OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA,
HELD MONDAY, DECEMBER 23, 2002, AT 12:55 P.M.
The meeting was called to order by Mayor Elaine M. Scruggs, with Vice
Mayor Thomas R. Eggleston and the following Councilmembers present: Joyce V.
Clark, Steven E. Frate, David M. Goulet, and Manuel D. Martinez.
Absent: H. Philip Lieberman
Please note: Councilmember Lieberman actively participated in the
Executive Session discussion via conference call.
Also present were Ed Beasley, City Manager; Terry Zerkle, Assistant City
Manager; Rick Flaaen, City Attorney; and Pamela Oliveira, City Clerk.
COMPLIANCE WITH ARTICLE VII, SECTION 6(c) OF THE GLENDALE CHARTER
A statement was filed by the City Clerk that the one resolution and the one
ordinance to be considered at the meeting had been posted.
MOTION TO EXCUSE
It was moved by Frate, and seconded by Clark, to excuse Councilmember
Lieberman from today's meeting. The motion carried unanimously.
APPROVAL OF THE MINUTES OF THE NOVEMBER 26, 2002 CITY COUNCIL
MEETING
It was moved by Goulet, and seconded by Frate, to dispense with the
reading of the minutes of the November 26, 2002, Regular City Council meeting,
as each member of the Council had been provided copies in advance, and
approve them as written. The motion carried unanimously.
CONSENT AGENDA
Mr. Ed Beasley, City Manager, read Agenda Item Numbers 2 and 3 by number
and title.
2. PREVENTION OF FAMILY VIOLENCE GRANT
This is a request for City Council to accept a grant offer in the amount of
$2,021.43 from the Governor's Community Policy Office, Division for Prevention of
Family Violence. This office has federal pass-through funds available through the

Children's Justice Act Grant. The Glendale Police Department will use the grant funds
for supplies needed at the Northwest Valley Advocacy Center.
During the two years of operation, the Center has seen a marked increase in its
use by other agencies in the west valley as well as agencies outside Maricopa County
whose investigations have brought them to our area. Projected figures to date are
expected to show a 75 to 100 percent increase over 2001 in use of the Center by other
agencies. Glendale Police Department detectives have also been called upon to assist
smaller agencies with evidence collection in the form of photographing injuries,
confrontation calls, and interviews of both suspects and victims. Detectives at the
Center are required to collect video evidence of crime scenes as well as suspect and
victim interviews that take place off site.
With these grant funds, the Glendale Police Department will purchase
video/audio tapes and computer disks for the Center. There is no match or additional
costs to the City of Glendale associated with this grant.
The recommendation was to waive reading beyond the title and authorize the
submission and acceptance of a grant offer from the Governor's Community Policy
Office, Division for Prevention of Family Violence.
3. LIBRARY SERVICES AND TECHNOLOGY (LSTA) GRANT AWARD FOR THE
"LISTENING TO THE DESERT" PROJECT
This is a request for City Council to accept a Library Services and Technology
(LSTA) grant in the amount of$41,576 for the "Listening to the Desert" Project.
Glendale Public Library and Water Conservation Office staffs, University of
Arizona Cooperative Extension experts and Glendale Community College agricultural
sciences professors will collaborate to develop a multi-media water conservation
education program. The grant will be used to produce a 60-minute self-guided audio
tour of the Main Library xeriscape and ethno-botanical gardens and selected sites at
Historic Sahuaro Ranch. It will also pay for the development and distribution of water-
wise gardening printed materials and a lecture series about what homeowners can do
to save water and incorporate low water use plants into their landscaping plans. An
Internet website, designed and maintained by Glendale Community College, will help
increase public awareness of the ongoing need to conserve water and to live in greater
harmony with our Sonoran Desert environment.
The city of Glendale has been a leader in water conservation for several
decades. Our Main Library has one of the best xeriscape demonstration gardens in the
Southwest. The LSTA grant will be used to enrich and extend Glendale's existing water
conservation education and outreach programs. No City matching funds or future
ongoing costs are required for this project.

The recommendation was to authorize the acceptance of the LSTA grant
described herein and the implementation of the grant project in accordance with all
applicable federal, state and local regulations, policies and contract guidelines.
It was moved by Clark, and seconded by Frate, to approve Consent Agenda
Item Nos. 2 and 3. The motion carried unanimously.
NEW BUSINESS
1. CALL FOR VOTE TO ENTER INTO AN EXECUTIVE SESSION
It was moved by Clark, and seconded by Martinez, to go into Executive
Session to receive legal advice and provide direction to the City Attorney and City
staff regarding a pre-annexation development agreement addressing 240 acres
located at the northwest and southwest corners of 91st Avenue and Bethany
Home Road. The motion carried unanimously.
The Executive Session adjourned and the Special Council meeting reconvened
at 3:35 p.m. Ms. Lisbeth Cortez served as the Acting City Clerk for the remainder of the
meeting.
RESOLUTION
4. PRE-ANNEXATION DEVELOPMENT AGREEMENT
This Pre-Annexation Development Agreement is proposed in connection with the
annexation of the Pendergast parcel for use as Multi-Purpose Facility ("MPF") parking
as well as youth sports fields. The Agreement: (1) provides for annexation of the
property upon adoption of the annexation ordinance by the City Council; (2) confirms
that the Glendale 2025 General Plan designation for the property is Corporate
Commerce Center which allows for office/employment uses together with uses
accessory thereto; and (3) acknowledges that the intended use of the property is
parking for MPF.
The recommendation was to waive reading beyond the title and adopt the
resolution authorizing the City Manager to execute the Pre-Annexation Development
Agreement on behalf of the City of Glendale.
ORDINANCE
5. ANNEXATION ORDINANCE FOR 240 ACRES LOCATED AT THE
NORTHWEST AND SOUTHWEST CORNERS OF 9151- AVENUE AND
BETHANY HOME ROAD (ANNEXATION NUMBER 145)

This is a request to annex approximately 240 acres of land. The site is located
at the northwest and southwest corners of 91st Avenue and Bethany Home Road. The
annexation process was initiated at the request of the property owner. The blank
annexation petition was prepared and recorded on October 1, 2002. A public hearing
on the proposed annexation, as required by Arizona Revised Statutes §9-471, was
conducted by the City Council on October 22, 2002. There was no public comment on
the proposed annexation.
Annexation petitions have been circulated and the City has received a sufficient
number of signatures to meet the statutory requirements for annexation. Property
owners of at least one half of the value of the real and personal property, and more
than one half of all property owners in the proposed annexation area have signed the
annexation petition. The signatures have been reviewed for accuracy and sufficiency,
per statutory requirements. The original signed petition has been filed with the
Maricopa County Recorder's Office.
The recommendation was to waive reading beyond the title and adopt an
ordinance increasing the Glendale City Limits, as defined in the annexation petition for
Annexation Number 145.
Mr. Flaaen recommended Agenda Items 4 and 5 be tabled to allow for further
negotiation.
It was moved by Frate, and seconded by Martinez, to table the Resolution
adopting the Pre-annexation Development Agreement and the Annexation
Ordinance for 240 acres until a future meeting. The motion carried unanimously.
COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Goulet voiced a holiday message to enjoy the holidays.
ADJOURNMENT
There being no further business, the meeting was adjourned at 3:40 p.m.
