Street, N.W., Room 7254 Washington, DC 20006 Re: Submission Under Section 5 of the Voting Rights Act City of Glendale,Arizona — Special Election, November 5, 2002 Dear Sir or Madam: Please find enclosed a copy of Resolution No. 3587, New Series (Appendix A) ordering the holding of a Special Election in the City of Glendale to be held on November 5, 2002 to submit Proposition No. 403 to the voters. Proposition 403 requests that the voters ratify Glendale 2025: The General Plan for the City of Glendale. Also enclosed is a copy of Resolution No, 3578, New Series, (Appendix B) which adopts Glendale 2025: The Next Step as a policy pursuant to A.R.S. 9-461, et. seq. A copy of Arizona State Statutes A.R.S. 9-461 et. seq. (Appendix "C") is also enclosed. Pursuant to the Maricopa County Elections Department, Service Menu — Jurisdictions and the attached City of Glendale Addendum thereto (Appendix D), the City of Glendale Special Election will be conducted in conjunction with Maricopa County's General Election to be held on November 5, 2oo2. The Service Agreement and Addendum provide for the Maricopa County Elections Department to furnish the polling places, election officials, and other services. There will be sixty-six Maricopa County voting precincts in the City of Glendale. The Maricopa County Elections Department will pre- clear these polling places with the Department of Justice. These precincts are the same precincts that will be used for the statewide General Election to be held at the same time as the City of Glendale Special Election on November 5, 2002. Attached for your information is a list of Maricopa County polling places in the City of Glendale for the November 5, 2002 General Election/Special Election and a list of the City of Glendale Polling Places in the May 21, 2002 General Election (Appendix E). The City of Glendale had twenty-three polling places in its last City General Election held on May 21, 2002. In city elections, multiple precincts can be combined at one polling place. United States Department of Justice Submission Under Section 5 of the Voting Rights Act City of Glendale,Arizona — Special Election, November 5, 2002 August 6, 2002 - Page 2 Maricopa County's General Election Ballot will contain the City of Glendale's Proposition 403 and the Maricopa County Elections Department will tabulate the election results. The City, as required by law, will send an informational pamphlet to each household containing a registered voter. As required, the pamphlet will indicate the location of each polling place, a summary of Proposition 403, and the ballot language in both English and Spanish. Per the City's request, the Maricopa County Elections Department will provide Spanish speaking voting precinct officials in as many precincts as possible, but specifically in the Ocotillo District. Based on the most recent census, the Ocotillo District is the City's predominately minority district. All voting precincts will have Spanish translators available by telephone. Enclosed are the copies of the following pertaining to recent City of Glendale annexations (Appendix F): Ordinance No. 2236, New Series, pertaining to Annexation No. 138 and cover letter to the Civil Rights Division of the Justice Department dated March 26, 2002. Ordinance No. 2261, New Series, pertaining to Annexation No. 139 and cover letter to the Civil Rights Division of the Justice Department dated July 26, 2002. Ordinance No. 2262, New Series, pertaining to Annexation No. 140 and cover letter to the Civil Rights Division of the Justice Department dated July 26, 2002 Ordinance No. 2263, New Series, pertaining to Annexation No. 141 and cover letter to the Civil Rights Division of the Justice Department dated July 26, 2002. These materials are being submitted to the Department of Justice for pre-clearance under Section 5 of the Voting Rights Act, as amended. The citizens of the City of Glendale hereby adopt the City of Glendale General Plan, Glendale 2025: The Next Step, in its entirety as herein generally described: GENERAL PLAN INTRODUCTION The Glendale 2025: The Next Step document contains prefatory and explanatory materials intended to facilitate the use and understanding of the City's General Plan. SEQ., ESTABLISHING PLANNING GOALS, OBJECTIVES AND POLICIES; AND CONSIDERING EACH OF THE PLAN ELEMENTS REQUIRED BY STATUTE AS WELL AS OTHERS DETERMINED ESSENTIAL BY THE CITY. - WHEREAS, the City intends to establish policies for preserving quality living conditions, enhancing business opportunities, and fostering desired community growth in ways that are consistent with its citizens' values; and WHEREAS, an open public participation process has provided direction for Glendale's future derived from the ideas, commentary, priorities, preferences, review and suggestions offered by residents, business people, civic organizations and representatives of local institutions; and WHEREAS, the General Plan serves as a framework for municipal preparedness planning that embraces