PARCEL SIZE FOR SENIOR CITIZEN OVERLAY ZONING
SUMMARY
This is a request by the McGill Ranch Partnership to amend the SCO (Senior Citizen Overlay) zoning district.
The amendment will reduce the minimum parcel size for Senior Citizen Overlay zoning from 20 acres to 10
acres in the multi-family zoning districts (R-2, R-3, R-4, R-5). The current 20-acre minimum parcel size will
still be required in the single family residential (RR, SR, R-1) and PAD (Planned Area Development) districts.
The current 20-acre minimum was established to ensure that a homeowners association or property management
company would have the resources to enforce age restrictions prior to any city enforcement. The objective was
also to ensure that subdivisions and apartment complexes were large enough to create the desired senior living
environment.
Reducing the minimum parcel size for multi-residence developments will allow greater flexibility for seniors
only projects and help to accommodate infill development. A minimum parcel size of 10 acres is large enough
to ensure economic viability and establish a senior living environment.
The Planning Commission recommended approval of Z-99-21 at its hearing on November 18, 1999 by a vote of
4-0. One letter in opposition was submitted prior to the hearing. Two people spoke in opposition at the public
hearing. Their primary concern was that the text amendment would encourage apartment development on infill
parcels in central and southern Glendale. A letter in opposition was subsequently submitted on December 28,
1999.

The SCO district is an overlay that works in conjunction with the underlying zoning district. It does not change
the permitted uses, maximum density, or minimum development standards of the underlying district.
Apartments can only be developed on sites zoned for apartment use. Apartments developed under SCO zoning
cannot be converted to non-senior living unless the SCO overlay is removed from the property through the
public hearing process.
RECOMMENDATION
Conduct a public hearing, approve Z-99-21, and waive reading beyond the title and adopt the Ordinance
amending the text of the Zoning Ordinance.

REQUEST:
Amend the text of the Zoning Ordinance to allow SCO (Senior Citizen Overlay) zoning on new
multiple residence developments with a minimum size of 10 acres.
APPLICANT: McGill Ranch Partnership.
DETAILS OF REQUEST:
1. This request will amend Section 6.602 (D)2 of the Zoning Ordinance by specifying a 10-
acre minimum parcel size for Senior Citizen Overlay zoning in the Multiple Residence
(R-2, R-3, R-4, R-5) zoning districts. The present minimum is 20 acres.
2. The minimum parcel size for Senior Citizen Overlay zoning applications in the RR (Rural
Residential), SR (Suburban Residential), R-1 (Urban Residential), and PAD (Planned
Area Development) districts will remain at the current 20-acre minimum.
CITIZEN PARTICIPATION TO DATE:
The applicant sent 355 letters to: persons on the interested parties list for each council district; to
persons who spoke at previous hearings regarding Senior Citizen Overlay zoning; to the
interested party list for Senior Citizen zoning; and to the residents of Casa Compana and Royal
Shadows subdivisions. Ten (10) people contacted the applicant regarding this Zoning Ordinance
amendment. The majority support the change or have no concern. Two (2) persons identified
that they did not generally support Senior Citizen Overlay zoning. The applicant's Citizen
Participation report is attached.
Two people spoke in opposition at the Planning Commission public hearing on November 18,
1999. They would like the minimum Senior Citizen Overlay size to remain at 20 acres. One
letter in opposition was also received prior to the hearing.
A notice of the text amendment was published in the Glendale Star on December 23, 1999. One
letter in opposition was received on December 28, 1999.

