Dear Mr. Paladini :
This refers to the procedures for conducting the May 17,
2005, special referendum and charter amendment election; the
joint election procedures with the Glendale Union High School
District; and the polling place changes for the City of Glendale
in Maricopa County, Arizona, submitted to the Attorney General
pursuant to Section 5 of the Voting Rights Act, 42 U. S . C. 1973c.
We received your submission on February 9, 2005 .
The Attorney General does not interpose any objection to the
specified changes . However, we note that Section 5 expressly
provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the
changes . Procedures for the Administration of Section 5 of the
Voting Rights Act (28 C.F.R. 51 . 41) .
0 Section 5 review is required for any chance affecting voting
(e .g. , the change in general election date) which is adopted as a
result of the special election. See 28 C.F.R. 51 . 15 .

City of Glendale,Arizona—2005 Special Election
Dear Sir or Madam:
This letter, including the attachments (Exhibits A through C) constitutes Glendale's
submission for your review under Section 5 of the Voting Rights Act.
A City of Glendale Special Election was held on May 17, 2005 to determine whether the
Glendale City Charter should be amended to move the primary and general election
dates from March and May in even numbered years to September and November
respectively. The proposed charter amendment passed by a vote of 5733 to 1166.
Under Section 5, the charter amendment constitutes a change in practice or procedure
affecting voting and thus requires preclearance prior to its enactment.
A copy of the ballot is attached as Exhibit A. A copy of the certified election results is
attached as Exhibit B. If precleared by the DOJ, the charter amendment will first take
effect during the 2006 election cycle (i.e. rather than a March primary and November
general election, the primary election date is moved to September 2006 and the general
election date is moved to November 2006).
Pre-Clearance for May 17, 2005 Special Election
On February 7, 2005, Glendale submitted a Section 5 preclearance request to the
Department of Justice. A copy of U.S. Justice Department letter dated March 31, 2005
stating no objection is included as Exhibit C.

Sec. 10. Induction of mayor and council members into office
At 7:00 p.m. on the day set for the first regularly scheduled meeting in December
following the general election, the council shall hold a meeting for the purpose of
inducting the newly elected mayor and council members, and to organize the
council.
DESCRIPTIVE SUMMARY
A YES vote will move the City's primary and general elections dates and associated term
commencements and inductions to be consistent with Maricopa County, State, and
Federal election dates, which are held in September, for primary elections, and
November, for general elections.
A NO vote will continue Charter language providing that the primary election be held in
even years on the second Tuesday in March and the general election on the third Tuesday
in May in even years and associated term commencements and inductions will remain the
same.

A RESOLUTION OF THE COUNCIL OF THE CITY
OF GLENDALE, MARICOPA COUNTY, ARIZONA,
DECLARING AND ADOPTING THE RESULTS OF
THE SPECIAL ELECTION HELD ON MAY 17, 2005;
AND ORDERING THAT A CERTIFIED COPY OF
THIS RESOLUTION BE RECORDED.
WHEREAS, the City Council of the City of Glendale, Maricopa County,
Arizona, by Resolution No. 3841, New Series, adopted on the 12th day of April,
2005, caused a notice to be submitted to the qualified electors of the City of
Glendale (the "City") of a Special Election called and held in and for the City on
the 17th day of May, 2005 for the consideration of three proposals designated as
Proposition 101, Proposition 102 and Proposition 103; and
WHEREAS, the City Council caused notice of the Special Election to be
provided by the City Clerk by publishing notice thereof in the Glendale Star
newspaper, which is published in and has general circulation within the City. The
notice as published, specified the polling places where the election was to be
held; plus, the candidates and propositions to be voted upon. A copy of the
notice, with the affidavit of publication attached thereto, is on file and a part of the
official records of the City of Glendale; and
WHEREAS, the election returns have been presented to and have been
canvassed by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF GLENDALE as follows:

SECTION 1. The total number of ballots cast at the Special Election, as
shown by the cumulative report of polling places, with the addition of provisional
ballots and early ballots processed, was 6,635.
SECTION 2. The total number of early ballots cast at the Special Election
was 5,025. Of these, 0 early ballots were found to be invalid.
SECTION 3. The total number of provisional ballots received was 48. Of
these, 13 provisional ballots were found to be invalid.

SECTION 5. It is hereby found, determined, and declared of record, that
Proposition 101 did receive more than one-half and the highest total number of
valid votes cast; and that said move of the City's election dates to September for
primary and November for general and associated term inductions and
commencements is carried.
SECTION 6. It is hereby found, determined, and declared of record, that
Proposition 102 did receive more than one-half and the highest total number of
valid votes cast; and that said franchise agreement with Southwest Gas is
carried.
SECTION 7. It is hereby found, determined, and declared of record, that
Proposition 103 did receive more than one-half and the highest total number of
valid votes cast; and that said franchise agreement with Arizona Public Service is
carried.
SECTION 8. Exhibits A through D attached to this resolution include a
detailed canvass of vote for the May 17, 2005 Special Election.
SECTION 9. The City Clerk is hereby instructed and authorized to
forward a certified copy of this resolution for recording to the Maricopa County
Recorder's Office.
PASSED, ADOPTED AND APPROVED by the Mayor and Council of the
City of Glendale, Maricopa County, Arizona, this 24th day of May, 2005.

The Attorney General does not interpose any objection to the specified changes. However,
