CITIZEN COMMENTS
James Deibler, Phoenix resident, expressed his concerned about the statewide increase of the minimum
wage and the impact it would have on small businesses.
Julie Effron, Barrel District resident, expressed her concern about the uncertain future of the Glen Lakes
Golf Course. She requested that the City share what was planned for the golf course.
Manuel Padia, Barrel District, was a member of the Friends of Glen Lakes community group. He
understood the challenges with running a golf course. An investment in the asset was necessary to
attract customers. There were opportunities to promote and improve the golf course.

22. ORDINANCE NO. 018-10
AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO
EXECUTE AND FILE AN AIRPORT LAND LEASE AGREEMENT WITH JAMES W. ROWAN
TRUST DATED OCTOBER 12, 1999 FOR CERTAIN PROPERTY AT THE GLENDALE
MUNICIPAL AIRPORT.

Ms. Bower read the ordinance by title.
Mr. Ebersole said the request was to waive reading beyond the title and adopt an ordinance
authorizing the City Manager to enter into a land lease agreement with James W. Rowen Trust
for land for Hangar No. 9.
Mr. Ebersole said eight south box hangars were constructed as padof a,December 1, 1997
development agreement and 40-year land lease with Corporate Holdings Inc., at the Glendale
Municipal Airport. Corporate Holdings had two shareholders: Mr. Tim Brown and the Chin Yi Tu
Family Living Trust. On March 15, 2005, Mr. Brown sent a letter advising the City of his
resignation as president of Corporate Holdings and that all contact with Corporate Holdings
should be directed to the vice president, Mr. Chin Tu, who was assuming the managerial control
over the property.
Mr. Ebersole said in April, 2006 the City discovered that Corporate Holdings was placed in
receivership for the distribution of corporate assets (which included its leasehold interest in the
eight airport hangars). As part of that corporate dissolution and distribution of corporate assets,
Corporate Holdings transferred its interest in four aircraft hangars to Mr. Chin Tu, the last
remaining shareholder of Corporate Holdings. The land lease with Corporate Holdings was
terminated and Mr. Chin Tu (Chin Yi Tu Family Living Trust)was given a new 40-year lease for
the four aircraft hangars.
Mr. Ebersole said in 1997, James W. Rowan Trust purchased one of the eight hangars. James
W. Rowan Trust, along with three of the other south box hangar tenants, retained hangar
occupancy rights under the 1997 lease, with the initial rent rate to the City established at$250
per month, per hangar.
Mr. Ebersole said the Transportation Department and City Attorney staff had evaluated the issue
and concluded the lease terms should be the same for all of the original south hangar
occupants. It would be consistent with Federal Aviation Administration policy and City best
practices to create a new lease for James W. Rowan Trust that would extend the term to 2046,
matching the original owner's 2006 lease.
Mr. Ebersole said at its September 09, 2017 meeting, the Aviation Advisory Commission
approved a motion to recommend that Council adopt an ordinance authorizing the City Manager
to enter into a Lease Agreement with James W. Rowan Trust for Hangar No. 9 at the Glendale
Municipal Airport.

25. ORDINANCE NO. 018-13

LINE AND FIBER OPTIC LINE LOCATED AT COPPERWING IN THE 115TH AVENUE
ALIGNMENT SOUTH OF GLENDALE AVENUE AND DIRECTING THE CITY CLERK TO
RECORD A CERTIFIED COPY OF THIS ORDINANCE.

Mr. Beard said the request was for Council to waive reading beyond the title and adopt an
ordinance accepting a new easement for an existing reclaimed water line and fiber optic line in
the 115th Avenue alignment south of Glendale Avenue within the Copperwing Special Use
District.
Mr. Beard said in 2001, the City constructed a 30-inch reclaimed water line and associated fiber
optic line within the 115th Avenue alignment south of Glendale Avenue. The pipeline conveyed
reclaimed water from the City's West Area Water Reclamation Facility to the City's Aquifer
Recharge Facility located one-quarter mile to the west.
Mr. Beard said during the zoning case associated with the Copperwing Special Use District, it
was discovered that the easement shown on the construction documents for the reclaimed water
line and fiber optic line was never obtained from the property owner. The owner of Copperwing,
John F. Long Family Revocable Living Trust, was now granting the City an easement for the
reclaimed water line and fiber optic line so that the City could maintain, operate, repair, replace
and remove if necessary the effluent line and fiber optic line.
Mr. Beard said staff recommended acceptance of the easement for the existing reclaimed water
line and fiber optic line. There would be no impact on City departments, staff or service levels.
There might be minimal costs incurred to the City for operating and maintaining the reclaimed
water line and fiber optic line in the future.

26. ORDINANCE NO. 018-14

ARIZONA, AUTHORIZING THE ABANDONMENT OF 48TH AVENUE RIGHT-OF-WAY SOUTH
OF MYRTLE AVENUE AND DIRECTING THE CITY CLERK TO RECORD A CERTIFIED COPY
OF THIS ORDINANCE.

