OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA,
HELD TUESDAY, OCTOBER 9, 2001, AT 7:00 P.M.
The meeting was called to order by Mayor Elaine M. Scruggs, with Vice Mayor
Thomas R. Eggleston and the following Councilmembers present: Joyce V. Clark,
Steven E. Frate, David M. Goulet, H. Philip Lieberman, and Manuel D. Martinez.
Also present were Ed Beasley, Assistant City Manager; Rick Flaaen, City
Attorney; and Pamela Oliveira, City Clerk.
COMPLIANCE WITH ARTICLE VII, SECTION 6(c) OF THE GLENDALE CHARTER
A statement was filed by the City Clerk that the three ordinances to be
considered at the meeting were available for public examination and the title posted at
City Hall more than 72 hours in advance of the meeting.
Mayor Scruggs introduced Mr. Garrett Simpson, Scout Master of Troop 254;
scout leaders Lani Duberry and Jurgen Irkirt; and the following boy scouts who were
present at the meeting: John Glen, Tom Duberry, Nick Grissom, Andrew Bendel!,
Andrew Simpson, Niky Duberry, Mitchell Irkirt, Zack Hayhurst, Josh Carpenter, Brandon
Corcoran.
APPROVAL OF THE MINUTES OF THE SEPTEMBER 25, 2001 COUNCIL MEETING
It was moved by Goulet, and seconded by Clark, to dispense with the
reading of the minutes of the Regular Council Meeting held on September 25,
2001, as each member of the Council had been provided copies in advance, and
approve them as revised. The motion carried unanimously.

TELECOMMUNICATOR OF THE YEAR
September 11 , 2001 is recognized by the State of Arizona as National "9-1-1
Day". Every year Public Safety agencies throughout the State send in nominations for
the 9-1-1 Telecommunicator of the Year. This year, Communications Specialist, Ms.
Loretta Hadlock, who was nominated by Ms. Martha Henderson, Communications
Supervisor, was selected as the recipient of this outstanding award. Ms. Hadlock was
nominated for her ability to take the extra steps to research calls for service in order to
help citizens the best way she can. This year, Ms. Hadlock may have saved a man's
life. The man called on 9-1-1 from a cell phone; he was incoherent and difficult to
understand. Currently there is no method for tracking cellular phone calls. Ms. Hadlock
somehow managed to obtain a possible location and had medical units dispatched to

check the area. Paramedics located the individual in the area; he was in diabetic
shock, almost comatose with the phone still in his hand.
Ms. Hadlock was due to receive her award at the State Capital on September 11,
2001; however with the catastrophe of the attacks in New York and in Washington,
D.C., the celebration ceremony in which Ms. Hadlock was to receive her award was
cancelled.
The Police Department wished take this opportunity to honor Ms. Hadlock and
allow officials from the State Department of Administration and the Arizona Chapter of
the National Emergency Number Association this opportunity to present Ms. Hadlock
with her well-deserved award.
Ms. Barbara Jaeger, State of Arizona Department of Administration 9-1-1
Coordinator, and Ms. Susan MacFarlane, Maricopa County 9-1-1 Administrator,
representing the Arizona Chapter of the National Emergency Number Association,
presented Ms. Loretta Hadlock, City of Glendale Communications Specialist, with a
plaque for her accomplishment of being recognized by the State of Arizona as the 9-1-1
Telecommunicator of the Year.
Ms. Hadlock thanked her supervisor, Ms. Martha Henderson, Communications
Supervisor, and Ms. Terry Alexander, Communications Specialist, for their nomination.
CONSENT AGENDA
Mr. Ed Beasley, Assistant City Manager, read Consent Agenda Item No. 1 by
number and title.
1. FINAL PLAT APPLICATION P-00-01: 8302 WEST MISSOURI AVENUE
This was a request by Clouse Engineering, Inc. for final plat approval for a
subdivision titled "Missouri Ranch". The site is located at the northwest corner of 83rd
Avenue and Missouri Avenue.
The subdivision includes 63 single family lots on 40.1 acres, at a density of 1.6
dwelling units per gross acre. Lot sizes vary from 17,007 square feet to 34,911 square
feet, with an average lot size of 19,325 square feet. The proposed minimum lot width is
110 feet and the minimum lot depth is 130 feet.
The final plat is in conformance with the existing SR-17 (Suburban Residence)
zoning district and the preliminary plat approved by the Planning Commission on May 4,
2000. All stipulations of the preliminary plat have been satisfied.
The recommendation was to approve Final Plat Application P-00-01.