PLANNING COMMISSION ACTION:
The Planning Commission recommended approval of this text amendment by a vote of 4-0 on
November 18, 1999.
ANALYSIS:
• The SCO zoning district currently provides the parameters for age restrictive zoning within
Glendale. SCO is an overlay district that works in conjunction with the development
standards and density provisions of base zoning districts (i.e. R1-8 or R-3). The overlay
requires one resident to be 55 years of age or older in conformance with the Arizona Fair
Housing Act, the Federal Fair Housing Act, and the Housing for Older Persons Act of 1995.
Occupancy of persons less than 18 years of age is restricted to 120 days or less per year. The
proposed text amendment does not conflict with the requirements of these Acts.
• The current 20-acre minimum was established to ensure that a homeowners association or
management agency would have the resources to enforce age restrictions prior to any City
enforcement. The objective was also to ensure subdivisions or apartment projects of
adequate size to create a seniors only environment.
• Maricopa County requires a minimum parcel size of 5 acres for Senior Citizen Zoning. Mesa
and Peoria require a 40-acre minimum. None of these jurisdictions distinguish between
single family and multi-family development.
• The RR (Rural Residential), SR (Suburban Residential), and R-1 (Urban Residential) zoning
districts are low density single family districts that allow a density range of 0-8 units an acre.
The multiple residence (R-5, R-4, R-3, R-2) zoning districts provide for higher densities,
generally within a range of 8-30 units an acre. A 20-acre minimum parcel size is appropriate
for Senior Citizen Overlay zoning in the single family residential districts. It appears,
however, that 10 acres is sufficient in the Multiple Residence zoning districts to ensure that
SCO zoning objectives are met.
• Reducing the minimum parcel size for multi-residence developments will allow greater
flexibility for seniors only projects and help to accommodate infill development. Recently
developed apartment sites in Glendale range in size from 12.8 to 22 acres. A minimum
parcel size of 10 acres is large enough to ensure economic viability and establish a senior
living environment.
STAFF CONCLUSION:
The proposed text amendment is not contrary to the objectives of senior citizen overlay zoning
and should be approved.

The City Council must conduct a public hearing and determine if this request is consistent with
the policies and objectives of the General Plan and the intent of the Zoning Ordinance.

GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING
THE ZONING ORDINANCE OF THE CITY OF GLENDALE,
ARIZONA, ARTICLE 6 (ZONING DISTRICTS) BY REVISING

SETTING FORTH AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE as follows:
SECTION 1. That the Zoning Ordinance of the City of Glendale, Arizona, Article 6
(Zoning Districts), Section 6.600 SCO (Senior Citizen Overlay) is hereby amended to read as
follows:

D. On residential communities which meet the intent of the SCO as outlined in 6.601, the

mobile home parks, or multiple residence communities with defined boundaries.
No minimum acreage is required. The SCO District precludes exception parcels.
2. For new developments SCO may be established only on parcels of twenty (20) or
more contiguous acres IN THE RURAL RESIDENTIAL (RR), SUBURBAN
RESIDENTIAL (SR), URBAN RESIDENTIAL (R-1) AND PLANNED
AREA DEVELOPMENT (PAD) ZONING DISTRICTS. NEW SCO
DEVELOPMENTS IN THE MULTIPLE RESIDENCE (R-5, R-4, R-3, R-2)
ZONING DISTRICTS MAY ONLY BE ESTABLISHED ON PARCELS OF
TEN (10) OR MORE CONTIGUOUS ACRES and—must. SCO ZONING

Gentlepersons:
We hereby request a text amendment to Section 6.602 of the City of Glendale Zoning
Ordinance (also known as the Senior Citizen Overlay Provision) as it pertains to the
minimum acreage requirement for a new development to be built. Specifically we would
propose that the minimum acreage requirement be amended from 20 acres to 10 acres for
Multiple Residence developments (R-2, R-3, R-4 and R-5) zoning districts. This would
leave the minimum acreage at 20 acres for Rural Residential (RR), Suburban Residential
(SR), Urban Residential (R-1) and the Planned Area Development (PAD) zoning
districts.
We currently own a 17.4 acre site in Glendale, which we believe, is eminently suited
for development as a senior apartment project serving 55+ active seniors exclusively. We
are proposing to build an upscale senior development on this land in order to serve the
growing need of the senior community in the west side of the valley. To build this
project under the Senior Citizen Overlay provision will insure its status of being
permanently restricted to occupancy by seniors.
Based on our research Maricopa County and Youngtown have Senior Citizen Overlay
zoning at minimum acreage requirements of 5 acres and Mesa has Senior Citizen Overlay
zoning with a 40 acre minimum acreage requirement. Phoenix, Litchfield, Goodyear,
Avondale, El Mirage, Surprise, Scottsdale, Tempe and Chandler do not have Senior
Citizen Overlay zoning.
Apartment communities that have submitted plans for review to the City of Glendale
have ranged from 7.5 acres to 22 acres. Recent developments that have been approved or
are in review are Coral Stone 19.4 acres at 71st Ave and Bell, Glen Arrow 18.4 acres at
63"I and Beardsley, Vintage 7.5 acres at 66th Ave and Cactus, Fairfield 22 acres,
Arrowhead Springs 20 acres and Camden Apartments 12.8 acres all in the area of the
Arrowhead Mall.
My partner Don Short has built 2 senior projects in Escondido, California. Morning
View Terrace 326 units on 11.6 acres and Terrace Gardens 225 units on 10.8 acres. In
addition he has built in excess of 800 apartment units in various projects. We currently
own 2 other projects here in Arizona, which are not senior projects. Desert Gardens 307
units on 11.156 and Walnut Grove 160 units (all single level) on 8.72 acres. Previous to
Desert Gardens and Walnut Grove we operated Del Mar Terrace 1012 units on 34.910
acres.
We have researched existing senior apartment communities throughout the State as to
their site size. The Orchard in Mesa is 696 units on 12.981 acres, Glencroft in Glendale
has various facilities and is on 14.731 acres, Sun Wood in Peoria is 220 units on 10.216
acres and Phoenix Manor in Phoenix is 450 units on approx. 25 acres.
We believe, after reviewing some of the materials as to when the Senior Citizen
Overlay was created,that the primary focus was on detached housing and mobile home
parks. The reason for such an acreage requirement was to provide the economic viability
of those developments to have managing associations to enforce guidelines. However as
seen by the example of the above stated apartment communities for seniors in existence
and even apartment projects not for seniors the size allows for the economic base and the
obvious management in place to enforce these guidelines.