Mr. Beard said the proposed ordinance would abandon public right-of-way on 48th Avenue
adjacent to 4803 West Myrtle Avenue.
Mr. Beard said the owner of the residence at 4803 West Myrtle Avenue was requesting the City
abandon a 12-foot strip of right-of-way in 48th Avenue consisting of approximately 1,548 square
feet. The owner's house currently extended into the existing right-of-way by approximately 6 feet.
The 12-foot wide abandonment would remove the house from the right-of-way and provide a
5-foot setback to the structure. The remaining right-of-way on 48th Avenue would be 48 feet
which provided sufficient room for any improvements the City might do in the future.
Mr. Beard said there were no objections to the abandonment of the right-of-way from the public
utility companies or from City departments. Staff recommended abandonment of the
right-of-way. There would be no impact on City departments, staff or service levels as a result
and there were no costs incurred to the City.
Councilmember Clark asked when the house was built and why no one realized that it was being
built in City right-of-way.
Mr. Beard said the house was built fifty years ago and he didn't know why it wasn't caught at the
time.

Mr. Beard said the proposed resolution would authorize the City Manager to enter into a Land
Use License with Salt River Project Agricultural Improvement and Power District(SRP)for the
nonexclusive right to enter upon and use USA fee land located near the Grand Canal and
Bethany Home Road.
Mr. Beard said in November 2016, the City entered into a Construction Escrow Agreement with
the Arizona Cardinals Football Club, LLC for the construction of a pedestrian tunnel under
Bethany Home Road and for the design and construction of two pedestrian bridges to span the
Grand Canal and the Bethany Home Outfall Channel. In order to enter or cross existing SRP
real property(Grand Canal) along Bethany Home Road, SRP required the City to enter into a
Land Use License. There would be no impact on City departments, staff or service levels as a
result and no costs were incurred by the City.

Mr. Beard said the proposed resolution authorized the City Manager to enter into a Property Use
License with Salt River Project Agricultural Improvement and Power District(SRP)for the PS
(Black) Parking Lot project.
Mr. Beard said the City/was constructing the PS (Black) Parking Lot at Bethany Home Road and
95th Avenue. The project also included the full width construction of Montebello Avenue, a traffic
signal at Montebello and 91st Avenues and a water line in Montebello Avenue from 91st to 95th.
Avenues. Portions of the improvements being made as part of the project were on land owned
by SRP at 91st and Montebello Avenues and on Bethany Home Road, west of 91st Avenue. A
Property Use License was required in order to enter or cross existing SRP property.
Mr. Beard said the license would allow for installation of a water line undercrossing, driveway,
traffic signal, and sidewalk improvements at the 91st Avenue and Montebello Avenue
intersection as well as irrigation conduit and headwall removal in Bethany Home Road west of
91st Avenue.

Mr. Beard said there would be no additional impact on City departments, staff or service levels
as a result and there were no costs incurred by the City.
Councilmember Clark wanted to reassure residents of the Pendergast neighborhood that the
actions would have no effect on the residents' right to irrigate.
Mr. Beard said that was correct. There would be no impact.

Clark to approve Resolution No. R18-17.

A motion was made by Vice Mayor Lauren Tolmachoff, seconded by Councilmember Ian
Hugh to hold the next regularly scheduled City Council Workshop on Tuesday, February 27,
2018 at 12:30 pm. in the City Council Chambers, to be followed by an executive session
pursuant to A.R.S. 38-431.03 and that the regular start time for City Council voting meetings
be changed to 5:30 p.m., beginning with the voting meeting on February 27, 2018.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama thanked City staff for its diligent work.
Councilmember Aldama invited residents to Coffee with a Cop on February 21, 2018, 8:00 a.m. at Shot of
Java in downtown Glendale.
Councilmember Clark said she was sponsoring the 8th Annual Kilt Walk/Run event to be held on March
16, 2018, 6:00 p.m. at"Westgate. She invited everyone to participate.
Vice Mayor Tolmachoff reported that the shred event, hosted by herself and Councilmember Malnar, was
very successful. She said there were 547 cars in under four hours, filling 4 trucks with 26,504 pounds of
material to be shredded.

Mayor Weiers introduced the Transportation Department's newest intern, Jada Page. Ms. Page was
earning academic credit at Centennial High School through the 100-hour internship.
Mayor Weiers said.there were two retired Glendale police cars in the basement of the parking garage that
were being re-purposed for use by the Puerto Penasco, Mexico police department, at no cost to Glendale
taxpayers. Members of the Glendale Chamber of Commerce had purchased the two cars and repainted
and re-lettered them.
Mayor Weiers said when the Puerto Penasco mayor had shared the difficulties faced by his impoverished
city, Mayor Weiers had recruited Chamber members to help. An event was being held in Puerto
Penasco, called Amigos Ayudando a Amigos or Friends Helping Friends, and would be attended by the
governor of Sonora, Mexico and dignitaries from the Tohono O'odham Nation. The event would celebrate
the fact that there were people willing to make a difference.
Councilmember Aldama said the lettering on the vehicles read, "Puerto Penasco Policia Municipal"or
Puerto Penasco Municipal Police.
Mayor Weiers had visited Albuquerque, New Mexico to check out the homeless program established by
Albuquerque's mayor. The program provided day work in an effort to break the cycle of homelessness.
Mayor Weiers wanted to establish a similar program in Glendale and would be bringing it to Council in
the future for discussion.