It was moved by Lieberman, and seconded by Clark, to approve Final Plat
Application P-00-01. The motion carried unanimously.
LAND DEVELOPMENT ACTIONS - PUBLIC HEARING
2. REZONING APPLICATION Z-01-09: 5604 NORTH 67TH AVENUE
Ms. Teresa Halverson, Planner, presented this application by the Planning
Commission to rezone a 2.1-acre property from C-1 (Neighborhood Commercial) to C-2
(General Commercial). The site is located at the southwest corner of 67th and
Montebello Avenues. The property consists of two parcels. The south parcel has a
craft store with a single-family residence on it. The north parcel is vacant.
The property was zoned C-1 (Neighborhood Commercial) in 1979 (Z-79-32).
From 1979 to 1994, the City's zoning map showed the property as C-1 . After late 1994,
the map incorrectly showed the property as C-2.
Both of the zoning districts are consistent with the General Plan designation of
General Commercial. Similar uses are found in both C-1 and C-2, with the C-2 uses
being more intense. A more significant difference is in the uses that require a
Conditional Use Permit. Automotive uses, thrift stores, live entertainment in bars, and
self-storage warehouses are some uses that are permitted in the C-2 zoning district
with a Conditional Use Permit. The Conditional Use Permit does require additional
neighborhood notification and public hearings to allow further scrutiny for those uses.
At its hearing held on September 20, 2001, the Planning Commission
recommended approval of Rezoning Application Z-01-09 subject to two stipulations.
The stipulations require dedication of half-width right-of-way on 67th Avenue and that all
half-street improvements on 67th and Montebello Avenues be constructed. No one
other than the property owner spoke at the hearing.
The recommendation was to conduct a public hearing and approve Rezoning
Application Z-01-09, subject to the two stipulations recommended by the Planning
Commission.
Mayor Scruggs opened the public hearing on Agenda Item No. 2.
Mr. Leonard Clark, a resident of the City of Glendale Barrel District,
commented on the beauty of the residence. He expressed his concern about possible
uses and cautioned residents of the neighborhood to look at all posted zoning signs.
Mayor Scruggs closed the public hearing.
It was moved by Lieberman, and seconded by Clark, to approve Rezoning
Application Z-01-09, subject to the two stipulations recommended by the
Planning Commission. The motion carried unanimously.

ORDINANCES
3. ABANDONMENT OF AN EASEMENT AT 67TH AVENUE SOUTH OF PINNACLE
PEAK ROAD
Mr. Larry Broyles, City Engineer, presented this request to abandon an existing
twenty-five foot public utility easement located between Parkside Lane and Pinnacle
Peak Road, east of 67th Avenue. The owner has requested this abandonment due to
the terrain and the inability to install utilities within this area.
No objections to the abandonment have been received by any department within
the City of Glendale, nor from any outside utility company. There are no facilities
located within this area.
There are no costs associated with this abandonment.
The recommendation was to waive reading beyond the title and adopt an
ordinance abandoning this easement.
Ordinance No. 2218 New Series was read by number and title only, it being AN
ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA
COUNTY, ARIZONA, AUTHORIZING THE ABANDONMENT OF A PORTION OF AN
EASEMENT AT 67TH AVENUE SOUTH OF PINNACLE PEAK ROAD TO THE
OWNERS OF RECORD OF THE ABUTTING PROPERTY; AND DIRECTING THE
CITY CLERK TO RECORD A CERTIFIED COPY OF THIS ORDINANCE.
It was moved by Clark, and seconded by Frate, to approve Ordinance No.
2218 New Series. Motion carried on a roll call vote, with the following members
voting "aye": Clark, Goulet, Lieberman, Eggleston, Martinez, Frate, and Scruggs.
Members voting "nay": none.
4. ABANDONMENT OF RIGHT OF WAY LOCATED BETWEEN 69TH AND D 67TH
AVENUES SOUTH OF MARYLAND
Mr. Larry Broyles, City Engineer, presented this item. The owner of the property
located between 67th and 69th Avenues, south of Maryland Avenue, has requested an
abandonment of right of way. At this time, the surrounding area is in development and
this existing right of way will no longer be needed. In consideration for this
abandonment, the property owner has agreed to dedicate an area of right-of-way the
City has requested for Romero Estates, an adjacent development.
There are no other property owners or utilities involved in the abandonment of
this property. There are no costs associated with this abandonment.

The recommendation was to waive reading beyond the title and adopt an
ordinance abandoning the existing right-of-way subject to dedication of required
easements.

CITY CLERK TO RECORD A CERTIFIED COPY OF THIS ORDINANCE.
It was moved by Goulet, and seconded by Clark, to approve Ordinance No.
2219 New Series. Motion carried on a roll call vote, with the following members
voting "aye": Clark, Goulet, Lieberman, Eggleston, Martinez, Frate, and Scruggs.