BRIEF DESCRIPTION OF PROPOSED PROJECT
This participation plan was put together to support our application for a text
amendment to the Senior Citizen Overlay ordinance as it pertains to the
minimum acreage requirement of new development from a 20 acre
minimum to a 10 acre minimum.
BRIEF OVERVIEW OF THE ELEMENTS OF THE CITIZEN
PARTICIPATION PLAN
The plan included a project impact section that discussed our reason for
wanting to reduce the minimum acreage requirement and that this
amendment is not a site specific one and that therefore individual project
owners were not notified. Parties notified were those on various interest
parties lists.
DATES AND SPECIFIC AREAS OF NOTIFICATION
A notification letter was mailed out via first class mail on September
27,1999 with a response deadline of October 7, 1999. There were no other
mailings or newsletters mailed out as part of this plan. No advertisements or
notices in publications were done. This application not being site specific
only parties who have had specific interest in the Senior Citizen Overlay
Ordinance or parties who are on a general interested party's list were
notified. Our request in no way effects existing developments, its residents
or its owners.

He wanted to know why we were interested in targeting seniors and I
explained how we feel about the needs for seniors in Glendale. He was
curious as to why developers wouldn't seek individual variances for their
proposed projects. He said he would put our letter out on the intemet and
others he was associated with.

wanted to know if it pertained to a specific site. I explained this is not a site-
specific application.

She wanted to know what the letter meant. Her only concern is that she
doesn't want another Sun City because she doesn't want support cut off for
schools (taxes).

She lives at Casa Campana. She says they tried to get Casa Campana under
the SCO ordinance and were unsuccessful. She does support senior projects.
She is a real estate agent in Glendale.

He resides in Royal Shadows. He just wanted to know what the letter
means. He says doesn't effect him.
HOW CONCERNS,ISSUES, AND PROBLEMS HAVE BEEN

It was explained to each person who made contact what specifically we were
asking for in the application. Each person was also told that there would be
a public meeting of which they would be notified. They were also told that
if they had any other questions and or concerns even following the October
7, 1999 deadline that they could feel free to call me.

There are no issues that the participants claimed to feel unable to discuss.
And there are no issues we as applicants have or will be unable or unwilling
to discuss.
HOW PROPOSALS HAVE BEEN REVISED TO ADDRESS PUBLIC
CONCERNS
Based on comments received at the Planning Commission Workshop we
have revised our request to change only the minimum required acreage for
new developments with R-2, R-3, R-4 and R-5 zoning to a 10 acre minimum

verses a 20 acre minimum. This is more appropriate to accommodate
multiple residential developments. We are in the process of notifying the 10
respondents of our modified application by mail and by phone for those we
have phone numbers for.

Mayor Scruggs referred to a letter received from Mr. Paul Dobash, who
originated this issue in Glendale 12 years ago, which discussed the efforts made to
establish this overlay. She stated that it was legal for a community or an individual to
bring forward an issue for City action. She affirmed that the Planning Commission had
voted no on the overlay. She noted that other cities in the Valley have successfully
worked with this type of overlay and have successful school districts as well. She
stated that her feelings were best conveyed by a previous speaker, Ms. Kimberly
Omnes. She acknowledged that Casa Campana has always been a senior community
and that restriction was somewhat taken away; therefore, she believed the community
should have the right to apply for the overlay. She assured those present that the
Legal Department had worked with the Ordinance to ensure that no federal laws were
being violated She reminded everyone that if the zoning overlay was enacted, it did
not mean that the zoning would suddenly spread throughout Glendale, it simply gives
an alternate housing choice for those who choose to live that way.

