OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA,
HELD TUESDAY, JUNE 4, 2002, AT 1:30 P.M.
The meeting was called to order by Mayor Elaine M. Scruggs, with Vice Mayor
Thomas R. Eggleston and the following Councilmembers present: Joyce V. Clark,
Steven E. Frate, David M. Goulet, and Manuel D. Martinez. Councilmember H. Philip
Lieberman was absent.
Also present were Ed Beasley, City Manager; Terry Zerkle, Assistant City
Manager; Rick Flaaen, City Attorney; and Pamela Oliveira, City Clerk.
COMPLIANCE WITH ARTICLE VII, SECTION 6(c) OF THE GLENDALE CHARTER
A statement was filed by the City Clerk that the two resolutions to be considered
at the meeting were available for public examination and the title posted at City Hall
more than 72 hours in advance of the meeting.
Ms. Pam Oliveira, City Clerk, read Agenda Item Numbers 1 and 2 by number and
title.
CONSENT RESOLUTIONS
Councilmember Clark requested that Agenda Item Nos. 1 and 2 be heard
separately.
1. RESOLUTION FOR ADOPTION OF THE WESTERN AREA GENERAL PLAN
AMENDMENT APPLICATION NO. GP-00-04
The Western Area General Plan Amendment, Application No. GP-00-04, was
presented at the May 14, 2002 City Council meeting. At that time, the City Council
conducted a public hearing on the proposed amendment to obtain further public
testimony. After consideration of the public testimony, the City Council voted to approve
the Western Area General Plan Update.
The resolution for adoption of the Western Area General Plan Update,
Application No. GP-00-04, as an amendment to the 1989 General Plan, was presented
for City Council action.
The recommendation was to waive reading beyond the title and adopt a
resolution adopting the Western Area General Plan Update, Application No. GP-00-04,
as an amendment to the 1989 General Plan.

Resolution No. 3580 New Series was read by number and title only, it being A
RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA
COUNTY, ARIZONA, APPROVING A GENERAL PLAN AMENDMENT FOR THE
AREA BOUNDED BY 83RD AVENUE ON THE EAST, 115TH AVENUE ON THE WEST,
NORTHERN AVENUE ON THE NORTH AND CAMELBACK ROAD ON THE SOUTH,
BY AMENDING THE 1989 GENERAL PLAN WITH THE AMENDMENT KNOW AS
THE WESTERN AREA GENERAL PLAN UPDATE.
Councilmember Clark asked Mr. Flaaen to clarify why the Western Area General
Plan was being adopted as a resolution to amend the 1989 General Plan rather than as
a portion of the Glendale 2025 Plan. Mr. Flaaen explained that the process started as a
Council-initiated amendment to the 1989 General Plan and has been continuously
posted and noticed to the public as such. He said, as a result, the Council has to
proceed with it as an amendment to the plan as opposed to a portion of the Glendale
2025 Plan. He confirmed for Councilmember Clark that the Western Area General Plan
amendment would become part of the Glendale 2025 Plan if the Glendale 2025 Plan is
approved by the voters in November of 2002. He said, if the Glendale 2025 Plan was
not approved, the 1989 plan and all amendments thereto would continue to be in effect.
Councilmember Clark said she did not support the Western Area General Plan,
although she supported many elements of the plan. She stated that she was
disappointed in how the issue of apartments and large-lot development have been
handled.
Mayor Scruggs read an excerpt from an e-mail she received, signed by Kevin
and Jane Plesinger, Michael and Nancy Howard, John and Julia Kology, Robert
Hamilton, Terry and Cynthia Lane, Mary Jean Eggleston, James and Janet Nesbitt,
Kelly Barkley, Missy Schreiber, Bill Cromack, Robert and Sherry Hall, Mike and Karen
Griner, Rebecca Truillo, and Paul and Alice Miller. The e-mail indicated the authors'
acceptance of the Council's passage of the Western Area General Plan and stated that
they would address their concerns at zoning and Planned Area Development (PAD)
hearings.
Mr. Flaaen confirmed for Vice Mayor Eggleston that the Council initiated the
Western Area General Plan Amendment in 1999, prior to the Glendale 2025 General
Plan project which was initiated in May of 2001. Vice Mayor Eggleston thanked
residents in the area for their interest.
Councilmember Martinez said he supported the plan. He pointed out a process
for making future changes is in place.
Councilmember Goulet expressed his opinion, in response to Councilmember
Clark's previous comments, that it would be unfair to exclude a given area (such as the
Western Area) from development. He said they have a good plan and the
recommendations are the best that can be made at this time.

It was moved by Eggleston, and seconded by Goulet, to pass, adopt and
approve Resolution No. 3580 New Series.
Councilmember Clark said residents in the western area of Glendale are not
opposed to development and know it is coming. She explained that their concern is
with the development of 2,000 to 3,000 additional apartment units in the district. She
pointed out that several apartment complexes already exist. She said a majority of the
people who rent apartments are transient by nature and make no commitment to the
community. With regard to Councilmember Goulet's comment regarding exclusivity,
she pointed out that the plan denies homeowners who desire large lots an opportunity
to live in west Glendale. She noted that 83rd Avenue has historically been a corridor of
large-lot development. She stated that the residents want that kind of development to
be preserved and maintained.
Mayor Scruggs said the issue was whether this was the appropriate place to
address such issues. She stated that a general plan, by definition, does not deal with
specifics. She pointed out that the area Councilmember Clark and other residents
would like designated for large lot development is already zoned and the property owner
is not willing to change the zoning. She said the 14 households that signed the e-mail
were also those who circulated the petitions on the two amendments. She said, while
they were not happy, they would accept the plan and voice their concerns at zoning and
planned area development hearings. She stressed the fact that adoption of the General
Plan does not create any apartments or multi-family housing, but merely indicates how
the area would best be developed.
Upon a call for the question, the motion carried, with Clark voting "nay".
2. CANVASS OF VOTES AND RESOLUTION ADOPTING RESULTS OF THE
MAY 21 , 2002 GENERAL ELECTION
A.R.S. 16-642 states that "the governing body holding an election shall canvass
the election not less than six days nor more than fifteen days following the election".
The City of Glendale Primary Election was held on Tuesday, May 21, 2002.
The purpose of "canvassing" of the votes is to permit the members of the Council
to review and approve the election results. These results, which include all polling place
returns, early ballots, and the ballots to be verified, constitute the official canvass when
approved by the City Council and certified by the City Clerk.
The recommendation was to waive reading beyond the title and adopt a
resolution accepting the canvass of votes of the General Election held in the City of
Glendale on Tuesday, May 21, 2002.

Resolution No. 3581 New Series was read by number and title only, it being A
RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA
COUNTY, ARIZONA, DECLARING AND ADOPTING THE RESULTS OF THE
GENERAL ELECTION HELD ON MAY 21, 2002; AND ORDERING THAT A
CERTIFIED COPY OF THIS RESOLUTION BE RECORDED.
It was moved by Eggleston, and seconded by Frate, to pass, adopt and
approve Resolution No. 3581 New Series. The motion carried unanimously.
REQUEST TO EXCUSE COUNCILMEMBER LIEBERMAN
It was moved by Eggleston, and seconded by Frate, to excuse
Councilmember Lieberman from tonight's meeting. The motion carried
unanimously.