5. IMPACT FEE ORDINANCE
Mr. Tim Ernster, Deputy City Manager, presented this item. Impact fees are one-
time charges to developers that are used to offset the costs of Capital Improvement
projects necessary for new development. In 1994, the City of Glendale undertook an
impact fee study that was completed and implemented on February 1 , 1997. Again in
1999, the City undertook an impact fee study that was completed and implemented on
September 25, 2000.
On June 5, 2001, the City Council reviewed the recommendations of the
consultant and directed staff to bring the new ordinance forward for adoption. Arizona
State Law requires that prior to increasing impact fees the City follow several required
steps. On July 24, 2001, the City passed a resolution stating the City's intent to
increase impact fees, which completed the first step. The City published a notice in the
Glendale Star setting the date for the public hearing on September 11, 2001, which
completed the second step. However, the City Council meeting was cancelled and all
items were continued to the September 25, 2001 Council meeting. The City held a
public hearing on September 25, 2001, completing the third step. An ordinance
changing the fees, is the fourth and final step in the process.
Staff has been notifying developers of the increase in fees for several months in
each pre-application and application meeting. Staff also provided copies of the study to
the HomeBuilders Association of Central Arizona, the Arizona Multifamily Housing
Association, and the Valley Partnership for review and comment.
The recommendation was to waive reading beyond title and adopt an ordinance
making the effective date of the new rates January 10, 2002.
Mayor Scruggs opened the public hearing on Agenda Item No. 5.

Mr. Leonard Clark, a resident of the City of Glendale Barrel District, voiced
his support of the impact fee ordinance. He asked the Council to ensure that the
money is used for its intended purpose.
Mayor Scruggs closed the public hearing.
Ordinance No. 2220 New Series was read by number and title only, it being AN
ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA
COUNTY, ARIZONA, AMENDING GLENDALE CITY CODE CHAPTER 28, ARTICLE
VI, ENTITLED "DEVELOPMENT IMPACT FEES"; AND ESTABLISHING AN
EFFECTIVE DATE.
It was moved by Lieberman, and seconded by Frate, to approve Ordinance
No. 2220 New Series. Motion carried on a roll call vote, with the following
members voting "aye": Clark, Goulet, Lieberman, Eggleston, Martinez, Frate, and
Scruggs. Members voting "nay": none.
REQUEST FOR FUTURE WORKSHOP AND EXECUTIVE SESSION
It was moved by Eggleston, and seconded by Martinez, to hold a City
Council Workshop at 1:30 p.m. in Room B-3 of the City Council Chambers on
Tuesday, October 16, 2001 to be followed by an executive session pursuant to
ARS 38-431.03; to vacate the regularly scheduled City Council meeting on
Tuesday, October 23, 2001; and to hold a City Council meeting at 7:00 p.m. in the
City Council Chambers on Tuesday, October 30, 2001. The motion carried
unanimously.
CITIZEN COMMENTS
Mr. Leonard Clark, a resident of the City of Glendale Barrel District,
expressed his appreciation for the ability to speak before the Council. He thanked all
Glendale citizens who are serving in the armed forces or have done so in the past. He
expressed his concern about the financial difficulties many military families will face. He
commented on young women who are addicted to controlled substances and urged the
Council to find a way to intervene in their lives. He asked that the original part of the
Southern Baptist Church of Glendale be preserved. He thanked police officers for their
dedication and the City Clerk's Office for their courteous and professional manner.
Ms. Debbie Sawyer, a resident of the City of Phoenix, spoke on behalf of the
Thoroughbred and Camelback Farms "Good Neighbors" action plan group. She read a
prepared statement, copies of which were submitted for the record.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Clark announced that three meetings regarding the development
of the Ellman Company site have been scheduled for October 16, 17 and 18. She
explained that the three meetings would be identical, allowing all citizens a chance to
attend. She encouraged all Glendale residents to attend.
Councilmember Goulet thanked the Fire Department for the parade last
Saturday and for all they do to protect the citizens of Glendale.
Councilmember Lieberman noted that a Cactus District meeting will be held at
Horizon School at 7:00 p.m. on October 11, 2001 . He greeted the boy scouts present.
He said he has always tried to live by their motto - to do his duty to God and his
country. He listed a number of improvements he has seen throughout the City during
his tenure on the Council. He stated that they would not have been possible had the
City not properly handled its money.
Councilmember Martinez thanked the citizens of the Cholla District who attended
last week's neighborhood meetings.
Councilmember Frate thanked the firefighters of Fire Station 153 for letting him
drive their fire truck during the parade. He mentioned that Mr. Bill Kelleher was the
2001 recipient of the Community Outreach Motivating Excellence for Tomorrow
("Comet") Award.
Mayor Scruggs thanked the scouts for attending the meeting and noted that the
next time they come, the meeting probably will not be short.