more specific functional and geographical area plans that have been or are being prepared; and WHEREAS, the City wishes to be in full compliance with the State of Arizona "Growing Smarter/Plus" legislation requirements; and • WHEREAS, advisory comments pertaining to the General Plan document have been sought from those agencies and jurisdictions specified by A.R.S. §9-461.06(C) to be included in the sixty-day statutory review period and the written comments and public hearing testimony received pursuant to such required review have been duly considered; and WHEREAS, the General Plan; Glendale 2025: The Next Step, was presented at public hearings conducted by the Glendale Planning Commission at three different locations in the City ' of Glendale on February 21, 2002; March 7, 2002 and March 21, 2002 and forwarded to the City Council with unanimous recommendation for approval of Glendale 2025 together with recommended text and land use map amendments derived from the sixty-day review period and public testimony; and WHEREAS, the Glendale City Council, in consideration of the Planning Commission recommendation of approval, with text and land use map amendments, and further public testimony obtained at the May 28, 2002 City Council public hearing, has directed such additional amendments and refinements to the General Plan as it deems necessary; and 1 WHEREAS, A.R.S. §9-461.06 requires that a general plan adopted pursuant to statute be submitted to the voters of the city for ratification at the next available election date. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: SECTION 1. ADOPTION OF GLENDALE 2025 That the City of Glendale hereby adopts the City of Glendale General Plan, Glendale 2025: The Next Step, in its entirety as herein generally described: The planning process, from which the General Plan documents derive, was citizen-driven in determining the content and desired direction for conserving, developing, utilizing and enjoying the physical characteristics of the City of Glendale. CITIZEN PARTICIPATION The City Council adopted, by Resolution No. 3478 (New Series) on June 26, 2001, a citizen participation plan to ensure an open process for community residents to become actively involved in the preparation of the General Plan. Among the activities enumerated to fulfill requirements of Arizona Revised Statutes §9-461.06 (B)(1) for citizen input were the following: regular meetings with a Public Focus Group, area meetings, community workshops, briefings to Boards and Commissions and civic events. Communications methods, planning coordination with other jurisdictions and agencies, incorporation of public planning studies and community outreach efforts were also utilized to achieve a General Plan with a strong foundation of grassroots values and opinions. AN ORDINANCE OF THE COUNCIL OF THE CITY OF 2i GLENDALE, MARICOPA COUNTY, ARIZONA, EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF GLENDALE, MARICOPA COUNTY, STATE OF ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, SECTION 9-471, ARIZONA REVISED STATUTES AND AMENDMENTS THERETO, BY ANNEXING THERETO CERTAIN TERRITORY CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY OF GLENDALE TO BE KNOWN AS ANNEXATION AREA NO. 141. WHEREAS, the City of Glendale on March 27, 2002 filed in the Maricopa County Recorder's Office a blank petition requesting annexation and setting forth a description and an accurate map of all the exterior boundaries of the territory contiguous to the City proposed to be annexed; WHEREAS, after filing the blank petition, the City of Glendale held a public hearing on April 23, 2002 to discuss the annexation proposal. The public hearing was held in accordance with applicable state law; WHEREAS, signatures on petitions filed for annexation were not obtained for a waiting period of thirty (30) days after the filing of the blank petition; WHEREAS, within one year after the last day of the thirty (30) day waiting period, a petition in writing was circulated and signed by the owners of one=half or more in value of the real and personal property and more than one-half of the persons owning real and personal property that would be subject to taxation by the City of Glendale in the event of annexation, as shown by the last assessment of the property, and filed in the office of the Maricopa County Recorder's Office on June 19, 2002; WHEREAS, no alterations increasing or reducing the territory sought to be annexed were made after the petition had been signed by a property owner; WHEREAS, all information contained in the filings, the notices, the petition, tax and property rolls and other matters regarding a proposed or final annexation were made available by the Clerk of the City of Glendale for public inspection during regular business hours; and WHEREAS, the Mayor and Council of the City of Glendale, Arizona are desirous of complying with said petitions and extending and increasing the corporate limits of the City of Glendale to include said territory.