REQUEST: A request by the McGill Ranch Partnership to amend the SCO (Senior
Citizen Overlay) zoning district. The requested amendment would reduce the minimum
size site for a new development with Senior Citizen Overlay zoning from 20 acres to 16
acres.
Mr. Dan Fairbanks summarized the application, discussed the size of typical multi-family
developments, and the minimum size of Senior Citizen zoning districts in other
communities.
Commissioner Potocki asked why the Senior Citizen Overlay zoning was set to 20 rather
than 15 acres, or 25 acres.
Mr. Fairbanks responded that the Council decided that as part of the adoption of the
Senior Citizen Overlay zoning, they wanted a first tier of enforcement, which would be
the homeowners association or management agency. He said it was felt that a
subdivision that was 20 acres in size would have the resources to enforce their own
private deed restrictions before the City would have to be relied upon.
Commissioner Potocki pointed out that if there were 15 acres there would be less people
to go around and it could be controlled better.
Mr. Fairbanks said it was not as much a matter of control as it was a matter of funding
resources.
Commissioner Potocki commented that with regard to an apartment complex, there
would be just as many apartment units as there would be individual homes.
Mr. Fairbanks responded that there would be substantially more units in a multi-family
development per acre than a single family development. He explained that apartments
are often developed at approximately 18 units per acre, whereas single family
development generally occurs somewhere between 2 and 4 units per acre.

Commissioner Potocki asked why the number 20 was originally set when 17 or 16 acres
could be a sufficient size for a multi-family development.
Mr. Fulk responded that it might be appropriate to have a different minimum acreage for
multi-family than single family. He said the 20 acres everyone was thinking of at the
time of the SCO adoption was single family development, not multi-family. He added
that there can be a viable multi-family development on 10 acres.
Mr. Fairbanks stated that the Senior Citizen Overlay could be applied to an R-4 site,
which could be apartments, townhouse, or condominiums.
Commissioner Morgan said it seemed that the attempt with 20 acres was to assure that
economic viability was achieved. He said he did not see a problem with it.
Commissioner Wurbel said her biggest concern was that it would impact the minimum
lot size for future development.
Mr. Fairbanks responded that the minimum lot size within a zoning district is based on
the zoning district. For example, he said in an R-4 zoning district, a developer could
pursue up to 20 units per acre regardless of whether they had SCO Overlay zoning or not.
Commissioner Potocki commented that perhaps there should be a minimum size for
multi-family, and a minimum size for single family development.
Commissioner Mason asked if that could be two provisions.
Mr. Fulk responded that could be done, and it could be tied to the zoning districts. He
said staff would explore that as the report is prepared.

Mr. Dan Fairbanks, Senior Planner, presented an overview of the request. He stated that
approval of this text amendment would reduce the minimum size of a new multi-family zoned
development with Senior Citizen Overlay zoning from 20 acres to 10 acres. He added that staff
received one letter regarding this matter which has been provided to the Commission.
Chairperson Williams opened the public hearing.
Ms. Cathy Oliva, applicant, 8815 West Peoria, Suite 2, Peoria, 85345, stated that over 310 letters
were mailed out and most responses were positive. Ms. Oliva stated that two negative responses
regarding the amendment to the Senior Citizen Overlay Zoning District were received.
Chairman Williams asked why this request was for a minimum of 10 acres for multi-family
zoned properties with SCO overlay zoning.
Ms. Oliva stated that their objective is to encourage other developments to be built under this
ordinance for senior citizen projects. She said their investigations show that ten acres seem to be
appropriate for senior citizen properties.
In response to a question from Chairman Williams, Ms. Oliva stated that her company's plans are
to build a Senior Citizen restricted development on a 17.4-acre parcel.
Mr. Fulk clarified that the request is to amend the text of the ordinance to reduce the minimum
required multi-family acreage from 20 acres to 10 acres. This application does not apply to a
specific parcel.

