AN ORDINANCE OF THE COUNCIL OF THE CITY OF
GLENDALE, MARICOPA COUNTY, ARIZONA, VACAT-
ING AND ABANDONING CERTAIN RIGHT-OF-WAY ON
MYRTLE AVENUE BETWEEN 48TH AVENUE AND 48TH
DRIVE TO THE OWNER OF RECORD OF THE ADJOIN-
ING PROPERTY; AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE as
follows:
LECTION 1. That the following described real property
be, and the same hereby is, vacated and abandoned, to -wit:
Beginning at the Northeast corner of Lot 22 of
Rancho Del Higo Amended, in the Southwest Quarter
Section 4, T2N, R2E of the Gila and Salt River Base
and Meridian, Maricopa County, Arizona, thence West
along the North boundary of said Lot 22 a distance
of 116.6 feet, more or less, to the true point of be-
ginning; thence South a distance of 5 feet to a point;
thence West 5 feet South of and parallel to the North
boundary of said Lot 22 a distance of 198.40 feet to
a point; thence North 5 feet to the Northwest corner
of said Lot 22; thence Northeasterly on a 450 angle
a distance of 14.14 feet, more or less, to a point
10 feet East of and 10 feet North of the Northwest
corner of said Lot 22; thence East parallel to the
North boundary of Lot 22 a distance of 188.40 feet to
a point; thence South a distance of 10 feet to the
true point of beginning.
SECTION 2. The above described real property is hereby
vacated and abandoned to the abutting property owners as their
interest may appear on February 22, 1972, as evidenced by the
records of the County Recorder of Maricopa County.
SECTION 3. WHEREAS the immediate operation of the pro-
visions of this Ordinance is necessary for the preservation of
the public peace, health and safety of the City of Glendale,
an emergency is hereby declared to exist, and this Ordinance
shall be in full force and effect from and after its passage,
adoption and approval by the Mayor and Council of the City of
Glendale, and it is hereby exempt from the referendum provi-
sions of the Constitution and laws of the State of Arizona.
