AN ORDINANCE OF THE COUNCIL OF THE CITY OF
GLENDALE, MARICOPA COUNTY, ARIZONA,
AUTHORIZING AND DIRECTING THE MAYOR AND/OR
CITY MANAGER AND CITY CLERK TO EXECUTE AN
AMENDMENT TO LEASE AGREEMENT WITH GLENDALE
AVIATION, L.L. C. CONCERNING A FIXED BASE
OPERATION AT THE GLENDALE MUNICIPAL AIRPORT;
AND DECLARING AN EMERGENCY.
WHEREAS, the City of Glendale and Glendale Aviation, L. L. C . ,
f . k. a . Aces Aviation Associates, an Arizona limited liability
company entered into a Lease Agreement dated June 30 , 1993 (the
"Lease" ) by which the City leased certain real property located at
the Glendale Municipal Airport to Glendale Aviation, L.L. C. for use
as a fixed base operation; and
WHEREAS, the City and Glendale Aviation, L. L.C. modified the
Lease by an Amendment to Lease Agreement dated July 1 , 1994 and a
Second Amendment to Lease Agreement dated July 1 , 1995 ; and
WHEREAS, the City and Glendale Aviation, L.L. C. wish to
further amend certain provisions of the Lease ; and
WHEREAS, the City and Glendale Aviation, L. L. C. entered into
a License for Use of Real Property dated January 11, 1995 (the
"License" ) , by which the City granted Glendale Aviation, L . L.C. a
revocable license to use certain property located adjacent to the
fixed base operation, and the City and Glendale Aviation, L. L. C.
wish to extend the term of the License .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
GLENDALE as follows :
SECTION 1 . That the City has determined that certain
modifications to the Lease and an extension of the License, as set
forth in the Third Amendment to Lease Agreement on file in the
office of the City Clerk, are necessary and are in the best
interests of the City and its residents .
SECTION 2 . That the Mayor and/or City Manager and the City
Clerk are hereby authorized and directed to execute the Third
Amendment to Lease Agreement on file in the office of the City
Clerk on behalf of the City of Glendale .
SECTION 3 . Whereas the immediate operation of the provisions
of this Ordinance is necessary for the preservation of the public
peace, health, and safety of the City of Glendale, an emergency is
hereby declared to exist, and this Ordinance shall be in full force
and effect from and after its passage, adoption, and approval by
the Mayor and Council of the City of Glendale, and it is hereby
exempt from the referendum provisions of the Constitution and laws
of the State of Arizona .
PASSED, ADOPTED AND APPROVED by the Mayor and Council of the
City of Glendale, Maricopa County, Arizona, this 28th day of
January, 1997 .
