West Paradise Lane. The proposed land use designation is compatible with the Medium Density Residential designation of surrounding parcels. The R1-4 PRD zoning adds to the city's housing stock and provides housing diversity. The development incorporates sound growth management techniques by utilizing surrounding infrastructure. Paradise Enclave consists of 21 lots on 4.75 acres, at a density of 4.4 dwelling units per gross acre. Lot sizes vary from 4,011 square feet to 8,098 square feet with an average lot size of 4,768 square feet. The minimum lot width is 40 feet and the minimum lot depth is 80 feet. The Planning Commission recommended approval of this General Plan Amendment and rezoning application on August 17, 2006. The project promotes the development of vacant property and provides housing on an in-fill site that is compatible with the surrounding area. Notification letters were sent to 116 property owners and interested parties on May 9, 2005. No written responses were received from the mailing. There were four telephone calls to staff and five calls to the applicant. The callers voiced opinions including: support of the request, opposition to any land use change, opposition to the subdivision entrance being located on 69th Avenue, a desire for fewer lots, and concern with increased traffic and traffic speeds. Due to the number and nature of issues raised from the notification letter, a neighborhood meeting was held on June 8, 2005. Of the 116 people invited to the neighborhood meeting, 14 property owners and interested parties attended. Issues discussed included the location of the subdivision entrance (some in support of an entrance off of 69th Avenue and some opposed), design of house product, and side yard building setbacks. Both the applicant and city project team determined that access to the subdivision on 69th Avenue is appropriate. 13 The recommendation was to conduct a public hearing, waive reading beyond the titles, and adopt the resolution for General Plan Amendment GPA05-12 and the ordinance for rezoning application ZON05-22, subject to the stipulations as recommended by the Planning Commission. Mr. Rick Andiotos, applicant representative, stated that they have been working closely with staff and believe this will be an asset to the community. Mayor Scruggs opened the public hearing on Agenda Item No. 9. As there were no comments, Mayor Scruggs closed the public hearing. Resolution No. 3993 New Series was read by number and title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING THE GENERAL PLAN MAP OF THE CITY OF GLENDALE, ARIZONA, BY APPROVING GENERAL PLAN AMENDMENT GPA05-12 FOR PROPERTY LOCATED AT 6830 WEST PARADISE LANE. It was moved by Frate, and seconded by Martinez, to pass, adopt and approve Resolution No. 3993 New Series. The motion carried unanimously. Ordinance No. 2530 New Series was read by number and title only, it being AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, REZONING PROPERTY FROM A-1 (AGRICULTURAL) TO R1-4 PRD (SINGLE RESIDENCE, PLANNED RESIDENTIAL DEVELOPMENT), AMENDING THE ZONING MAP; AND PROVIDING FOR AN EFFECTIVE DATE. It was moved by Frate, and seconded by Martinez, to approve Ordinance No. 2530 New Series. Motion carried on a roll call vote, with the following Councilmembers voting "aye": Clark, Goulet, Lieberman, Eggleston, Martinez, Frate, and Scruggs. Members voting "nay": none. REQUEST FOR FUTURE WORKSHOP AND EXECUTIVE SESSION It was moved by Eggleston, and seconded by Martinez, to hold a City Council Workshop at 1:30 p.m. on Tuesday, October 17, 2006 in Room B-3 of the City Council Chambers, to be followed by an Executive Session pursuant to A.R.S. 38-431.03. The motion carried unanimously. CITIZEN COMMENTS Mr. Leonard Clark, a Glendale resident, thanked both the Sine Family and the Salvation Army for their contribution to the city. He stated that on a different matter, he believes that the Phoenix tours of older cemeteries are an excellent idea because of the history they hold. He suggested possibly having something like it in Glendale. Mayor Scruggs said she had passed along his suggestion and thinks it might be something of interest. She said someone would be in touch with him. 14 COUNCIL COMMENTS AND SUGGESTIONS Councilmember Clark stated that on October the 26, 2006 they will hold a district meeting focusing on present social services and assistance that the city provides or has access to for residents in the immediate area. Councilmember Goulet stated he would be meeting with the Glendale High School administration and graduates to plan a fundraiser. He added that they will be reaching out to the community for assistance. Councilmember Lieberman announced that this Saturday night was GAIN night. He explained the concept of GAIN night. He also thanked the Sine family for their contributions to the community. Councilmember Martinez discussed some of the Sine family contributions. He also announced a neighborhood meeting October 18, 2006 at 6:00 p.m. at the Foothills Library. Councilmember Frate stated that he would be attending the different meetings being held for GAIN night. He said it is a great opportunity to make new friends and meet your neighbors. He also announced that the Glendale Police Department is recruiting and testing this Saturday. He said they will be testing at Cactus High School.