Ms. Joyce Clark, 8628 West Cavalier Drive, representing the West Glendale Community
Coalition, stated that they recognize the immediate and future need for senior accommodations.
She said that reducing the requirement from 20 acres to 10 acres has implications to the future of
every portion of this community. She said reducing the acreage requirement would make the
concept virtually meaningless. A 10-acre parcel is so small, it would make almost every infill
parcel in the City vulnerable to this type of development. It's a strategy to guarantee that more
apartments will be built especially in central and southern Glendale. There is a possibility that
there may be small, senior living complexes that become non-age restricted in the future. Ms.
Clark asked that the Commission deny this request.
In response to a question from Commissioner Morgan, Ms. Clark explained that what mandates a
senior overlay is one person in the household 55 years or older. She asked what is to prevent an
apartment complex manager from renting to a family that has their grandmother come to live
with them. Ms. Clark stated that might meet the requirements for senior citizen overlay.
In response to a question from Commissioner Morgan, Mr. Fairbanks stated there are two
primary provisions to qualify for senior citizen overlay. The first is that one resident must be 55
years or older. Second, residents 18 years and younger are not allowed to reside within the
district for more than 120 days a year.
Commissioner Morgan stated that a need is trying to be filled. He said to meet that need, they
will need some flexibility. He said allowing a senior citizen overlay on 10 acres, you would need
the availability of small parcels because small parcels are all that remain.
Ms. Clark stated that in a meeting with Dean Svoboda, Planning Director, he indicated when the
senior citizen overlay amendment was first proposed and discussed, there was discussion about
increasing the minimum acreage. Both Council and Staff agreed to a minimum acreage of 20
acres. Ms. Clark believes that there were valid reasons for the 20-acre minimum. Ms. Clark
stated that the Ordinance is not broken, don't fix it.
Mr. Bill Norgren, 8608 West Cavalier Drive, co-chair of the WGCC, speaking as an individual,
questioned "critical mass". He believes that more inforination is needed defining 'critical mass'.
He said there must be a financial size to make the system work. He suggested not to be too
quick to approve this request because whatever is built will last a lifetime.
Ms. Oliva stated that no one has built under this new ordinance. She believes the ordinance is
broken and does need fixing. The minimum acreage only exists for new projects. She hopes
approval of this amendment would encourage senior citizen overlay development.
Chairperson Williams closed the public hearing.
Commissioner Morgan MADE a MOTION to approve Z-99-21. The MOTION was

I have received your letter of October 18, 1999 which includes information about your revised application
to amend the City of Glendale Ordinance concerning Senior Citizen Overlay Districts.
You had originally wished to amend by changing the minimum requirement of 20 acres to 16 acres. You
now propose to further change the minimum requirement to 10 acres.
You may recall that I telephoned you about the earlier proposal which I opposed based on the limited
information which you included. That information stated that the lower minimum allowed"more typically
sized development." You state this amendment request using the same rationale. Nowhere do you
document any studies,any examples or any reason for assuming what is a"typically sized development."
In our experience in the northwest valley it would be more typical to assume that close to a section of land
would be"typical."
I oppose your amendment based on lack of information and also on the philosophy that ordinances should
not be changed simply to accommodate one applicant. This ordinance was developed over a period of
perhaps two to three years with much input from citizens, staff and developers,and I believe it should stand
until proved to be incorrect.

McGill Ranch Partnership is asking to reduce the Senior citizen overlay acreage
requirement from 20 acres to 10 acres.
The West Glendale Community Coalition executive board has reviewed this proposal and is
unanimously opposed to this action.
We looked at this issue not only in terms of the short-term benefits and disadvantages but
with respect to long term results as well.Our first observation is that the McGill Ranch
Partnership is asking this community,its citizens,you and our elected officials to grant
them a concession from the existing ordinance.In and of itself it would not be an issue but
the implications of reducing the Senior Overlay acreage from 20 acres to 10 acres has
implications for the future of every portion of this community.
Reducing the Senior Overlay acreage requirement from 20 acres to 10 acres makes the
concept virtually meaningless.Why continue to have an acreage requirement?A 10-acre
parcel is so small it makes nearly every infill parcel in Glendale vulnerable to this type of
development.
We are certainly aware that there is a great need for senior citizen apartments and we
support efforts to provide more and better facilities. However we are concerned that the
long term results of this particular change represents significant risk to the quality of the
Glendale community.Data suggests that the smaller complexes(under 20 acres)are likely
to have insufficient resources to survive over a longer time span.The "critical mass"
appears to be at least 20 acres. When an inevitable,future money crunch comes for those
below the critical mass,the city will be faced with a much more difficult decision and will
be forced to choose between having the apartments vacant,or having to convert these units
into more affordable non-senior apartments.
Changing this requirement is a strategy that will guarantee that more apartments be built,
especially in central and south Glendale.We have been told that in order for these
complexes to be able to rent in a non age restricted environment a public hearing process
would have to occur to remove the senior overlay. Our concern rests with the fact that no
one can predict future priorities. What may be perceived as a difficult procedure now could
be quite easy to accomplish five or ten years from now.Therefore there is the potential for
small, senior living complexes, sure to spring up if this ordinance is amended, and to
become non-age restricted future slums.
Before serious consideration is given to this application the city should conduct an
independent study of what other communities have found to be the minimum practical size
for this type of development.This study would be crucial in determining what course of
action would be best for Glendale and it's citizens.
There are a lot of small, infill properties in south and west Glendale. We would hate to
indirectly open the door to more apartments that cannot be guaranteed in blood to remain as
senior only.The best way to avoid this dilemma is to deny this amendment and never
construct a complex which does not meet a minimum "critical mass"!
We respectfully request that you deny the applicant's request based upon our conclusions
that:
1.You are not obligated to provide relief for this developer.
2. Reductions of the Senior Overlay acreage requirement make it all but meaningless.
3. There is future potential that complexes such as these could become non-age restricted.
Again,it is important to remember that such an amendment to the Senior Overlay acreage
requirement have implications that can go far beyond the specifics of this individual
applicant. Accommodation of this applicant will probably result in unintended and
unwanted consequences for the future well being of our entire community.

PLANNING COMMISSION ACTION SUMMARY
TEXT AMENDMENT APPLICATION Z-99-21
REQUEST:
A request by McGill Ranch Partnership to amend the text of the Zoning Ordinance to allow
reduction of the minimum Senior Citizen Overlay (SCO) size of a new development in the
Multiple Residence (R-5, R-4, R-3, R-2) zoning districts. The minimum size of a Multiple
Residence district with the SCO overlay would be reduced from twenty (20) acres to ten (10)
acres.
CITIZEN PARTICIPATION:
A. The applicant sent 355 letters to persons on the interested parties list for each council
district; to persons who spoke at previous hearings regarding Senior Citizen Overlay
zoning; to the interested party list for Senior Citizen zoning; and to the residents of Casa
Compana and Royal Shadows subdivisions. Ten (10) people contacted the applicant
regarding this Zoning Ordinance amendment. The majority support the change or had no
concern. Two (2) persons identified that they did not generally support Senior Citizen
Overlay zoning.
B. A notice of the text amendment was published in the Glendale Star on October 28, 1999.
C. A letter in opposition dated November 2, 1999 was submitted by Barbara Garland.
D. The Planning Commission conducted a public hearing on this request on November 18,
1999. The following people spoke at the public hearing:
1. Ms. Joyce Clark, 8628 West Cavalier Drive, representing the West Glendale
Community Coalition, stated that they recognize the immediate and future need
for senior accommodations. She said that reducing the requirement from 20 acres
to 10 acres has implications to the future of every portion of this community. She
said reducing the acreage requirement would make the concept virtually
meaningless. A 10 acre parcel is so small, it would make almost every infill
parcel in the City vulnerable to this type of development. It's a strategy to
guarantee that more apartments will be built especially in central and southern
Glendale. There is a possibility that there may be small, senior living complexes
that become non-age restricted in the future. Ms. Clark asked that the
Commission deny this request.
2. Mr. Bill Norgren, 8608 West Cavalier Drive, co-chair of the WGCC, speaking as
an individual, questioned "critical mass". He believes that more information is
needed defining 'critical mass'. He said there must be a financial size to make the
system work. He suggested not too be too quick to approve this request because
whatever is built will last a lifetime.

FINDINGS:
A. The proposed amendment is consistent with the Arizona Fair Housing Act, the Federal
Fair Housing Act and the Housing for Older Persons Act of 1995.
B. The net effect of the Zoning Ordinance amendment will be to facilitate the use of the
Senior Citizen Overlay zoning district for new multi family developments which are
typically smaller than the present 20-acre minimum size criteria.
COMMISSION ACTION:
Motion made by Commissioner Morgan, seconded by Commissioner Wurbel, to approve
Z-99-21.
